This was written with reference to the three city gay pride marches in India that took place on Sunday:

Sexuality is instantly reduced in any conversation in our country to sex. Sexuality is not just about sex. What Pride is taking to the public is not just sexuality, but its politics. It is about identity. It is about self-respect. It is about not being fired from your job because of how you look or whom you share your apartment with. It is about being able to tell your doctors your full medical history without fear. It is about being able to protect your partner and share benefits, taxes, home loans, and health insurance. It is about being able to approach the law as a citizen, rather than with fear. It is about being able to be free of violence. It is about, ironically, being able to forget. To forget that one’s being gay or lesbian or transgendered is just one part of one’s identity, rather than everything that one is. In India today, you cannot forget. You cannot forget your caste if you are a Dalit, your gender if you are a woman, your religion if you are not Hindu or your sexuality if you are not heterosexual. The right to forget is a freedom. Pride is the right to fold sexuality into our everyday, to let it be part of us but not define us, and certainly not define us as a despised, abnormal “other”.

Three cities in India – New Delhi, Kolkata and Bangalore – are expected to hold the largest ever display of gay pride in the country as the Delhi High Court is set to resume hearings on India’s sodomy law in early July.

Conceived merely weeks ago via email groups, LGBT activists are planning to march, give speeches and have candlelight vigils in New Delhi, Kolkata and Bangalore (officially known as Bengaluru) on Sunday.

Désarmer les marchés

LE typhon sur les Bourses d’Asie menace le reste du monde. La mondialisation du capital financier est en train de mettre les peuples en état d’insécurité généralisée. Elle contourne et rabaisse les nations et leurs Etats en tant que lieux pertinents de l’exercice de la démocratie et garants du bien commun.

La mondialisation financière a d’ailleurs créé son propre Etat. Un Etat supranational, disposant de ses appareils, de ses réseaux d’influence et de ses moyens d’action propres. Il s’agit de la constellation Fonds monétaire international (FMI), Banque mondiale, Organisation pour la coopération et le développement économiques (OCDE) et Organisation mondiale du commerce (OMC). Ces quatre institutions parlent d’une seule voix - répercutée par la quasi- totalité des grands médias - pour exalter les « vertus du marché ».

Cet Etat mondial est un pouvoir sans société, ce rôle étant tenu par les marchés financiers et les entreprises géantes dont il est le mandataire, avec, comme conséquence, que les sociétés réellement existantes, elles, sont des sociétés sans pouvoir (1). Et cela ne cesse de s’aggraver. (Lire, pages 12 à 15, notre dossier sur la crise financière actuelle.)

Succédant au GATT, l’OMC est ainsi devenue, depuis 1995, une institution dotée de pouvoirs supranationaux et placée hors de tout contrôle de la démocratie parlementaire. Une fois saisie, elle peut déclarer les législations nationales, en matière de droit du travail, d’environnement ou de santé publique, « contraires à la liberté du commerce » et en demander l’abrogation (2). Par ailleurs, depuis mai 1995, au sein de l’OCDE, et à l’écart des opinions publiques, se négocie le très important Accord multilatéral sur les investissements (AMI), qui devrait être signé en 1998, et qui vise à donner les pleins pouvoirs aux investisseurs face aux gouvernements.

Le désarmement du pouvoir financier doit devenir un chantier civique majeur si l’on veut éviter que le monde du siècle à venir ne se transforme en une jungle où les prédateurs feront la loi.

Quotidiennement, quelque 1 500 milliards de dollars font de multiples allers et retours, spéculant sur des variations du cours des devises. Cette instabilité des changes est l’une des causes de la hausse des intérêts réels, qui freine la consommation des ménages et les investissements des entreprises. Elle creuse les déficits publics et, par ailleurs, incite les fonds de pension, qui manient des centaines de milliards de dollars, à réclamer aux entreprises des dividendes de plus en plus élevés. Les premières victimes de cette « traque » du profit sont les salariés, dont les licenciements massifs font bondir la cotation boursière de leurs ex- employeurs. Les sociétés peuvent-elles longtemps tolérer l’intolérable ? Il y a urgence à jeter des grains de sable dans ces mouvements de capitaux dévastateurs. De trois façons : suppression des « paradis fiscaux » ; augmentation de la fiscalité des revenus du capital ; taxation des transactions financières.

LES paradis fiscaux sont autant de zones où règne le secret bancaire, qui ne sert qu’à camoufler des malversations et d’autres activités mafieuses. Des milliards de dollars sont ainsi soustraits à toute fiscalité, au bénéfice des puissants et des établissements financiers. Car toutes les grandes banques de la planète ont des succursales dans les paradis fiscaux et en tirent grand profit. Pourquoi ne pas décréter un boycottage financier, par exemple, de Gibraltar, des îles Caïmans ou du Liechtenstein, par l’interdiction faite aux banques travaillant avec les pouvoirs publics d’y ouvrir des filiales ?

La taxation des revenus financiers est une exigence démocratique minimale. Ces revenus devraient être taxés exactement au même taux que les revenus du travail. Ce n’est le cas nulle part, en particulier dans l’Union européenne.

La liberté totale de circulation des capitaux déstabilise la démocratie. C’est pourquoi il importe de mettre en place des mécanismes dissuasifs. L’un d’entre eux est la taxe Tobin, du nom du Prix Nobel américain d’économie qui la proposa dès 1972. Il s’agit de taxer, de manière modique, toutes les transactions sur les marchés des changes pour les stabiliser et, par la même occasion, pour procurer des recettes à la communauté internationale. Au taux de 0,1 %, la taxe Tobin procurerait, par an, quelque 166 milliards de dollars, deux fois plus que la somme annuelle nécessaire pour éradiquer la pauvreté extrême d’ici au début du siècle (3).

De nombreux experts ont montré que la mise en oeuvre de cette taxe ne présente aucune difficulté technique (4). Son application ruinerait le credo libéral de tous ceux qui ne cessent d’évoquer l’absence de solution de rechange au système actuel.

Pourquoi ne pas créer, à l’échelle planétaire, l’organisation non gouvernementale Action pour une taxe Tobin d’aide aux citoyens (Attac) ? En liaison avec les syndicats et les associations à finalité culturelle, sociale ou écologique, elle pourrait agir comme un formidable groupe de pression civique auprès des gouvernements pour les pousser à réclamer, enfin, la mise en oeuvre effective de cet impôt mondial de solidarité.

It has to be admitted: the March of the Dissenters on 6 May was a failure, first and foremost because of us, the organisers. The organising committee got together once or twice and never decided anything much. After that, matters were left to take their own course and the individual member groups each did its own thing. Disastrously little money – to all intents and purposes none whatsoever – was spent on the march's needs. Handmade National Bolshevik stickers and a few Oborona graffiti weren't going to make a mark, and the issue of the United Citizens Front (OGF) newspaper didn't come out in time for 6 May.

Furthermore, no attempt was even made to involve other organisations, as was done previously, in the preparations for the event. The prize in the disorganisation stakes has to go to the appearance at Chistye Prudy of Denis Bilunov to announce that the event had been cancelled at the very time that activists from Oborona, Smena, the OGF, the National Democratic Union of Youth (NDSM) and the National Bolsheviks were trying to break through to the march. Bilunov did of course try to save the situation but the end result was basically an admission that we had failed. One of the really special things about the Dissenter's March was that it was going to take place no matter what, regardless of pressure from the authorities. When its organisers voluntarily cancelled it, that could only be taken as an admission of defeat.

The failure of the 6 May event was in some ways a foregone conclusion. We lost interest and drive; the enthusiasm that existed during the preparations for previous events was not there. As a result, after the well-known spring demonstrations of 2007, the number of events we held went down and down while interest in them dropped as well. The early Dissenter Marches were some of the most outstanding and most discussed political events in the country. As time has passed, however, they have become more routine sorts of events, almost like May Day Communist demonstrations. Worst of all, new people have stopped joining in.

I am sorry to say this but I think that this demo-march format has lost its relevance. Each demo is going to be weaker than the preceding one until the very concept of "Dissenters' March" becomes totally discredited. To hold them purely for the sake of getting a few fresh photos of OMON cops arresting participants is fairly pointless: there are years' worth of such photographs on the internet already. The cops too are getting better at dealing with our demos. What we need to do now is something different – and that is to get as many people as possible involved in resistance against the authorities, help then get over their concerns and fears about doing so, and teach them how to peacefully defend themselves on the streets.

For example, we could set ourselves the task of holding the largest mass meeting of recent years this autumn, perhaps in the form of a concert or festival. It does not matter much where it would be held – even Tishino will do so long as it is possible to get together somewhere. An event of this kind will need serious resources and take months of time and effort to organise. However, if we make a success of it, it will be far more useful and important than three hurriedly organised Dissenters' Marches of a few hundred people in each. An event of this kind could be arranged under the banner of The Other Russia and perhaps even be the first ever event in support of the National Assembly. The main things is that we need to attract new people – people who did not previously join opposition demos – and show that we can do more than just present our backs to the police so that they can beat them with truncheons.

Oborona Marches for Change

On May 1 in St. Petersburg Oborona activists, along with other opponents of the status quo in Russia, held a "march for freedom and justice." The participants paraded along Nevsky Prospect, the main street of the city and other principal streets of the "Northern Capital", carrying a banner that boldly called for "CHANGE!" (see photo above) and then held a rally at Pioneer Square. The dissenters chanted slogans such as: "We need another Russia!" and "Putin, go skiing in Magadan!"and "The Plan of Putin is Russia poverty!"and "This is our city!"

The event ended with a concert hosted by actor Alexei Devotchenko, a member of the United Civil Front (FSI). He invited opposition leaders express themselves in the language of music, calling Putin's regime "illegitimate" and condemning the participation of the Russian Orthodox Church in the activities of state. He followed Garry Kasparov, who said that United Russia was "looting" the country. Andrei Illarionov also spoke, asking those assembled to remember those who could not be present because they had been incarcerated, and calling for freedom for all political prisoners of the Putin regime.

Directive concernant les marchés d'instruments financiers

La directive concernant les marchés d’instruments financiers (MIF, en anglais : MiFID, Markets in Financial Instruments Directive), publiée au Journal officiel de l’Union européenne le 30 avril 2004, est l’un des éléments clés du Plan d’action des services financiers 2005-2010 lancé par la Commission européenne. Ce texte particulièrement détaillé (il ne compte pas moins de 73 articles, accompagnés de mesures d'exécution) est entré en application le 1er novembre 2007, bien que certaines transpositions en droit national soient encore en cours par les autorités de régulation de quelques États membres.

En complétant (et en renforçant) les exigences de la Directive de 1993 sur les Services d’Investissement (DSI), la directive MIF devrait à terme modifier radicalement le paysage boursier paneuropéen. Les acteurs de la Place annonce déjà une « révolution », avec des conséquences stratégiques, organisationnelles et technologiques importantes pour toutes les banques et entreprises d’investissement.

Enjeux [modifier]
L’objectif de la directive MIF tel que le présente la Commission européenne est de participer à la construction d’un marché de capitaux plus intégré, plus profond et plus efficace pour abaisser le coût du capital, générer de la croissance et renforcer sa compétitivité internationale ; et ce en maintenant une logique de protection des investisseurs.

Plus concrètement, la directive poursuit deux types d’ambitions.

Modifications structurelles sur les marchés [modifier]
Premièrement, la directive MIF s’attache à faire évoluer le contexte concurrentiel des marchés financiers. Pour ce faire, une partie de ses mesures visent à :

Instaurer une concurrence entre les lieux d’exécution des ordres. L'option de concentration des ordres sur les marchés réglementés laissée par Directive sur les Services d'Investissement est abandonnée. L'exécution d'un ordre portant sur un instrument financier admis à la négociation sur un marché réglementé peut désormais être négocié sur différents lieux d'exécution. En clair, cette disposition réduit le rôle traditionnel des bourses de valeur en légitimant une concurrence de la part d'autres institutions (grandes banques...) pouvant opérer en direct avec leur clients, et aussi entre elles des transactions sur titres. Depuis l'entrée en vigueur de la directive MIF, les ordres peuvent être négociés sur un marché réglementé, sur un MTF (une plateforme multilatérale qui fonctionne selon le même mécanisme qu'un marché réglementé) ou par internalisation de l'ordre sur le compte propre de l'intermédiaire (ce dernier se portant contrepartie). Pour la France en particulier, il s’agit d’une véritable transformation dans la mesure où l'option de concentration des ordres sur les seuls marchés réglementés avaient été choisie.
Harmoniser les conditions d’exercice des prestataires de services d’investissement à travers l’Union européenne. Le passeport européen, qui consiste à permettre à une entreprise ayant obtenu un agrément de l’autorité de son pays d’origine de distribuer ses produits dans toute l’Union européenne, va être étendu à davantage de services d’investissement.

Modifications organisationnelles dans les entreprises [modifier]
Deuxièmement, la directive MIF entend - à l’inverse - accroître la réglementation en vigueur. Cela se traduit par :

Une obligation de classification et d’information des clients pour les prestataires de services d’investissement. Le raisonnement retenu est le suivant : moins les clients sont expérimentés, plus ils ont le droit à des protections. Trois classes de clients sont prévues : les contreparties éligibles (les banques et établissements financiers), les professionnels (les entreprises) et les non professionnels (les particuliers).
La nécessaire formalisation des processus d’exécution des ordres des acteurs sur les marchés financiers à travers l’élaboration d’une politique d’exécution. Toute entreprise devra ainsi présenter à ses clients sa politique d’exécution et la leur faire accepter. Qui plus est, cette politique d’exécution est assortie d’une obligation de meilleure exécution. Celle-ci implique la mise en place de dispositifs garantissant le meilleur processus d’exécution des ordres pour chaque client (évalué notamment par les coûts ou la rapidité associés).
Des exigences organisationnelles renforcées pour les entreprises proposant des services d’investissement : adaptation des règles pour les fonctions de contrôle interne et de conformité, mise en place de politiques destinées à la gestion des conflits d’intérêt, instauration de dispositifs de contrôle des prestations externalisées, etc.

Acteurs concernés [modifier]
Sont concernés par cette directive, à la fois, les entreprises d’investissement (y compris les sociétés de gestion de portefeuille), les établissements de crédit, les entreprises de marché, mais également d’autres acteurs qui ne lui sont pas directement assujettis : conseillers en investissements financiers, investisseurs, diffuseurs d'informations financières et sociétés cotées.

Calendrier et textes [modifier]
La directive MIF a été élaborée selon le processus dit Lamfalussy, une approche réglementaire qui comprend quatre niveaux.

Niveau 1 (2004) : Directive cadre (Directive 2004/39/CE).
Niveau 2 (2006) : Mesures d'exécution de la directive (Règlement (CE) n°1287/2006 et Directive 2006/73/CE).
Niveau 3 (2007) : Coopération entre les régulateurs européens au sein du Committee of European Securities Regulators (CESR).
Niveau 4 (2008) : Contrôle de la mise en œuvre de la législation communautaire.
La transposition de la directive en droit national par les autorités de régulation des Etats membres a été effectuée principalement courant 2007. En France, le Conseil des Ministres du 11 avril 2007 a adopté l'ordonnance transposant la directive MIF (par voie législative via l’évolution du Code monétaire et financier) et le règlement général de l'Autorité des marchés financiers (AMF) a été modifié le 15 mai 2007. Six décrets d'applications ont également complété la définition du nouveau cadre réglementaire. Parmi les prochaines étapes figure l'éventuelle publication de codes de bonne conduite. La directive MIF est entrée en vigueur le 1er novembre 2007. Fin octobre, les banques françaises ont annoncé qu'elles étaient prêtes.

Continuing King's Legacy: The New Generation of Pastors

The generation of pastors that worked alongside Martin Luther King Jr. in the civil rights movement is fading but their influence remains as a new rank of ministers takes up the mantle, the Religion News Service reported.

Ministers are using new and old tools to fight age-old problems of hate, inequality and violence and new issues of economics and education .

Still, there is a need to address some of the problems with old-fashioned tools, such as marches and rallies, Woods said."We have to keep that in our arsenal because it raises the level of consciousness," he said. "I think marches will be in order as long as there is a human family."

But the complex problems facing black America today may require solutions other than marches, sit-ins and boycotts.

"The reason for marches was to bring attention to the issues, and they were successful," Franklin said. "There is new leadership with a new agenda that builds on the work of the civil rights era. It's a continuation of what Dr. King envisioned. The strategies may be different."

Oborona Marches for a Volunteer Army

On March 25th, as shown above, Oborona's Moscow and St. Petersburg members participated in a March for a Volunteer Army.

In anticipation of the March the authorities took aggressive action to prevent it and intimidate those who participated. We were banned from deploying any banners. But we did so anyway. There were over two hundred participants, including members of such groups as Memorial and For Human Rights, as well as ordinary citizens concerned with the rights of Russia's conscripts. We marched shoulder-to-shoulder to the Ostakino TV Tower proclaiming: "We need a new army! End military slavery now!"

The March culminated with a concert at the TV tower, and then dispersed. On the way ot the subway station, a gang of thugs attacked several members, but did not succeed in provoking us to violence as was undoubtedly their aim.

We, citizens of Russia, believe that service in the army should be voluntary, and that the institution of draft-slavery is an unacceptable anachronism in a modern society. Those who are not inclined to military service can serve their country in other ways. Universal military conscription must end now!

We believe that a strong army can only be made up of volunteers, not conscripts consisting of poorly trained and equipped slaves who are often subjected to torture and murder, always victimized by officers looking for free labor. We, the citizens of Russia, demand a strong army. A volunteer army is a strong army!

We demand immediate changes in the legislation of the Russian Federation on Military Duty and Military Service, deleting all provisions relating to forced conscription, the repeal of the articles of the Penal Code applicable to draft evasion, the cessation of all criminal cases under this heading, and full amnesty for all convicted this article. We demand the immediate cessation of the so-called "raids on fugitives from the call," especially given the fact that many victims of these raids have legitimate deferment or exemption from conscription. In fact, we strongly demand the cessation of criminal mass kidnappings for recruitment by illegal means.

We can change the situation in the Russian army. We can say "NO" state arbitrariness. All that we have to do is . . . say it loud and clear as one.
