<title><![CDATA[Psystar Plans Antitrust Suit Against Apple]]></title>

<content:encoded><![CDATA[<p><span> Psystar, a Mac cloner that operates out of a Miami industrial park, is going on the offensive against Apple. Company officials have stated that they plan to file a countersuit against Apple charging the company with anticompetitive practices.</span></p>
<p>From <a href="http://news.cnet.com/8301-13579_3-10026033-37.html">CNET</a>:</p>
<p><em>Miami-based Psystar, owned by Rudy Pedraza, will sue Apple under two federal laws designed to discourage monopolies and cartels, the Sherman Antitrust Act and the Clayton Antitrust Act, saying Apple's tying of the Mac OS to Apple-labeled hardware is "an anticompetitive restrain of trade," according to attorney Colby Springer of antitrust specialists Carr &#38; Ferrell. Psystar is requesting that the court find Apple's EULA void, and is asking for unspecified damages.</em></p>
<p><em> Psystar's attorneys are calling <a title="Apple sues clone maker Psystar -- Tuesday, Jul 15, 2008" href="http://news.cnet.com/8301-13860_3-9991572-56.html">Apple's allegations of Psystar's copyright infringement </a>"misinformed and mischaracterized." Psystar argues that its OpenComputer product is shipped with a fully licensed, unmodified copy of Mac OS X, and that the company has simply "leveraged open source-licensed code including Apple's OS" to enable a PC to run the Mac operating system. </em></p>
<p><em> Pedraza says he wants to make Apple's Mac OS "more accessible" by offering it on less expensive hardware than Apple.</em></p>

<p><span><em> Apple filed a <a href="http://www.techweb.com/encyclopedia/defineterm.jhtml?term=copyright&#38;x=&#38;y=">copyright</a> infringement suit against Apple in July, charging the company with illegally selling copies of its Leopard <a href="http://www.techweb.com/encyclopedia/defineterm.jhtml?term=operating%20system&#38;x=&#38;y=">operating system</a> on third-party, generic PC hardware. Apple's end-user licensing agreement specifically forbids installing its <a href="http://www.techweb.com/encyclopedia/defineterm.jhtml?term=OS&#38;x=&#38;y=">OS</a> on non-Apple hardware. </em><em> Psystar now claims that the license terms violate U.S. antitrust laws. </em></p>
<p><em> For its defense and countersuit, Psystar has retained the high-profile Silicon Valley law firm Carr &#38; Ferrell. The firm has previously tangled with Apple--and won. Partner Robert Yorio in 2007 extracted a $10 million settlement from Apple for Burst.com, which claimed Apple violated its <a href="http://www.techweb.com/encyclopedia/defineterm.jhtml?term=streaming%20media&#38;x=&#38;y=">streaming media</a> patents. Yorio also helped negotiate a similar, $60 million settlement from Microsoft on behalf of Burst.com.</em></p>
<p><span><em> Apple versus Psystar is a high stakes case--and not just for the parties involved. If Psystar prevails, it could open the door for other PC makers, including major vendors like Dell and HP, to offer Mac clones. Such a development could undermine Apple's main business model--which relies on Apple's perceived right to dictate which <a href="http://www.techweb.com/encyclopedia/defineterm.jhtml?term=software&#38;x=&#38;y=">software</a> products can run on its hardware. </em></p>
<p><em> Psystar claims its Mac clones cost about one-quarter to half of what Apple branded systems sell for. In defense of its clones, the company charges that Apple marks up the cost of the hardware on which its <a href="http://www.techweb.com/encyclopedia/defineterm.jhtml?term=operating%20systems&#38;x=&#38;y=">operating systems</a> ride by as much as 80%.</em></p>

<p>A couple weeks ago I wrote about Psystar, the company responsible for creating Mac Clones and selling them despite direct violation of Apple's EULA. Upping the ante, they have now hired a <a href="http://www.computerworld.com/action/article.do?command=viewArticleBasic&#38;articleId=9111090" target="_blank">law firm</a> known as Carr &#38; Ferrell who has fought Apple in court in the past - and won. Carr &#38; Ferrell represented Burst.com Inc. in a 2006 patent-infringement case in which Apple agreed to pay Burst.com $10 million; Burst.com Inc. has also taken on Microsoft as well, ending a similar case with $60 million. As you can see, Apple's got a tough case on its hands now, and Psystar still has a <a href="http://cloggedgears.wordpress.com/files/2008/07/apple-logo.jpg"><img class="size-medium wp-image-76 alignright" src="http://cloggedgears.wordpress.com/files/2008/07/apple-logo.jpg?w=187" alt="" width="131" height="158" /></a>fighting chance. However, the stakes are high for both sides ; if Apple wins, Psystar will likely go bankrupt and be forced to recall all their OpenComputers sold so far; if Psystar wins, it will create an opportunity for other companies like Psystar to start selling their own Mac clones, which Apple will have to compete against. Methought Psystar had called it quits, but this is turning out to be an interesting situation.</p>

The <a title="Openserv 1100" href="http://www.psystar.com/index.php?page=shop.product_details&#38;flypage=flypage_images.tpl&#38;product_id=24&#38;category_id=3&#38;option=com_virtuemart&#38;Itemid=72" target="_blank">1100</a> offers four drive bays in a 1U rack space case and is available with a range of operating systems including Mac OSX 10.5 server. The <a title="Openserv 2400" href="http://www.psystar.com/index.php?&#38;page=shop.product_details&#38;flypage=flypage_images.tpl&#38;product_id=25&#38;category_id=3&#38;option=com_virtuemart&#38;Itemid=72" target="_blank">2400</a> models ups the drivebays to six in a 2U case. There's been no reported action from Apple following the release of the Opencomputer, so it looks like Psystar are confident they can continue with their Mac OS range with impunity.</p>
<p>There's also an <a title="Opengamer range" href="http://www.psystar.com/index.php?&#38;page=shop.product_details&#38;flypage=flypage_images.tpl&#38;product_id=26&#38;category_id=3&#38;option=com_virtuemart&#38;Itemid=72" target="_blank">Opengamer</a> range on offer, but not surprisingly this is restricted to Windows Vista.</p>
<p>Also on the Psystar web site is a <a title="10.5.3 installer for Opencomputer" href="http://www.psystar.com/1053_update_available.html" target="_blank">10.5.3 installer</a> for the Opencomputer range. This downloads and installs the 10.5.3 update from Apple for the hardware that the Opencomputer could be configured with. There's no indication if this would work for a homebrew hackintosh with the same hardware.</p>

<p>Let's look at the facts.</p>
<p>What does the OpenComputer come with? All I know is that it does not come with monitor or keyboard and that there are some nice specifications!</p>
<p>Remember, these are the SIMPLE specifications. We'll go into detail soon.</p>

* 250GB 7200RPM SATA drive<br />
* DVD+/-RW<br />
* Gigabit Ethernet<br />

<p>Look! 400 bucks for a 250 GB hard drive, and also the fact that the iMac comes with 250 GB and is $1200!</p>

<content:encoded><![CDATA[<p>El lunes 14 de abril de 2008, la compañia norteamericana de soluciones tecnologicas <a href="http://www.psystar.com" target="_blank">Psystar</a> anuncio OpenMac, al que un dia despues cambiaron el nombre a OpenComputer. Se trata de computadoras basadas en arquitectura intel capaces de trabajar al 100% con Mac OS 10.5 Leopard. El sistema operativo es totalmente legitimo sin alteracion alguna. El secreto esta en unas adecuaciones hechas al <a href="http://en.wikipedia.org/wiki/Extensible_Firmware_Interface#Boot_manager" target="_blank">emulador EFI V8</a>.</p>
<p>Este proyecto desafia el EULA del sistema operativo Mac, que especifica que este debe ser ejecutado en equipos Apple. La Psystar OpenComputer de $399 dolares ofrece un procesador de 2.2GHz Intel Core 2 Duo E4500, 2GB  DDR2 667 de memoria, tarjeta grafica  integrada  Intel GMA 950 Graphics, un  DVD+/-R SATA de 20x con Lightscribe.</p>

<p>La compañia argumenta que es una alternativa economica para este gran sistema operativo. El unico inconveniente es la clara violacion al EULA del sistema operativo de Apple.</p>

<title><![CDATA[Sobre os OpenMac e o regresso dos Clones]]></title>

<p>Nos últimos dias tem surgido incessantemente notícias sobre ume empresa que pretende vender computadores pessoais com a pré-instalação do sistema operativo da Apple ( o Leopard ) se assim o cliente o desejar. Isto com a vantagem aparente de se poder comprar uma dessas máquinas por 400$. </p>
<p>Independentemente de legitimidade / legalidade e do facto de provavelmente a tal empresa ser apenas um hoax, convém pensar um pouco sobre o porquê de ainda haver esta discussão.</p>
<p><!--more-->Embora se pense que não, os clones na apple sempre existiram. Houve o período não oficial em que os clones foram construídos através de engenharia reversa às Roms ou então através da utilização de Roms e boards de Macs já existentes (o que os tornava caros) e o período em que a Apple licenciava os designs de Hardware. </p>
<p>Entre 94 e 97 surgirem máquinas licenciadas pela apple que competiam em performance com os Macs e custavam muito menos. Claro que o <em>look &#38; feel</em> era mais próximo de um PC normal do que propriamente dum Apple, mas isso não constituía um problema. </p>
<p>Em 97 com o regresso do Steve Jobs à Apple o System 7.7 que deveria sair foi renomeado para System 8 deixando os fabricantes de hardware com licenças de produção de clones apenas para a família 7.x. Desta forma Steve Jobs pode colocar o System 8 com condições de licenciamento desinteressantes para os fabricantes e finalmente a Apple voltou a ter o exclusivo da produção de Macs</p>
<p>Recentemente com a mudança de plataforma do Power PC da IBM para os X86 da Intel voltamos a ver surgir um ressurgimento do interesse por clones da Apple. Primeiro, porque o hardware dos Macs é muito semelhante ao Hardware utilizado por fabricantes de PCs, segundo porque depois dos inúmeros tiros nos pés que o Windows Vista deu há cada vez mais pessoas interessadas em procurar alternativas, sem terem que se desfazer das suas máquinas actuais. </p>
<p>Mas não se pense que os clones actuais surgiram apenas na plataforma x86 da intel. Há também quem tenha decidido continuar a apostar na plataforma Power PC e há clones com o mais potente Power PC G6 algures para o extremo oriente. </p>
<p>Enfim, depois de um pouco de história vamos pensar alto: Actualmente quem tiver um PC intel arrisca-se a ter uma máquina que pode facilmente ser convertida num Clone Apple. Claro que um projecto destes exige verificar se o hardware é compatível, mas há boas possibilidades. E como nunca foi tão fácil criar clones dos macs há empresas que se propõe fazê-lo por si. Contudo isto invalida a EULA (End User License Agreement) que diz especificamente que não é permitido instalar o OS X em hardware não Apple. </p>
<p>Por um lado não sei até que ponto é que este tipo de EULA é aplicável em toda a parte, uma vez que a legislação europeia é muito mais cerrada no que diz respeito a este tipo de autorizações, podendo por este ou outro aspecto da EULA fazê-la estar ferida de legalidade. Mas como ainda ninguém levou isto a tribunal... não sei.</p>
<p>Por outro lado qual é o problema da Apple em fazer isto? Bastaria dizer que não daria qualquer tipo de suporte a OS X que não estivessem instalados em máquinas Apple. Tem um Apple? Tem "Toda" a experiência Apple. Não tem? arranje-se sozinho.</p>
<p>Claro que isto não interessa à Apple porque as coisas não são assim tão lineares. A existência de clones, mesmo que a apple não os suportasse iria provocar problemas e o número de pessoas insatisfeitas com a promessa da experiência Apple ia aumentar gerando uma imagem negativa que apple não deseja. </p>
<p>Por outro lado isto faz-nos pensar no futuro dos computadores? Para onde vão os sistemas operativos? Quem é afinal dono do computador que comprou? Você? Ou a empresa que lho vendeu? É que estas licenças de utilização são como comprar um carro e depois dizerem-lhe que só podia conduzir o seu carro em auto-estradas concessionadas a uma dada empresa e nessa mesma auto-estrada não seriam permitidos carros de outras marcas.</p>
<p>Estaremos na informática ainda no início da era automóvel em que todos os Fords podiam ser da cor escolhida pelo cliente desde que fosse preto? </p>
<p>Será o futuro da computação mais ou menos democrática? Poderá finalmente o utilizador ser verdadeiramente "dono" do que compra ou vamos assistir ao trajecto contrário em que o utilizador deixa de ser dono do que compra e passa a cada vez mais a "alugar" um serviço? E se assim for está disposto a isso?</p>
<p>O caso do OpenMac que prometia computadores a 400$ é mais uma farpa que rapidamente vai ser retirada do caminho das grande empresas, mas é também a prova de que há pessoas a querer outras coisa que não as que as grandes empresas querem vender. Veremos no futuro se este tipo de movimento cresce ou definha. </p>
