Law challengers postpone suit, await outcome of petition

Law challengers postpone suit, await outcome of petition
By Christian Hill | The Olympian • Published July 01, 2008
The battle over the city's controversial law regarding tent cities for the homeless has shifted from the courtroom to the hearing room.

A preliminary hearing before a presiding officer of the board is Thursday. The formal hearing before the board is tentatively scheduled for Oct. 8. The deadline for its decision is Nov. 19.

The city of Lacey and plaintiffs have agreed to stay a lawsuit filed in Thurston County Superior Court challenging the law pending the outcome of a petition the plaintiffs filed with the Western Washington Growth Management Hearings Board.

Panza, a nonprofit group that supports Camp Quixote; the group's secretary; and three residents who attend churches in Lacey challenged the law on the grounds that the City Council didn't follow proper procedure in adopting it. The city has denied that claim. Camp Quixote is the county's existing tent city for homeless people.

The law bans a tent city within Lacey city limits and instead requires churches to shelter the homeless indoors. The council adopted the law April 24.

Critics of the law say it's unworkable because churches don't have adequate room to minister to their congregations and operate a homeless shelter in the same building.

Supporters on the council say nothing in the law stops faith-based groups from helping homeless people, and the regulations provide them a place to stay that is safer and more dignified compared to being left outdoors in tents.

Specifically, the lawsuit and petition contend that although the city posted meeting notices and had public hearings and other meetings before the Lacey Planning Commission and City Council, no such steps were taken for a later draft that required the homeless be sheltered inside churches.

The lawsuit and petition were filed May 22. Both say the city's process violated procedural requirements of the state's Growth Management Act, the city's municipal code and the city's development regulations. The plaintiffs are the same in both challenges.

Lee Johnson, a Panza volunteer and retired lawyer, said if the hearings board rejected the plaintiffs' challenge, they could merge an appeal with the lawsuit and continue the case in Thurston County Superior Court.

Johnson acknowledged there's the potential that the city could move to dismiss the lawsuit on the grounds that the plaintiffs didn't exhaust other available avenues, including challenging the law before the hearing board.

Only one of the Seven Wonders of the World still exist. The Great Pyramid of Giza is the last surviving wonder. Do you know what the other six are?

1) King Nebuchadnezzar II built the Hanging Gardens of Babylon on the banks of the Euphrates River.

2) Pheidia, a sculptor, built a immense gold statue of Zeus, one of their false gods, at Olympia.

3) The temple of Artemis was erected in Ephesus, a city in Asia Minor.

4) The Mausoleum at Halicarnassus was a huge tomb constructed for King Maussollos.

5) The Greeks erected The Colossus of Rhodes in honour of Helios the sun-god, one of their many false gods.

6) The Lighthouse of Alexandria was built on the island of Pharos.

7) And of course, the Great Pyramid of Giza was built for Pharaoh Khufu near the ancient city of Memphis.

This was written for a regional high-school newspaper with a selective staff. It’s a compilati

This was written for a regional high-school newspaper with a selective staff. It's a compilation of the optional essay I wrote for my application to the college, and another informative feature-like article I wrote about it.

In a bubble of ignorance, believing that school was supposed to be about competing for grades, doing meaningless homework, and taking even more pointless tests, I was frustrated when I visited Evergreen. Why couldn’t I have been left alone, left to choose a ‘traditional’ college and complete my education in a more ‘normal’ way? I could have persisted with learning little, retaining little and being unenthusiastic about the whole process.
Luckily, there was another alternative. After two weeks of debating with myself and discussing with my dad, I jumped. It was a leap of faith– faith in myself, and faith in Evergreen’s spectacular system (or refreshing lack thereof).

Almost every institute of higher learning proclaims a “one-of-a-kind” education of some sort. But Evergreen has the genuine raw appeal of a completely non-traditional atmosphere, though it’s definitely not for everyone. It is intriguing to students who have never questioned their school’s method of awarding grades or percentages.

Through high school, we’re trained to “strive” for the A, or maybe to accomplish “just” the B. But as anyone who has taken at least a semester of high school knows, the definition of a letter grade changes in every class. Do you really have to reach for that A in choir, like you do the one in math? Maybe you’re psyched for a C in history, but disappointed by a C in chemistry. With all the ambiguity and shape shifting of grades, it’s a wonder that we still put meaning in them. Then again, it’s so ingrained in all students that we just accept it.

Not at the Evergreen State College. No letter grades are assigned, no numbers. Nothing that could be misunderstood or misinterpreted. Teachers instead write complete, comprehensive evaluations of students and their work throughout a quarter. They can choose to give full, partial or no credit for a program.

Evergreen doesn’t require as much academic prowess and scholarly willpower as it does creativity. I have an unlimited imagination, but never has it been applied to designing a college education. In an institution which allows this and encourages it, the mind is freed of meaningless worries such as credits, grades, and mere memorization. Instead, a swiftly growing and maturing brain will engage in more important processes, like internal discussion, developing ideas and opinions, self-analysis, and self-discovery (partly through self-doubt).

Evergreen’s program system clears things up for those of us who were frustrated by having to jump from learning about DNA to reading Moby Dick in two hours. What if we could connect the two based on something they may have in common?

In a program, all types of classes—arts, sciences, social studies—are all tied together around a central theme. Usually, there are two to five professors who each specialize in an area within the program. They all collaborate and share their expertise.

The students’ environment is collaborative as well. When they don’t have to compete for a grade or “setting the curve,” there’s much more energy for sharing opinions, knowledge, and backgrounds.

Authors of what we call the “Great Books” believed that this was always what learning was supposed to be about. Why, then, didn’t education remain such a quenching and enlightening process? Obviously, most people are probably not meant to write books, which, thousands of years later, are still memorable enough to be called the “Great Books.” But how and when did education become so untrustworthy that tests of knowledge were developed? When did it become so discrete that we could measure the amount of it in a letter grade? When, in fact, did education become a measurable quantity at all?

There exists a college where one’s own schools of thought matter most. Personal concepts can be applied to a learning environment where there can only be endless rewards– the introduction of new thoughts, which develop and are reapplied. This means a cycle of win-win collaborative learning situations in discussions, ideas and personal growth.
There is so much to look forward to at Evergreen. Aside from its unique perspective on studies, it doesn’t lose any exciting opportunities available at other colleges. There’s so much to get involved in and so many choices to take advantage of in clubs, sports and the arts. Many activities were not options for me in high school.

I have attended a specifically college prep school for the past six years. Needless to say, it wasn’t prepping me for the type of learning I will embrace at Evergreen. No, the Coeur d’ Alene Charter Academy has been training me in the ways of the traditional college, where I would spend even more tedious hours fighting for that weird letter A that really represented nothing.

Then again, it’s not like there’s an Evergreen Prep School. And because of the whole diploma thing, high schools need a way to quantify how much a student has supposedly learned.

I’m confused by the awarding of letter grades for tedious memorization and regurgitation of textbook knowledge, and by what, if any, relation these grades have to learning in the first place. Evergreen opened my eyes to this disconnection, thankfully. In attending Evergreen, I’m especially anticipating seeing the world unrestricted by the blindness caused when education is made into a monotonous, unimaginative chore. Evergreen is a breath of fresh air after struggling to find inspiration in a traditional school system.

7. The Testament

7. The Testament
Then, Holkias, as he had been instructed by the King, read out the Testament. What follows is a translation
of the version given by the Metz manuscript, supplemented (in angular brackets) by a few important
provisions found in Pseudo-Kallisthenes A.

§115. The testament made by King Alexander, son of Ammon and Olympias. If my child by my wife,
Rhoxane, is a son, he before all others is to be King of Macedonia, and in the interim Arrhidaeus, son of
Philip, should lead the Macedonians. If I should have a daughter by my wife, Rhoxane, let the
Macedonians see that she is brought up and married in a manner befitting their loyalty to me and my
rank, and let them elect as their king the man they think fit. The man so elected should be King of
Macedonia....

§116. To my mother, Olympias, I grant the right to live in Rhodes or anywhere else she wishes and
the King of Macedonia is to see that she is every year given all the things she was given during my
lifetime. To Leonnatus I give the satrapy of the Hellespont and the hand of Holcias' sister,
Cleonice20 in marriage. I appoint Eumenes, who was my secretary, ruler of Cappadocia and
Paphlagonia. I declare the islands free: let them retain their former possessions and be autonomous.

§117 I appoint Antigonus governor of Pamphylia, Lycia and Greater Phrygia, and I assign
authority over Caria to Asander. “and the territory which lies beyond” the river called the Halys;
over this land I appoint Antipater governor. I make Nicanor governor of Cilicia and Pithon
governor of Syria as far as the so-called Mesopotamian line21. Babylon and Babylonian
territory adjoining to it I put under the command of Seleucus who was my squire22.
Phoenicia and Coele-Syria I assign to Meleager. The kingdom of Egypt I leave to Ptolemy23, along with
the hand in marriage of my sister, Cleopatra.

§118. As for the areas lying between the boundaries of Babylonia and Bactria, the satraps should retain
what they variously govern, and as commander-in-chief over them all I appoint Perdiccas, on whom I
also bestow as a wife, Rhoxane, who was my wife, the Bactrian daughter of Oxyartes24. The people of
Rhodes are to be granted 300 talents of gold coin from the royal treasury for the beautification of their
city; they are also to be given 40 triremes and a free annual subsidy of 20,000 medimni of Egyptian grain
and, also free and on an annual basis, 20,000 medimni of wheat from the regions of Asia adjacent to
Rhodes. I also command the removal from the town of the garrison which I left there.

§119. The priests in Egypt are to be granted 2,000 talents in gold coin from the public purse, and
Ptolemy is to take care of the transportation to Egypt of my body, which the priests of Egypt are to
tend to as they think best. The sarcophagus in which the body is to be laid is to be made from 200 talents
of gold.

§120. To the Thebans of Boeotia I grant 300 talents of coined gold to rebuild their city, and to the
exiles who were refugees from there because of the war I restore all the property of which I had
deprived them. I consider that they have been sufficiently punished for their foolhardy opposition to me. The
Athenians are to be given a golden throne for the temple of Minerva and also a robe of gold. My arms and
insignia plus 1000 talents of silver are to go to the temple of Hera at Argos, while Apollo at Delphi is to be given
all the elephant tusks and “two” snake skins plus 100 golden libation-bowls. The Milesians are to be given 150
talents of silver and the Cnidians are also to be given 150.

§121. Taxiles is to be governor of those parts of India bordering the Indus river, Porus of those parts
between the river Hydaspes and the Indus25. I appoint the Bactrian Oxyartes, father of my wife, Rhoxane,
governor of Paropanisadae, and Sibyrtius is to rule the Arachosians and Cedrosians. I give command over
the Arians and Drangians to Stasanor of Soli.
Philip is to rule the Bactrians. Parthyaea and what adjoins Hyrcania I give to Phrataphernes,
Carmania to Tlepolemus. Peucestas is to hold sway over all the Persians. From all “these” governorships
Oxydates is to be relieved and Craterus26 is to rule the Medes in his place. Argaeus is also to be removed from
Susiana, and Coenus is to govern in his stead.

§122. Over all the Illyrians I appoint Holcias as governor and I award him a detachment of 500
requisitioned horses and 3000 talents of silver coin, which he is to use for the making of statues of
Alexander, Ammon, Minerva, Hercules, Olympias and my father, Philip27. These he is to set up in the shrine
at Olympia. The men to whom I have given supreme commands are to set up gilded statues of Alexander in
Delphi, Athens, “hiolce”28. Ptolemy is to set up in Egypt gilded statues of Alexander, Ammon, Minerva,
Hercules, Olympias and my father, Philip.

§123. Witnesses to all this be Olympian Jupiter, our ancestor Hercules, Minerva, Mars, Ammon the
Sun29, and King Alexander's Fortune.
Should any of these named act in contravention of my testament, I beseech Jupiter and the Olympian
gods to see that he not go unpunished for doing so, and that he be held guilty of perjury before
gods and men30.

Taken from the book "The Last Days and Testament of Alexander the Great: A Prosopographic Study" by Waldemar Heckel, Historia Einzelschriften, Heft 56 (Stuttgart 1988 ) xiv, 114.

The Testament of Alexander the Great has been undertaken by the study of Waldermar Heckel:"The last days and the Testament of Alexander the Great", published in 1988 in Stuttgart, Germany. This unique document represents an authentic witness regarding the continuity of Macedonian nation, state-law expression and culture. The Testament's value is in it's entire expression as an authentic evidence regarding the Macedonian past, whereas the long centuries misconceptions are being rejected and constructed thesis concerning their ceasing to exist.
The Testament originates from the year 317 BC and it is good enough argument on the behalf of the Macedonians before Christ. THE TESTAMENT WAS WRITTEN IN THE LAST LIVING DAYS OF ALEXANDER THE MACEDONIAN, it was written in Babylon in 323 BC. WHEN HE WAS AT 33 YEARS AGE AFTER HIS 13-YEARS OF REIGN. The time when the Testament has been written is the time of the Macedonian reign over a part of nowadays Europe, Asia and Africa. That is the time of great prosper of the Macedonian civilization and Macedonian Empire.

mmmm …. I’ve been cooking decadent goodies for friends’ parties this weekend, sinc

mmmm .... I've been cooking decadent goodies for friends' parties this weekend, since everyone knows you should save those for when OTHER people will be eating most of them :D

I made Pamela's Brownies (yes, it's a mix) for the barbecue today, which have to be the best brownies ever invented. I use the version of the recipe with no - yes, that's no - oil or butter whatsoever. They are also gluten-free and vegetarian (and you can make a vegan version if you want). We originally bought these brownies to make for my sister-in-law, who has a gluten-free diet, and they were so good that it's basically not worth making any other kind. Especially considering they take about 5 minutes to make and with no fats are actually healthy, and taste incredible.

On the other end of the health spectrum, tonight I made flavored butters for a Waffle Brunch tomorrow that another friend is giving. There's no way to make butter healthy, but I've been wanting to try this idea and everyone puts butter on waffles, right? It just wouldn't be a waffle party without it :) So, I made four kinds - cinnamon, honey-vanilla, ginger-lime, and blackberry. And tried my best not to taste them too much (but I can tell you in confidence the cinnamon one is divine!).

Then, feeling like I should eat just a bit of real food after making butter :) and a mid-afternoon barbecue, I ate one slice of what has to be the best bread I have eaten in a long time. It's not something fancy, "just" herb bread, made by Stone Ground Bakery, a local bakery here in Olympia. Just opening the bag releases a wonderful herbal, buttery smell. The bread smells wonderful, has the perfect texture (not too airy, not too dense), and tastes as good as it smells. I'm sitting here just savoring the excellence of this bread. More food should be like this.

We have an annual tradition of picking berries at the farm just around the corner from our house. As I mentioned in my earlier post, we've been growing increasingly more aware of the things that are going into our food and have been trying to make more conscientious choices with all the things we eat. Of course there are exceptions. Spooner Berry Farms has been in Olympia for as long as I can remember. I used to eat these berries when I was a kid. My kids have had such fun picking berries and making jam (or at least tasting jam - they don't actually help with the jam a whole lot unless they jump in for the pulverizing of the poor little fruits before they go into the pot for cooking) for the past several summers. We just couldn't break with tradition, even if it's not technically an organic operation. I did ask, though, and they do not use any pesticides. They cannot be certified as organic because they use a commercial fertilizer. meh. I can let it slide. These berries are well worth it.

After we picked our berries (and sampled a few - is there anything more delicious than a sun-ripened strawberry?) we came home and made a few batches of strawberry jam. This year I decided to use Pomona Brand pectin. This is a natural pectin which does not require any added sugar to gel the fruit. In fact, it does not require the addition of any sweetener at all, but I chose to add a bit of honey to mine since there are some really wonderful health benefits to honey. And besides, it just tastes good.

Formed: 1991
Key artists: Bikini Kill, Elliot Smith, The Gossip, Deerhoof
Website: http://www.killrockstars.com
Distribution: CD/DVD/7"/Cassette

Kill Rock Stars began in 1991 by Slim Moon initially to release 7" spoken word singles - the first release, KRS-101, was a split 7" featuring Kathleen Hanna and Moon (entitled "Wordcore"). The first musical releases were compilations entitled "Kill Rock Stars", "Stars Kill Rock" and "Rock Stars Kill", featuring artists from Olympia, Washington (home base of the label) featuring Bikini Kill, Unwound, The Melvins and even Nirvana. It was Moon's believe that acts such as Bikini Kill, Unwound and The Melvins were too exciting to remain unsigned, hence throwing it open as a full time label.

Since that time, Kill Rock Stars has become somewhat infamous for it's apparent "feminist" output, with acts such as Bikini Kill, Sleater-Kinney and later on Mika Miko appearing on the label; becoming one of the main exponents of the Riot Grrrl during it's peak and drawing both praise for it's "leftist" stance and pro female musical approach with the ire of other musical collectives - punk group NoFX's song "Kill Rock Stars" was pointed towards the label and, in particular, Hanna.

Despite that view, it couldn't be any further from the truth - though there is still a strong female presence and ideology within the label, artists such as the incomparable Elliot Smith, Panther and The Paper Chase, while a subsidiary was created for the harsher indie sound that was emanating from 1997; 5 Rue Christine (known as 5RC) deals with artists such as Deerhoof, Xiu Xiu, The Mae Shi and The Robot Ate Me

The New Bloods (http://www.myspace.com/thenewbloods)
Since their first band practice in March 2006, the three ladies who make up the New Bloods have dropped jaws and touched off unruly, spontaneous dance moves across the dark and drizzly basement/house party landscape of Portland, Oregon. Now with The Secret Life, they've shone a new light that won't be put out.

Adee Roberson's ominous new wave/tribal drums, Osa Atoe's sky-rising violin, and Cassia Gammill deep-shifting bass, turn songs like Day After Day, Oh, Deadly Nightshade! and the propulsive title-track into hard-packed anthems of empowerment and intense personal experience. And they sing, all of them, each totally defined and original voice tangling and crying out with the rest, shouting and proclaiming, harmonizing, singing brave and true and clear-eyed.

Mika Miko is an underground youth punk/noise band formed in 2003 in Los Angeles, California, U.S.. [1] In 2004 they gained local popularity for their frenetic live performances which emulate being at a party and often take place at parties. Featuring Victor Fandgore (Jennifer Clavin), Jet Blanca (Jenna Thornhill), Michelle Suarez, Jessica Clavin, and Jon Erik Edrosa, the original line up of the band made its first demo CD-R, its first 7" record, and toured the West Coast extensively before replacing their original drummer with Kate Hall and embarking on their first national tour in the Summer of 2005. Also in 2005 they were featured on two compilations released by Los Angeles-based record labels, produced their first two self-released cassettes, and two members of the band appeared on the Hawnay Troof EP Community.

How could this have happened?

Happy Friday everyone. Tomorrow I am 18 weeks from the Natural Olympia. Today I followed my diet and trained just like any other day. But I am not going to bore you with that today. I also went out on the boat with my wife and went out for dinner (I had ribs pasta and ceasar salad). With the diet strategy I use , i can do this at planned intervals with no negative effects. I will get more into this in future posts but my point here is, aim for balance in you life and in your passions. You will be happier in the long run and more successful at both. Here are some picture from today. Check back for some pictures and workout video next week. Have a great night and check out www.kevinweiss.com for more stuff that is going on.

Will ich Euch gerne verraten. Habt Ihr schon von der Aktion "Sports for Human Rights" gehört, gelesen? Ja?

136 days and counting. That is how many days until the Natural Olympia Contest in San Fransisco. I will be competing in the pro division against the best natural bodybuilders in the world. I just started this blog today to document the journey so I hope people will check back often and comment as they chose. I plan to post lots of pics, video and short articles as well. I don't want this to be the typical I did this in the gym and ate this today. I would like to make it more interesting than that. I welcome any questions and comments and I hope to have this in full swing in the next few days.

Have a good night

Yeah, well, I guess it was inevitable.

I have to say, I'm surprised at how premeditated the destruction was. Ry and I both knew that the thing would get a mustache drawn on her, or a cock and balls, or other graffiti... in fact, we expected that and were surprised when it didn't happen. This thing, though, required the person to print out their little "Stay in Connecticut" sign, bring white paint or spray or whatever, and paste, and spend some time sending their message. What message, though? Clearly not a protest against street art/vandalism, depending upon how you look at it, since this person had to drag their stuff over to Birthday Girl in the wee hours to do this themselves. And also, they very conspicuously didn't take her down, meaning that they wanted to co-opt Ryan's art space for their own, which is the weirdest, meanest part in a way. You can argue that Birthday Girl was an eyesore, or a cry for attention, or taking up space, blocking traffic (all of these have been made as claims in the Gawker comments, which are full of petty one-liners about this subject); but in reality, this defacer turned an actual art project -- loving and creative to some, lame and annoying to others -- into actual trash. The destruction of art and sentiment.

Birthday Girl was the best present because she allowed everyone who wanted to participate to feel good about the project for a moment or two. Ry loved making her and was proud to install his work on the street. I loved that she existed and the thought that went into such a loving present. And everyone who participated (a lot of people!) got to be part of something fun, get their picture on flickr, and genuinely make me smile for almost no effort at all. The worst part about this defacement is that it turned a thing that inspired a lot of different reactions in people into a thing that only radiates contempt and meanness. They could just as easily have put up the "Stay in Connecticut" sign over her face without whiting her out. That would have conveyed a similar sentiment. But instead, this wasn't primarily about the destruction of an art project; it was about a battle for attention, which is so petty, immature, and mean.

People have been asking me if I'm upset. I'm upset that more people, including a lot of my actual friends, didn't get the chance to take their pictures with her. And I'm a little upset that something Ryan spent months on was callously destroyed in this way. But other than that, I'm actually really happy that she stayed up as long as she did (we went out to see her again the day after we'd put her up, half-expecting that she'd already been taken down and gone). She was a piece of illegal street art, and I can't be too mad that something happened to her eventually. I've got pictures with perfect strangers, I've got pictures with myself and Ryan, and, heh, I guess I've got a little legacy of my own. I'm sorry to the owner of the building that she's parked outside, because now he really does have a gross eyesore instead of a colorful thing of whimsy. In fact, I hope the board actually gets taken down now.

And if you're reading this and you were one of the people who took a picture with her, THANK YOU! My birthday lasted a week longer than God intended, and that's the ultimate present.
