<p>Southwest Airlines announced on Wednesday that it will launch new service between Chicago Midway and Minneapolis St. Paul beginning in March. Southwest is moving into the Minneapolis St. Paul market right at the time that Northwest and Delta are expected to merge. This merger is expected to reduce service for Northwest at Minneapolis.  </p>
<p>Southwest is a great carrier and then know what they are doing. They would not launch service into a new market if they didn't think they could make a profit. The Minneapolis market needs a good low cost carrier as fares to that city have been very high and with the entry of Southwest, it will bring fares down in the market.</p>
<p>Southwest plans to release more details about the Minneapolis service in the coming months.</p>

<p style="text-align:center;">Pocket is Otsuka's 16th overall single, and the first in the post-LOVE PiECE era. The title track was the CM song for music.jp during the month of November. It reached #5 on the charts, and stayed on the charts for a total of eleven weeks. It was released on the 7th of November, 2007.</p>
<p style="text-align:left;"> <strong><em>Pocket</em></strong> opens with the soft sound of a piano playing alongisde some strings. It creates a very calming atmosphere, and Otsuka's vocals fit this style when they come in. Her voice sounds a bit different compared to the LOVE PiECE album, but I can't really tell how. Maybe it's just me. Either way, it fits the song well, and compliments the arrangement perfectly. After the first chorus, strings are added into the mix as well, and the guitar takes a more prominent role in the song. While I did enjoy the calmer atmosphere the beginning had, the fuller arrangement featured in the second half of the song certainly sounds great as well. A perfect choice for an a-side.</p>
<p style="text-align:left;"><strong><em>Ticket </em></strong>once again opens with a piano, this time with strings accompanying it, but it eventually leads into a much fuller arrangement with a more upbeat sound, featuring similar instruments to what were used in Pocket. Otsuka's voice sounds great in the verse, with maybe a few shakes at the beginning, but they don't seem to fit the chorus as well as they could, as they use the same key as the verse. It doesn't sound as bad in the second chorus, but that could be after getting used to it from the first chorus. After the second chorus, there's a rather enjoyable instrumental that has a heavy focus on the violin, followed by the final verse and a chorus that features less instruments for the first half before going back to normal, and closing with a short, three-second piano solo. It's a nice contrast to Pocket as a whole.</p>
<p style="text-align:left;">Closing the single is <strong><em>LIFE - LOVE CiRCLE</em></strong>. It starts with a short guitar and drum-based solo, before Otsuka comes in with some rather prominent male back-up vocals, and a slight change in her voice. It sounds a bit deeper than it did in Ticket, which is good. However, there's a lot of repetition in the lyrics in the song, and they sound a bit... Odd at this point, especially if you don't know what they mean. It's definitely the poppiest song on the single, and it wins points for that, but it's definitely b-side material. Interesting note, I couldn't for the life of me tell that this song was in total English. That's sone bad Engrish right there.</p>

<p style="text-align:left;">This is a great single from Otsuka. While the second b-side could have been better, both Pocket and Ticket were very enjoyable, and they worked well next to each other through the use of similar instruments and a reminiscent sound despite the differences in tone. A great way to start this era. Hopefully she steers clear from excessive English or learns to speak it better, because as much as I love Otsuka, LOVE - LIFE CiRCLE was just a bad example of the language being used in the Japanese music scene. It's still a good song, but you can just barely understand it. Anyway, it's a great single.</p>

<p>If you people didn't follow the news lately, Tickets for 2010 Winter Olympic (and paralympic) games in Vancouver go on sale as of today! However there is a certain catch that you people should know. There is 1.6 Million tickets up for grabs, but the requests are taken online through the Vancouver 2010 Olympics website. They will go on sale until November 7th, 2008.</p>
<p>Also there are more "catches" that you should people know. The tickets range from $25 to $1,000CDN not including service charges and taxes. Special packages will be available on hand. Despite the methods that the VANOC organizers are taken drastic action, there are many known fraudsters that can cheat the system. Many fraudsters even sell their tickets on eBay, a practice that VANOC officials that are looking out for. The ticketing information can be founded <a href="http://www.vancouver2010.com/en/ticketing-information/-/32334/f64b2s/index.html" target="_blank">here</a>.</p>
<p>By the time the site already opens, the traffic and requests was very high, the site almost crashed! There are many tickets up for grabs and the odds are very high. If my friends Bobby, Jenny, Tarin and Laura were to look at this particular blog posting and I made a mention that Paul and Dave (of the now defunct band Wave) were to get their hands of the tickets, they will say, "I don't care" (in homage to the song by Fall Out Boy).</p>

<p align="left">A Democratic Congressman has warned that a panic atmosphere is being intentionally created in order to get the financial bailout billed passed, further stating that several members of Congress were told before Monday’s vote that martial law will be instigated in America if the legislation fails.</p>
<p align="left">Congressman Brad Sherman of California’s 27th congressional district told the House in a speech yesterday evening that he personally knew of several Congressional representatives who have said they were threatened with the prospect of all out martial law should they vote in opposition to the $700 billion bailout.</p>
<p align="left">Sherman essentially intimated that powerful forces who want the bill passed have attempted to blackmail elected representatives.</p>
<p align="left">"The only way they can pass this bill is by creating and sustaining a panic atmosphere. That atmosphere is not justified." Sherman stated.</p>
<p align="left">"Many of us were told in private conversations that if we voted against this bill on Monday that the sky would fall, the market would drop two or three thousand points the first day, another couple of thousand the second day, and <span style="color:#ff0000;"><strong>a few members were even told that there would be martial law in America if we voted no</strong>.</span>" The Congressman continued.</p>

<p align="left">On the Eve of a second Congressional vote on the legislation, these revelations show that freedom in America is under direct attack. The Congress should instigate an immediate investigation into these serious allegations to uncover which private individuals and administration officials, if any, are involved with directly threatening a military takeover of the workings of the U.S. government.</p>
<p align="left">Sherman’s comments follow those of Rep. Michael Burgess (R-TX), who <a href="http://www.prisonplanet.com/congresswoman-criminal-insiders-behind-bailout-bill.html"><strong>warned Monday</strong></a> that the only information he had received about the bailout was what talking points to use on the American people and that he had been thrown out of meetings for not blindly supporting the bill.</p>

Burgess was referring to the temporary suspension of the rules and procedures of Congress by its leaders so that a bill can be passed quickly.</p>
<p align="left">Sherman’s allegations of threats against elected representatives have also been echoed by outspoken political activist <a href="http://www.youtube.com/watch?v=O59bKQ35vJc&#38;eurl=http://www.wariscrime.com/2008/10/03/news/rep-michael-burgess-martial-law-false-alarm-yet/"><strong>Lyndon LaRouche</strong></a> who told an audience "There are those in high positions who know that if they don’t allow this bill to pass, that there are people behind the Bush Administration who will force them to pass it or kill them…". LaRouche stated that well placed sources had told him that the use of armed troops to enforce the passage of the bill is "reality".</p>

(If you want to see them, <a href="http://www.remnantofgod.org/archives/week05-08.htm#3" target="_blank">click                  here</a>) These executive orders declare that the United States                  Government can, and will seize all communications media, electric                  power, fuels, minerals, food supplies, farmland, farm equipment,                  personal cars, trucks, motorcycles, boats, highways, seaports,                  water ways, health services, educational services, welfare services,                  postal services, banks, housing, railroads, and storage facilities.                  They will also round up as many American citizens as they wish                  for unpaid work forces under federal supervision and even split up                  families if they please. These laws are on the books as we speak.</p>
<p>What do you suppose will grant them                  the legal right do such things? Read Executive Order # 11501 which                  was placed under the list of orders I just summarized above.                  (By the way. This is happening in all countries. I am only reporting                  on the USA agenda)</p>

<p>This is why we see our economy                  failing. They need it to collapse so they can enforce the Executive                  Orders. Or in laymen's terms, enact martial law. Without it,                  the mark of Rome will remain forever out of reach. This is the exact same type                  of stranglehold Hitler had on his nation and the Jews before,                  what that Roman Catholic pawn termed,                  "a purifying of the races" began. This resulted in                   over                  six million dead.</p>
<p>These Executive Orders were put in place for a reason.                  When these laws were announced back in 1996 the economy was booming, and as sheeple                  usually do, they follow along with the herd thinking all is well. But in less then 12 years of passing these                  unjust  laws,                  we now see the economy going from good to worse right before                  our eyes. What's worse is those of us that research this know                  all of it could have been avoided by simply blowing the whistle                  on the men that caused it all. This is not something that happened                  by chance. This was purposely planned.                  But then that would mean we would be able to stop the prophecied                  end result now wouldn't it? I am pleased to say, that won't happen! Our God is                  very capable of exposing such an agenda with crystal clarity                  long before that day arrives. This is "one" of the                  reasons the enemy of souls is so focused on ridding the earth                  of real Christians as Revelation prophecies.</p>

<p>Not only do we expose Satan's                  lies by keeping <a href="http://www.remnantofgod.org/The-Law.htm" target="_blank">the                  Law of God</a> as prophecy said in the last book of the bible                  true Christians will be doing right before the end. But it also                  declares we have the "testimony of Jesus Christ."                  What is that you ask?</p>

<p>The true Christians understand                  prophecy with uncanny ability because we have drawn nigh to                  Christ by worship, study, and obedience. We know today,                  what the Vatican is planning tomorrow, and that get's their                  blood up. Usually we are just tagged "a cult" but                  the truth is, the REAL cult is the Roman Catholic church. <a href="http://www.remnantofgod.org/6SIGNS.htm" target="_blank">Every                  sign attributed to a cult has been documented in  this                  church</a> yet most with                  power ignore this because of her political prowess. Since most                  people don't read or trust Bibles, thanks mostly to the <a href="http://www.remnantofgod.org/B-BIBLES.HTM" target="_blank">Vatican's                  attack on the Word of God</a>,                  they are none the wiser. So the Vatican plays the moral card                  and they all believe it.</p>

<p>So yes, they will do as they plan                  because it is prophecied to occur. These laws will help in forcing most                  of the world to follow Satan over Christ. Most of what                  the Executive Orders speak of won't be long lived in that they                  will try to make society appear as if it's moving along as normal. A                  false sense of security works wonders on large scales like this.                  Truth is, the bulk of the unjust laws will be focused on God's people                  anyway. The wicked                  won't realize much of what we see because of their prophecied                  blindness, as well as their willingness to accept the mark of                  the Roman beast. They will literally be "walking dead." Without                  drawing nigh to Christ by studying His Word each day, they will                  be very easy prey.</p>

<li>Amos 8:11, "Behold, the days come, saith the Lord                      GOD, that <span style="text-decoration:underline;">I will send a famine in the land, not a famine                      of bread, nor a thirst for water, but of hearing the words                      of the LORD:"</span></li>

<p>Only those that understand prophecy will be wise to                  all that's happening. The rest will be pawns in the hands of Satan,                  who will convince them to do all they can against us to ensure their livelihood                  is kept intact. Nice thing about being a Christian is that                  we can handle such trials with smiles. We have been trained                  by the Master. Jesus has already overcome                  the world and educated us on that fact. Our duty is to recruit as many for Heaven as we can.                  So even as Rome was unable to stop the forward flow of the Gospel                  in her first prophecied hellish reign by killing hundreds of                  millions, they will still be unsuccessful in their final reign                  thanks to <a href="http://www.remnantofgod.org/latter-rain.htm" target="_blank">the                  Latter Rain</a> falling more                  abundantly.</p>
<p>Many false preachers are proclaiming <a href="http://www.remnantofgod.org/7yr-trib.htm" target="_blank">a seven year tribulation</a>,                  or <a href="http://www.remnantofgod.org/1000yr.htm" target="_blank">1000 years</a> of peace for their flocks. They will easily                  be deceived                  into a false sense of security by clamoring to the preachers                  that tickle their ears. But the Loud Cry we proclaim                  that brings their sins to the forefront, which in turn causes                  us to become a threat to Rome's agenda, will <span style="text-decoration:underline;">still cut some hearts for Christ. Yes, some of us Christians will have                  a hard row to hoe, but it's so worth it. And again, the wicked                  may not even be aware how bad it is, because Jesus plainly said...</span></p>

<p>I liked the moderator. Now, Biden and Palin made it easy for her because the arguing was minimal, but I thought her questions were good and she wasn't afraid to call someone out for not answering the question she asked.</p>
<p><strong>2. Demeanor</strong></p>
<p>Palin was ner-er-vous. She put herself in this situation so I couldn't feel bad for her, but she seemed downright terrified when the debate began. Her anxiety didn't seem to diminish drastically over the night, perhaps in contrast to how confident Biden seemed. I don't know if that made Palin seem endearing or week or Biden competent or patronizing. What did you think?</p>
<p><strong>3. Talking Points v. Points to Talk About<br />
</strong></p>
<p>Biden knows his stuff, but of course, this makes sense. He's been in Congress for decades, and when Palin would bring up a bill that he, Obama or McCain voted one way or another on, he could talk about that bill and the reasons in far more detail than she ever could because he was involved. This was in stark contrast to the Obama-McCain debate when both candidates intimately knew the details of these bills and could - and did! - argue back and forth about what was what. With Biden-Palin, there was little back and forth and I wonder if it's because she simply didn't know what to talk about. I don't mean this as a criticism (that's left up to how you take her pride about not being of the Washington bunch) but merely as an observation. It seemed that Palin had been seriously prepped with canned lines and points and told to avoid all sorts of other things for fear of a huge mistake. How did you feel?</p>
<p><strong>4. Gaffes</strong></p>
<p>Speaking of huge mistakes, let's talk about the one thing that all the political pundits really wanted to see - a gaffe. Now, I don't know that there were any huge gaffes that can't be undone. Palin did call Joe Biden "O-Biden" and she also told the moderator and Biden that she wasn't there to answer the questions she was asked but to say what she wanted. Palin also referred to her ticket as a "team of mavericks" which is a bit oximoronic - a fact I think was lost on her. Biden was probably advised to say less than he wanted to because the more active he is the more patronizing he appears. In 90 minutes, though, these were not the big things that came out. Did you notice anything particularly outrageous that slipped by me?</p>
<p><strong>5. Summary</strong></p>
<p>It's unclear to me what will come out of this. I don't really want to give you my opinion of the particular political positions as the VP candidates stated them last night - I'd rather discuss the importance of this debate and how the candidates appeared to Americans and the world. However, as an aside, I will mention that I thought it was funny when the moderator established that the two agreed about gay marriage (despite my own disagreement with their mutual opinion). Everyone had a nice chuckle.</p>
<p>Pundits, as they are want to do, said that this debate could be a make-it-or-break-it moment in the political process, but I didn't notice anything happen that would have been so swaying. I know who appeared more competent, more capable and more knowledgable and I know who appeared more presidential (mentally, not physically or genderally), but I also know that a lot of Americans are looking for something else and appreciate the different image that is being provided for them in this race.</p>

The 2003 release of Within Earshot features classical pieces by Shostakovich, Ginastera, Dvorak, Liszt and others. In that same year, Boston Brass collaborated with the Syracuse University Wind Ensemble for a new recording of Christmas classics titled Christmas Bells are Swingin?, which was released in 2004 and featured many of the most beloved tunes of the holiday season. In winter 2005, the Boston Brass All-Stars Big Band was born when the five members of the ensemble were joined by twelve other well known brass players and musicians to record A Stan Kenton Christmas. This recording of holiday music, conducted by brass master Sam Pilafian, features truly phenomenal charts made popular by the Stan Kenton Orchestra and performed with the enormously powerful sound of thirteen horns and jazz rhythm section. <p>In the Balloon Pop Game you will need to control the speed and location of a little <em>Blue Puffle</em>, <em>Floating </em>around in a basket with a red Balloon.  You control your <em>Floating Puffle</em> by moving the floating fan with the red arrow, with your mouse. If you want it to go up, you put the Fan under your your <em>Floating Puffle</em>, down, place it above and to go left or right just place the fan on the opposite side to where you want your <em>Floating Puffle</em> to go. You can move your <em>Floating Puffle</em> faster by holding down your mouse as you use it to move the fan around.</p>

<p>You need to place your <em>Floating Puffle</em> so that it knocks the <em>Floating Targets</em> into the <em>Cactus Plants</em>. If you can get your <em>Floating Puffle</em> to knock the <em>Floating Targets</em> then hit and bust the red parachutes, it will release free tickets that you need to then catch, by placing your <em>Floating Puffle</em> in their pathway. The more<em> Floating Targets</em> that you can bust, means the more tickets that you can collect.</p>

<p>The Puffle Soaker Game is designed like a carnival target game. You will win points for hitting a disk with a puffle image but you will also lose points if you hit the other images on disks, such as Aunt Artic.</p>

<content:encoded><![CDATA[<p>I am extremely interested in how tonight's Vice Presidential debate is going to go as I spent the entirety of last night (this is not a joke nor an exaggeration) watching interviews that Sarah Palin has done thusfar as prospective future Vice President or perhaps even President of our United States of America.</p>
<p>Honestly, I was -addicted- after just seeing one clip of her, unable to name a single Supreme Court case decision that she disagreed with, outside the chosen topic of Roe v. Wade.</p>
<p>What I learned from my several hours research, aside from her entire personal and political history,</p>
<p>(she was a beauty queen in 1984, once mayor in Wasilla she cut funding for building a new Town Hall and public library before putting the town in 1.3 million dollar debt to fund a new hockey rink, she attended five different colleges before getting her degree in broadcast journalism)</p>
<p>is that she is, honestly and truly, the most idiotic politician that I've ever had the displeasure of hearing speak. (And that's even considering President Bush)</p>
<p>She can't even name ONE goddamn newspaper in our country, I am serious about this, look up "Sarah Palin newspaper" on youtube if you're interested in that little disaster. I actually encourage you to watch the entire clip of that interview as the ending is really actually hilarious.</p>
<p>Sarah Palin's answers to Katie Couric's questions make her like a high school kid who is trying to bullshit their way through an essay test that they haven't studied for. </p>
<p>Here's a clip of the transcript: </p>
<p>Couric: You've said, quote, "John McCain will reform the way Wall Street does business." Other than supporting stricter regulations of Fannie Mae and Freddie Mac two years ago, can you give us any more example of his leading the charge for more oversight? </p>
<p>Palin: I think that the example that you just cited, with his warnings two years ago about Fannie and Freddie - that, that's paramount. That's more than a heck of a lot of other senators and representatives did for us. </p>
<p>Couric: But he's been in Congress for 26 years. He's been chairman of the powerful Commerce Committee. And he has almost always sided with less regulation, not more. </p>
<p>Palin: He's also known as the maverick though, taking shots from his own party, and certainly taking shots from the other party. Trying to get people to understand what he's been talking about - the need to reform government. </p>
<p>Couric: But can you give me any other concrete examples? Because I know you've said Barack Obama is a lot of talk and no action. Can you give me any other examples in his 26 years of John McCain truly taking a stand on this? </p>
<p>Palin: I can give you examples of things that John McCain has done, that has shown his foresight, his pragmatism, and his leadership abilities. And that is what America needs today. </p>
<p>Couric: I'm just going to ask you one more time - not to belabor the point. Specific examples in his 26 years of pushing for more regulation. </p>
<p>Palin: I'll try to find you some and I'll bring them to you. </p>
<p>I thought, perhaps, that this was some kind of sick dream that I could not wake up from, but alas, this is as real as the fact that Sarah Palin fired the Wasilla librarian as Mayor because librarian responded that she would not ban books for Sarah or that she had rape victims pay for their own rape kits, making rape the only crime that  victims needed to pay for investigation.<br />
(Before a disgusted legislator drafted a bill specifically to curb Wasilla's contagious disgrace) </p>
<p>I spent HOURS, in complete and utter awe of just how unforgivably ignorant Governor Palin is about any issue concerning our country, though she claims to know all,  confidently muddling through some of the worst shit I've ever heard come from a person. <br />
Who does she think she's kidding, HONESTLY?</p>

<p>She's had four days to "study up," though I personally believe that she's done quite enough damage to convince any competent voter that she is NOT ready to take the presidency should John McCain pass away during his first term</p>
<p>(an absolute possibility as he is oldest prospective president at 72 and has had cancer four times.)</p>
<p>If she does not "hit a homerun," I really hope John McCain considers pulling her from the ticket,<br />
though this will prove a likely devastation to his campaign.<br />
(Though probably a saving grace in comparison to the current sinking numbers) </p>
<p>What I believe the issue here with that is that John McCain is afraid that if he removes her from the ticket, especially "too soon," he will come under fire for doing what might be considered as <br />
 the absolute disservice to American citizenss of picking a Vice President purely from image rather than through careful consideration of her as an able leader of our country and informed person concerning policy and the economy (obviously one of his greatest weaknesses and at the most dire time in years that strong economic leadership is needed).</p>
<p>It's no secret that John and Sarah had met ONE time before he chose her as his running mate, why would he add insult to injury by pulling her from the ticket and scramble for a new pick before at least giving her the chance to do herself in at the debate or, with any luck, charm the shit out of the American people with such grace that they forget that she is a total gung-ho moron with even less experience than Barack Obama and no passport to even go overseas, let alone an interest in strong foreign policy. </p>
<p>(This is a huge deal, we need our leader to have an international framework already established upon taking the presidency or vice presidency at this time. We don't have weeks available for this small-talk "Hi, how are you, I'm from Alaska, I love hunting" jerk-off bullshit right now. </p>
<p>Especially not if that person wants to invade and control every goddamn country that's not behaving exactly to Miss Palin's liking, like, for example, Russia. <br />
Yes, Palin mentions that we should start getting itchy about RUSSIA, as if THAT'S what we need right now. We're already in a mess where our imperialism is biting us in the nutsack.</p>
<p>I think Governor Palin needs to be reminded that forcing ideology on others is absolutely un-democratic.<br />
Maybe it's just really rubbed off on her being the dictator over five children or perhaps it's that oh-so- extremist Assembly of God that she belongs to that gives her that attitude.<br />
(Yes, she would love for Creationism to be taught in schools) </p>
<p>My intuition tells me that McCain did not anticipate such a disaster and that he does, in fact,<br />
view it as such. </p>
<p>I believe that the hope here is that Governor Palin will step down from the ticket herself,<br />
but from her interviews, I highly doubt that that will become a possibility. </p>
<p>She is far too starry-eyed and stubborn and truly believes that she is "absolutely" ready to lead our country.</p>
<p>However, she is also the one who believes that dinosaurs and man co-existed together 6,000 years ago. I'd like to see the striking evidence for that argument. </p></div>

<p>Any mistake or gaffe by Palin could be fatal with a new poll finding voters are now questioning their commitment to Republican presidential candidate John McCain because of her. </p>
<p>About one third of likely voters, 32 percent of likely voters now say Palin makes it less likely they'll vote for McCain, according to the ABC News/Washington Post poll released today. </p>

<p>The poll found a minority of likely voters, 35 percent, believe she is experience enough to be president. </p>
<p>The ABC poll also suggests that questions about Palin are reinforcing concerns about McCain's age. Almost half of voters, 48 percent, now say the senator's age is a worry -- a new high -- and 85 percent of that group say that Palin is not qualified to serve as President.</p>
<p>It hasn't been an easy month for the Alaska governor. Palin initially boosted McCain's poll numbers, but after refusing to speak to the media she gave a few select interviews where she gave muddled responses. </p>
<p>Contributing to her perception problem: more voters have likely seen the Saturday Night Live sketches making fun of her rather than hearing her speak on the campaign trail. </p>
<p>It's all cementing in the minds of voters a preconceived notion that Palin is ill-prepared for the job. </p>
<p>Biden's poll numbers contrast starkly with Palin's with 75 percent of Americans saying he understands complex issues, 70 percent saying he has suitable experience to take over as president if necessary, and just 13 percent saying the Delaware senator makes them less apt to support Democratic presidential candidate Barack Obama.</p>
<p>In his debate against Palin tonight, Biden will try to show gracious restraint, and focus his attacks against McCain, Obama campaign aides tell ABC News. </p>
<p>Meanwhile McCain campaign aides say Palin will attempt to aggressively take the fight to Obama. </p>

<p>LOST GOODS — RIGHTS OF FINDER — FALSE ARREST — ASSAULT — PLEADING — GENERAL DENIAL — INSTRUCTIONS — EVIDENCE — VERDICT — PUNITIVE DAMAGES — COMPENSATORY DAMAGES — NECESSITY.</p>
<p>1. Plaintiff found a pocketbook in a place of amusement, when he started for the ticket office, to leave it there. The office was closed, and he was accosted by three of defendant's employés, who each asserted himself to be the proper person with whom the pocketbook should be left. Plaintiff refused to deliver the pocketbook to any one except a uniformed ticket seller or police officer, when defendant's employés assaulted and arrested him, and took him to a policeman, who took the pocketbook, but refused to continue plaintiff's arrest, which defendant's servants demanded. Held, that an instruction, in an action for unlawful arrest and assault, that the amusement company had a right to exercise reasonable care to protect the property of the true owner, inadvertently mislaid or lost upon its premises, and that if defendant and its manager only endeavored to obtain from plaintiff valuables so found, to keep them for the true owner, their request was not unreasonable, and defendant had the right to eject plaintiff on his refusal to comply with their request, using such force as was necessary, was erroneous, where the property had been lost, and plaintiff, therefore, as the finder, being entitled to its possession as against every one except the true owner.</p>
<p>2. The instruction was also erroneous as not supported by the evidence, since the assault was not committed for the purpose of ejecting plaintiff from the premises, but in an unlawful arrest.</p>
<p>3. Where plaintiff sued for an unlawful arrest and assault committed by defendant's employés for his refusal to deliver a pocketbook he had found on the ground in defendant's place of amusement, and defendant pleaded a general denial, such plea was insufficient to present a defense that it was the defendant's duty to protect lost property, and that, if plaintiff unreasonably refused the request of defendant's employés to deliver the pocket book, defendant was entitled to eject plaintiff from the premises, using such force as was necessary.</p>
<p>4. Where plaintiff was assaulted and arrested by reason of his refusal to deliver a pocketbook found on defendant's premises to defendant's employés, evidence of defendant's system in making a record of lost articles, and of its advertising the finding of the pocketbook in question, was inadmissible in an action for such assault.</p>
<p>5. In an action for assault and unlawful arrest, a verdict assessing plaintiff one cent punitive damages, and finding no compensatory damages, was erroneous, since actual damages must be found, as the predicate for the recovery of exemplary damages.</p>
<p>6. A jury found that defendant arrested plaintiff, and cursed and abused him, with no lawful excuse whatever. Held, that he was entitled to have damages, to some extent, assessed in his favor.</p>

<p>BURGESS, J.</p>
<p>This is an action for $5,000 damages alleged to have been sustained by plaintiff by reason of an unlawful arrest and assault and battery by the employés of the defendants of and upon him. On the evening of June 24, 1898, plaintiff was at Forest Park Highlands, a place of amusement and refreshment in the city of St. Louis, operated by defendant company, all parts of which are open and free to the public, except the open-air theater, which is fenced off from the rest. He attended the performance at the theater, and, after its close, sat down at one of the tables, which were scattered about the grounds, when he found a pocketbook lying on the ground. He at once started with it to the ticket office, for the purpose of leaving it there. The window was closed, but, in his efforts to attract the attention of those within, he was observed by the head waiter, who asked what he wanted. When told by plaintiff that he had found a pocketbook, this man claimed that he was the proper party to whom to deliver it. Another employé then approached, and he likewise claimed to be the proper custodian. A private watchman then came up and informed plaintiff that he was the right man to take it; and finally defendant Scherf was called, and, after telling plaintiff that he was the manager, demanded that plaintiff give it to him. Plaintiff refused to do so, telling each of the men, in turn, that he did not know him, and that he would deliver the pocketbook only to the ticket office or to a uniformed police officer. He had not shown it to any one, and, except for his statement, they would not have known he had it. His refusal angered the men, — particularly Scherf. They became violent, abusive, and profane in their language to him, and thereby attracted a large crowd. He handed his card to each one of them, but they all refused to take it. After detaining him some time, and refusing all the while to comply with his request to get the ticket office open or bring a police officer, Scherf ordered the others to arrest him. This they did. They took plaintiff from the ticket office, in the southern part of the grounds, to the street-car entrance, on the north, — a distance estimated by different witnesses at from 200 feet to 200 yards. Here they found a policeman, who took the pocketbook, but refused to continue the arrest, although Scherf demanded it. Plaintiff's clothing was disarranged, and he was so roughly handled that that night he found on his arms marks made by the two watchmen. They cursed him, and were violent and abusive. There was a large crowd, composed of people who were sitting around at the tables, and people who, like plaintiff, had attended the theater, and were starting home. The jury gave plaintiff no compensatory damages, but gave him one cent punitive damages! Having moved unsuccessfully for a new trial, plaintiff appeals to this court.</p>
<p>The only points urged upon this appeal for a reversal of the judgment of the trial court are error in giving instruction No. 5 on the part of defendants, and that the verdict was against the evidence, and must have been the result of bias or prejudice.</p>
<p>The instruction complained of reads as follows: "The court instructs the jury that the defendant Forest Park Highlands Amusement Company not only had the right, but was in duty bound, to exercise reasonable care to protect, for the true owner, all valuables inadvertently mislaid or lost upon its premises; and if the jury find that the defendant company and Henry Scherf, its manager, only endeavored to obtain from the plaintiff valuables so found for the purpose of keeping the same safe for the true owner, then their request was not unreasonable, and the defendants had the lawful right to eject the plaintiff from said premises upon his refusal to comply with their request, and in doing so the defendants could use such force as was necessary."</p>
<p>The argument is that the statement in this instruction that the request of the defendants for possession of the pocketbook found by plaintiff was not unreasonable is incorrect, because the defendants had no right to its possession. All of the authorities hold that the finder of a lost chattel is entitled to its possession as against all other persons, except the true owner. The finder has a special property in the chattel found, sufficient to maintain trover against every person except the true owner. 2 Kent, *356 (Lacy's Ed. 1892, p. 453); Darlington, Pers. Prop. 35-37. And generally the place in which it is found creates no exception to this rule. Hamaker v. Blanchard, 90 Pa. 377, 35 Am. Rep. 664. In that case a domestic servant in a hotel found in the public parlor a roll of bank bills. She immediately informed the proprietor of the hotel, who suggested that the money belonged to a transient guest of the house, and received it from the servant, to hand to him. It was afterwards ascertained that the guest did not lose the money, and upon demand by the servant for the return of the money the proprietor refused to return it to her. She brought suit for the money, and it was held that she was entitled to recover. In the case of Bowen v. Sullivan, 62 Ind. 281, 30 Am. Rep. 172, an employé in a paper manufactory, while engaged in assorting a bale of old paper purchased by the proprietor for manufacture, found certain lost genuine bank bills inclosed in a clean, unmarked, and</p>

<p>undirected envelope, which had formed part of such bale, and, for the purpose of ascertaining whether they were genuine, delivered them to the proprietor, upon his promise to return them, who, upon demand, refused to do so, whereupon the finder instituted suit for their value. Held, that she was entitled to recover the value of the bank bills, as against the defendant. Durfee v. Jones, 11 R. I. 588, 23 Am. Rep. 528, the plaintiff had bought an old safe, and soon thereafter instructed his agent to sell it again; he in the meantime having permission to use it. The agent found between the outer casing and the lining a roll of bank bills, belonging to some person unknown, whereupon the owner of the safe first demanded the money, and then demanded the safe and its contents as they were when the agent received them. The agent returned the safe, but retained the money. In an action brought by the owner of the safe for the money found, held that, as against the plaintiff, the agent was entitled to retain the money, and that the place where it was found made no difference. Now, the authorities, as a general rule, hold that money or other property voluntarily laid down and forgotten is not, in legal contemplation, lost, and that the owner of the shop, bank, or other place where it is left is the proper custodian, rather than the person who happens to discover it, as well, also, as to all other persons except the owner. State v. McCann, 19 Mo. 249; Lawrence v. State, 1 Humph. 228, 34 Am. Dec. 644; <a title="Summary of McAvoy v. Medina" href="http://www.lawnix.com/cases/mcavoy-medina.html">McAvoy v. Medina</a>, 11 Allen, 549, 87 Am. Dec. 733; Kincaid v. Eaton, 98 Mass. 139, 93 Am. Dec. 142. The question, then, was as to who was the proper custodian of the pocketbook in question, — the plaintiff or defendant? It is clear, we think, under the evidence, that the pocketbook was not laid down and forgotten, for certainly it would not have been left intentionally upon the ground, under the table, but was dropped there, or in some other way came there accidentally, and was, within contemplation of law, lost when plaintiff found it.</p>
<p>Another objection urged against the instruction is that it told the jury that defendants might use force to eject the plaintiff from the premises for refusal to comply with their request. But as plaintiff had the right to retain the property as against all other persons except the true owner, it logically follows that defendants had no right to eject him from their premises upon that ground, even if they had attempted to do so; but the record discloses that, instead of ejecting him, they arrested him, and that, too, without authority. Hence the instruction was without evidence or law upon which to predicate it, and is erroneous for these reasons, also. Moreover, no such issue was presented by the pleadings; the answer being a general denial, while the matters covered by the instruction, if thought to be available as a defense, should have been pleaded in the answer.</p>
<p>But the instruction is erroneous for the further reason that it told the jury that the defendant company "was in duty bound to exercise reasonable care to protect, for the true owner, all valuables inadvertently mislaid or lost on the premises," when the finder of property which had been lost on the premises was himself entitled to its possession and custody against every person except the owner.</p>
<p>The testimony concerning respondent's system of making a record of lost articles was clearly inadmissible, and no defense whatever for the illegal arrest of plaintiff, and the same may be said as to the advertisement by defendant with respect to the loss and finding of the pocketbook.</p>
<p>It is claimed that the judgment should be reversed upon the ground that the jury, by their verdict, gave the plaintiff no compensatory damages, while they assessed in his favor punitive or exemplary damages at one cent. It is held in 1 Suth. Dam. § 406, and Kiff v. Youmans, 86 N. Y. 324, 40 Am. Rep. 543; Stacey v. Publishing Co., 68 Me. 279; Freese v. Tripp, 70 Ill. 499; Maxwell v. Kennedy, 50 Wis. 648, 7 N. W. 657; Jones v. Matthews, 75 Tex. 1, 12 S. W. 823; Trawick v. Martin-Brown Co., 79 Tex. 466, 14 S. W. 564; Schippel v. Norton, 38 Kan. 567, 16 Pac. 804; Kuhn v. Railway Co., 74 Iowa, 137, 37 N. W. 116; and Mills v. Taylor, 85 Mo. App. 111, — that actual damages must be found as a predicate for the recovery of exemplary damages. The verdict, therefore, seems to be inconsistent with itself, for when no actual damage has been sustained, as found by the jury in the case at bar, no exemplary damages can be allowed, nor can exemplary damages constitute the basis of a cause of action, for they are mere incidents to it, and, when given, they are not given upon any theory that the plaintiff has any just right to recover them, but are given only upon the theory that the defendant deserves punishment for his wrongful acts, and that it is proper for the public to impose them upon the defendant as punishment for such wrongful acts in the private action brought by the plaintiff for the recovery of the real and actual damages suffered by him. No right of action for exemplary damages, however, is ever given to any private individual who has suffered no real or actual damages. He has no right to maintain an action merely to inflict punishment upon some supposed wrongdoer. If he has no cause of action independent of a supposed right to recover exemplary damages, he has no cause of action at all. Schippel v. Norton, 38 Kan. 567, 16 Pac. 804. Courtney v. Blackwell, 150 Mo. 245, 51 S. W. 668, the court instructed the jury on the question of exemplary damages as follows: "If the jury find for the plaintiff, and further find that plaintiff is entitled</p>

<p>to exemplary damages, under the evidence in the case, their verdict should be in the following form: `We, the jury, find for the plaintiff, and assess and award to her as exemplary damages the sum of ____ dollars.'" The jury did find for plaintiff, and did assess and award to her as exemplary damages the sum of $7,750, but made no finding with respect to compensatory damages. The court said: "The jury did find for the plaintiff, and, in so doing, found that the defendant had published the slander with which he was charged; and upon that finding the plaintiff was entitled to have actual damages assessed in her favor, the slander being of that character from which the law implies such damages. They also found, as is apparent on the face of the verdict, when read in connection with the instructions, that the slander had been wantonly and maliciously published, and it was also within their province to assess exemplary damages therefor in her favor. So that there was in fact a basis, under the instructions, for the assessment of both actual and exemplary damages. But by some mischance in the form of the verdict which was given to the jury, no place was left therein for the separate assessment of the actual damages, and the whole was returned in a lump sum, according to the form as exemplary damages. This was an error of form, and not of substance; and as, under the facts and circumstances of the case, the assessment was reasonable and just, we do not think the judgment ought to be reversed for this error." But the case at bar is distinguishable from that case in this: In that case the jury made no finding at all in regard to actual or compensatory damages, while in the case at bar they expressly found that plaintiff was entitled to recover, and that he had sustained no compensatory damages, but assessed punitive or exemplary damages at one cent. The jury, in finding for plaintiff, in effect found that defendants arrested the plaintiff, and cursed and abused him, without any lawful excuse or reason therefor; and upon that finding he was entitled to have actual damages, in some amount, assessed in his favor. Under such circumstances, at the common law he is entitled to pecuniary reparation by way of damages, at least nominal, and as much more, if anything, as the jury may think him entitled to under the evidence.</p>
<p>The judgment is reversed, and the cause remanded. All concur.</p>

<content:encoded><![CDATA[<p>So I got to enjoy more of the incompetence of the city of Toronto and their inability to properly sign the streets.</p>
<p>I took my bike to class yesterday because I needed to go straight to work afterwards. My class was right off of Queens Circle in downtown Toronto. I parked my bike in the same place I'd been parking it the past couple weeks. On each end of the sidewalk there were signs that read "Paid parking enforced: 12:30-3:30, 6:30-9:30" (those times are just estimates, I can't remember exactly and there were some other times I believe, but these were the ones concerning me). So I figured what anyone would figure when they see that sign without any others up anywhere on the block: you have to pay for parking if you're parking during those times otherwise there's no charge.</p>
<p>When I got out of my class and turned the corner to the street where I parked my bike, the entire street was empty (of parked cars). A few thoughts went through my head, first I thought, I just didn't remember exactly where I parked and I was actually one more block south, second that it had been towed, and third that the bike had gotten stolen. After freaking out a bit and walking the entire length of the street, checking every sign that was posted (and not seeing any no parking signs) I saw a group of people gathered around the parking meter where you pay to get your ticket. They had the same kind of looked that I imagined I had on at the moment and walked over and asked them if they had gotten towed and they answered that they figured they probably had. Then one of them leans over to the meter and points at a little label about 1/2" by 2" in the middle of a column of about 3 or 4 other labels. These labels apparently had the parking regulations of the street on them, and underneath one that repeated the "pay parking enforced" sign up on the street was one with a little "p" with a cross through it that said no parking between 3:30 and 6:30 (the time during which I was parked.</p>
<p>The most ridiculous part about this whole situation is that motorcycles don't have to pay for parking in Toronto, which means that there would be no circumstance under which I would be at the meter to have a chance to see the tiny, no parking label (which is clearly made as difficult to see as possible, which is why the other group ended up getting towed as well).</p>
<p>After work, I was able to call the towing company to make sure that they had my bike, which they did, and to get some more details. For just the first day, it was going to cost $180 to get my bike back, and every day after that an extra $48, and after 60 days... well the way the lady on the phone put it was "your bike won't be here anymore." On top of that, the place where people's towed vehicles is kept is extremely out of the way and very difficult to get to if you don't have your own mode of transportation... Also, the way I have to fight the ticket and the tow is to take it up with the police station that issued the ticket (which I get when I pick up my bike), and with them I set up a date to contest at a small claims court, the court date for which won't be set for around 6 months, and probably won't be for another 6 months after that.</p>
<p>So now I'm going to have to pay $240 to get my bike, and even if I fight it, I won't see any money for at least around a year, without any compensation for all the time it's going to take to figure this out. And this is all because the city of Toronto doesn't know how to sign their streets, or at least sign them in a way that discriminates against motorcycles (which the city benefits from being driven in terms of congestion and pollution when compared to cars).</p>

<content:encoded><![CDATA[<p>Have you had trouble trying to play the <strong>Grab &#38; Spin Game</strong> at the <strong>Fall Fair at Club Penguin</strong>, Me too. Actually I saw heaps of penguins not being aloud to play on a number of times.</p>
<p>Finally with a little help from my mum, we got it working by clearing out the Cache and Cookies.</p>
<p>This can be done in Firefox by clicking on the Tools tab at the top of the screen and the selecting the Clear Private Data tab or Hold down <em><strong>Ctrl+Shift+Del</strong></em> buttons on your keyboard.</p>

<p>All you need to do for this very, very simple game, is to click on the Grab &#38; Spin Arrow. The ticket wheel will the spin until it lands on a number. The number you land on will also be added to the number of tickets you will win.</p>

<content:encoded><![CDATA[<p>Really really chirpy today! Got up earl(-ier than usual!) and took a cab wayy out to the offices near Gamco for my leave ticket. Quite a high level of bureaucracy for something relatively simple..! But woot, it's done. I can go anytime, probably the 3rd? I went out to Spinney's too for some stuff (the new Moncole isn't out yet though). Lame as it is, I'm happier than usual because first of all, the weather is getting better and better now (a high of 38 degrees for the next 5 days!), plus I'm down to 120 pounds.</p>
<p>I have some vague ideas about taking a train up to Brisbane to see Kylie for a few days too. And even going to Munich once I get back to Abu Dhab if I have enough money left. One of my favourite websites ever - <a href="http://seat61.com/">seat61.com</a>- mentions a particular <a href="http://seat61.com/Slovenia.htm#London%20to%20Ljubljana%20&#38;%20Zagreb">train route going from Munich to Zagreb</a>, with really stunning scenery. Love. Trains. Love. Like an 8-year-old boy loves trains, bar the technical knowledge (errr). Is that so wrong?! :P</p>
