Buchi neri, riscontri vacui, svarioni investigativi. Cominciano a vacillare le granitiche risultanze della prima ora. Anche perché nell'ordinanza d'arresto di Ottaviano Del Turco una sola intercettazione sembra dare conforto all'impianto accusatorio. Il resto è frutto delle sole dichiarazioni dell'imprenditore-pentito Vincenzo Angelini (e dei nastri da lui registrati) che quando s’accorge di rischiare la galera decide di collaborare. In extremis è passato da corruttore a concusso, ecco perché bisognerebbe andarci cauti sulla genuinità di certe dichiarazioni.

I conti non tornano
Il gip è chiaro: «Le indagini non hanno evidenziato sin qui situazioni atte a riscontrare incassi diretti di denaro contante in conseguenza delle dazioni effettuate dall'imprenditore Angelini». Ma c’è un però: «Tale circostanza, però, non è assolutamente idonea a inficiare l'ipotesi accusatoria». Il ragionamento è tortuoso, capzioso: se non c’è traccia che i soldi siano effettivamente finiti nelle tasche di Del Turco, vuol dire che li ha presi qualcun altro per suo conto. Allo stesso modo l'acquisto di tre case con i proventi della corruzione sarebbe riconducibile solo a «operazioni immobiliari non del tutto trasparenti». Da qui ad avere la prova ce ne passa. Perché se è vero che al presidente della Regione l'imprenditore Angelini ha versato tangenti per 6 milioni; se è vero che nei conti correnti del presidente non sono emerse cifre enormi fuori posto; se è vero che le intercettazioni di Del Turco sembrano andare tutte in una direzione sfavorevole all'accusa; se è vero anche che nelle «sospette» operazioni di giroconto per l'acquisto degli appartamenti di Del Turco c’è una fuoriuscita di liquidità al massimo di 1milione e 279mila euro (tre operazioni da 269mila, 576mila, e 453mila euro), la domanda sorge spontanea: ma dove sono finiti i restanti 4milioni 721mila euro di tangenti di Ottaviano Del Turco? La Gdf li cerca ancora.

Siccome sono troppo stanca non mi drogo, e siccome delle mignotte viste nemmeno una me n'e' piaciuta, lascio amsterdam senza nessun senso di colpa. Non ho fatto nemmeno una foto, perche' non riesco proprio a fotografare quello che non mi piace. Gli olandesi sono coatti, e straordinariamente brutti (a parte gli olandesi neri, che sono di una bellezza stupefacente -ieri uno di loro in treno mi ha detto qualcosa in olandese, a due centimetri dall'orecchio, e ho dedotto fosse qualcosa di porco, visto il sorriso e il tono di voce). SIENA. Ambizioni, aspirazioni, amicizie e facezie simili. In Ateneo a Siena non si fa che parlare della nuova assunzione - scattata il 1° marzo - dell'Architetto Gianni Neri, capitano della contrada della Giraffa nel ruolo, prima assente, di responsabile dell'edilizia.
Una assunzione preceduta da una selezione tra 20 candidati da parte di una commissione ad hoc.
A riferire i particolari il sito "Il senso della misura" del professor Giovanni Grasso.
Nell'articolo si mettono a confronto due candidati: in particolare, Maurizio Capra dell'Università di Bologna - che ha meritato una menzione particolare da parte della commissione - e Giovanni Neri, appunto, che ha ottenuto il posto per "ottima preparazione e buona capacità di gestione». Ma soprattutto perchè dimostra "sensibilità alle problematiche locali" ed è capace di inserirsi "nel tessuto cittadino senza difficoltà".
Fino a qui tutto "oggettivamente avvenuto", sebbene l'articolo ricordi che questa nuova assunzione rientra in un quadro che vede l'Università di Siena tra gli Atenei che spendono di più per il personale "in rapporto ai finanziamenti ricevuti dallo Stato".

Tornando ai fatti: Focardi, durante il cda del 3 marzo scorso, ha proposto di incrementare lo stipendio del neo assunto Neri. Uno stipendio non certo "misero": 36mila euro lordi, più indennità di posizione. La modifica non è stata varata per la perlessità di alcuni consiglieri che hanno proposto di rimandare la decisione.

On his part, Supreme Court Chief Justice Reynato Puno was dismayed with the  majority decision of the Supreme Court finding President Arroyo’s conversation with the then Socio- economic Planning Secretary Romulo Neri  as classified information.

The three questions that Neri refused to answer in the Senate were covered by executive privilege.1) whether the President followed up the NBN-ZTE project with Neri; 2) whether Neri was dictated by the President to prioritize the NBN-ZTE project; and 3) whether he was told by the President to go ahead with the project after being told of the alleged bribe offer.”

However in his 120-page dissenting opinion, “Puno said that ‘these questions are pertinent to the subject matter of their investigation, and there is no effective substitute for the information coming from a reply to these questions." He said the three questions were not covered by executive privilege since the Senate needs the answers to these questions so that it can enact laws to remedy flaws in the government's procurement system.

Encouraging Corruption

Sen. Alan Peter Cayetano, Senate Blue Ribbon Committee chairman, finds the SC decision could “boost the confidence of high government officials into corrupting the government.”

"If you’re undersecretaries and the Senate invited you because you took big amounts of money, you will run to the Supreme Court. You will be confident that the executive can get away with everything," he said in an interview with DZMM radio.

The same sentiments is also shared by some members of the Lower House as this will only lead to more corruption in the government  “Bayan Muna Rep. Teodoro Casiño, for his part, said the decision has given President Arroyo powers similar to a mafia boss.” 

“Casiño said Mrs. Arroyo has become an "untouchable" and could very well commit crimes without being punished.”

UP Protest Action

“Commission on Higher Education (CHEd) chair Romulo Neri was greeted by a protest action at the University of the Philippines-Diliman Thursday when he arrived for a meeting of the university's Board of Regents.” As soon as he alighted from his vehicle for the meeting he was greeted by protesters. He remained calm and even smiling as protesters gathered around as reported by Nina Corpuz of ABS-CBN news.

"They upheld the rule of law and respect for human rights. That's all I can say," Neri said. Last Thursday was the first time he spoke to the media after the Supreme Court decided in favor of his petition.

Sen. Alan Peter Cayetano, who was also in UP for the board meeting, being a member of the Board of Regents, said “he will try to convince Neri to tell what he knows.” However, after the meeting Cayetano said he had no chance to talk to Neri about it.

“Cayetano is the chairman of the Blue ribbon Committee, the Senate’s lead committee in the probe on the allegations of overpricing and bribery in the national broadband deal between the government and China’s ZTE Corp.”

Senator Cayetano did not say he calls again for another hearing on the ZTE broadband issue in the Senate. The senator however said that “they are going to discuss the guidelines for questioning Senate witnesses that is being asked of them.”

Neri's lawyers, on the other hand said that "only time can tell" if Neri would still attend Senate hearings if he is called to testify."

Constitutional Crisis

As expected, the Senators will challenge the decision of the highest tribunal of the land. This, they said, will lead to constitutional crisis. Political opposition and civil society groups are again into protest rallies to what they perceived as coercion of the executive to the judiciary.

"I hope a constitutional crisis can be avoided. If SC reconsiders… maybe SC needs more time," said Cebu Rep. Antonio Cuenco.

People’s Action

People who are opposed to the administration of president Arroyo find the SC decision as prelude to more corruption in the government. Supreme Court justices who voted yes are heavily berated of their actions. Some express total lost of confidence on all systems of the government. Others cease to believe that president Arroyo will step down on 2010. Against all these rumblings and political noise, do we see massive protest actions again?  Or to be frank about it is People Power at the offing?

I have to be honest I don't get Romulo Neri. He'd sacrifice people's time, effort and money  to prevent the truth from coming out! What kind of mentality is that? When it's so easy to just spill the beans, tell the truth, say what he knows and damn the consequences because at the end of the day, it's all for the greater good!

You have to ask the highest court of the land to decide whether you can tell the truth or not? And the Supreme Court actually decided to his defense?   

What has this country gotten into? Eversince Gloria illegally became president, the worst traits in a human being surfaced! 

Oh, when will we see the light at this very dark, dank, smelly tunnel?

On the other hand, the decision is just so piss-poor that I can't help cheering Puno on either, albeit quietly and mostly just to myself. Yay, Puno! But he is treading on dangerous ground. The last thing a Chief Justice wants to do is to undermine public confidence in the Court (of course, one might argue that the decision did that well enough without any help from Puno, still, if the decision were nails on the SC's credibility's coffin - Puno's comments only actually delivered the coup de' grace).

I had actually hoped that the SC's decision would cool-off the overheated proceedings at the Senate, maybe restore some semblance of objectivity or even dignity. That would have been possible if the decision had adopted fair standards for determining whether the invocation of executive privilege is righteous or not and then trust the other branches to respect those standards and to police themselves accordingly.  At the very least, the Court should not have appointed itself arbiter on the validity of specific invocations. Executive privilege, to my mind, is a pure political question falling well outside the scope of judicial review.

And in any case, even assuming that a claim of privilege is righteous, what's wrong with tackling such issues in executive session? Surely, the Court did not mean to say that Senators cannot be trusted to respect the confidentiality of information disclosed behind closed doors. I know I don't trust Senators to keep mum on information that might conceivably be used for political mileage, but certainly a co-equal branch of government cannot cast such aspersions on another co-equal. To do so would be to invite anarchy.

But I'm arguing the case again, right? Oh well.

All things considered (and no matter how much I agree with Puno's dissent) I still have to say that Puno totally should not have sounded off like that. It didn't add to the validity of his opinion, nor did it make the majority decision any more heinous than it already is. All he did was make sure that no one would ever fully trust his Court again.

As far as I could grasp of the implications of the ruling of the High Court--- on the question can one use executive privilege to hide a crime--- the answer is, from hereon, yes.
