    Hi there, I’m hoping someone can help me. I’ve had this comment today on one of my posts “I’m pretty sure this isn’t an infringement but a parody” which had me scratching my head a little, especially as the clicking on the poster leads to an amazon site for a T-shirt.

    The post is about Christmas presents and all pictures are my own, I don’t think I’ve done anything wrong but I’d rather be sure and take it down before I have an email from someones lawyer!

    It sounds like they were referring to fair use:

    The purpose and character of the use: Why and how is the material used? Using content for criticism, comment, news reporting, teaching, scholarship or research is usually fair. Additionally, using material in a transformative manner, that is to say, in a manner that adds new expression, meaning, or insight, is also more likely to be considered fair use over an exact reproduction of a work. What’s more, nonprofit use is favored over commercial use.

    Do you feel like the poster that you uploaded falls under that category?

    Sorry, I meant that clicking on the gravatar of the person who commented leads to an amazon site. I haven’t uploaded any posters.
    As far as I can see I haven’t uploaded anything that falls under the category of fair use that you mentioned either.

    I’m not sure how these two things are related.

    Someone liked your post, and their Gravatar image links to a product on Amazon. There is no rule against that – you can link your Gravatar profile to any website you choose, even ones you don’t own.

    But I don’t understand how that has anything to do with copyright infringement or fair use.

    If you are referring to the text of the comment itself? If you ask me, that is spam, and you should mark it as spam so our spam filters will know to filter out similar comments to that one in future. Looking at the username they gave only further convinces me that that comment belongs in Spam.
