As fotos da Agência Espacial Européia (ESA) mostram que a ponte de gelo que une a plataforma Wilkins à Ilha de Charcot está colapsando, o que deve colocar toda a plataforma em uma situação de alto risco. Mas esta situação não se parece em absoluto com a ruptura das plataformas Larsen A e B no início do ano, já que ela ocorre em pleno inverno antártido, indicando que o aquecimento na região continua produzindo efeitos cumulativos.</p>

<h2>Purpose of This Post</h2>
<p>The purpose of this post is to prove that U.S. Dist. Judge Donald L. Graham is not a "strict constructionist" judge, but a "judicial activist" and a rogue judge.  Judge Graham is of the apparent belief that he can assert some heretofore undisclosed Federal Rule of Civil Procedure "discovery rule" and take away rights guaranteed under the United States Constitution and Florida Law.  Judge Graham believes, by apparent fiat, that he has the power to command that a non-lawyer litigant seek the permission of a private for profit attorney in order to request public records under Florida Law.  Judge Graham is alone in this view.  Secondarily, this post seeks to land a glancing blow to the American Bar Association's notion of "judicial independence".</p>
<h2>Strict Constructionist Irony</h2>
<p>U. S. District Judge Donald L. Graham is a 1992 President  				George Herbert Walker Bush appointee.  Judge Graham is  				presumably a <span class="smalltext"> <em>'strict constructionist' . </em>It is unremarkable and widely known that </span>President  				George Herbert Walker Bush believed in the doctrine of strict contructionism and attempted to make judicial appointments accordingly.  <span class="smalltext"><em>"A</em></span> strict constructionist is one who sticks to the meaning of the words in the Constitution as they were used at the time of its drafting without reading too much into them.<span class="smalltext"><em>" </em><a href="http://www.law.com/jsp/article.jsp?id=1124960710913">Law.com, </a></span><a href="http://www.law.com/jsp/article.jsp?id=1124960710913">Originalist? Constructionist? A Confirmation-Hearing Glossary</a>. "Strict constructionism" is also used in American political discourse as an umbrella term for conservative legal philosophies such as <a title="Originalism" href="http://en.wikipedia.org/wiki/Originalism">originalism</a> and <a title="Textualism" href="http://en.wikipedia.org/wiki/Textualism">textualism</a>, which emphasize judicial restraint and fidelity to the original meaning (or originally intended meaning) of constitutions and laws. It is frequently used even more loosely to describe any conservative judge or legal analyst.The term is often contrasted with the pejorative phrase "<a title="Judicial activism" href="http://en.wikipedia.org/wiki/Judicial_activism">judicial activism</a>", used to describe judges who seek to enact legislation through court rulings, although the two terms are not actually opposites.<span class="smalltext">" </span><span class="smalltext"><a href="http://en.wikipedia.org/wiki/Strict_constructionism">Wikipedia</a>. </span>As this webpage will  				prove, Judge Graham is not a <span class="smalltext"> <em>'strict constructionist' , </em>but an activist judge making  				up laws and disdaining binding precedent as he sees fit with  				apparent impunity. </span></p>
<h2>Judicial Activism</h2>
<p>"<strong>Judicial activism</strong> is when <a title="Court" href="http://www.conservapedia.com/Court">courts</a> do not confine themselves to reasonable interpretations of laws, but instead create law. Alternatively, judicial activism is when courts do not limit their ruling to the dispute before them, but instead establish a new rule to apply broadly to issues not presented in the specific action. "Judicial activism" is when judges substitute their own political opinions for the applicable law, or when judges act like a legislature (legislating from the bench) rather than like a traditional court. In so doing, the court takes for itself the powers of <a title="Congress" href="http://www.conservapedia.com/Congress">Congress</a> rather than limiting itself to the powers traditionally given to the judiciary."  <a href="http://www.conservapedia.com/Judicial_Activism">http://www.conservapedia.com/Judicial_Activism</a>.</p>
<p><em>"Judicial activism</em> is the term used to describe the actions of judges who go beyond their constitutionally prescribed duties of applying law to the facts of individual cases, and "legislate" from the bench. These judges create new constitutional rights, amend existing ones, or create or amend existing legislation to fit their own notions of societal needs." <p>Rogue is "an individual varying markedly from the standard."  <a href="http://www.yourdictionary.com/rogue">http://www.yourdictionary.com/rogue</a>. Given the definition of rogue, then Judge's Graham's actions can easily be characterized as those of rogue judge.</p>
<h2>History of Thumbing His Nose At Supreme Court Precedent</h2>
<p>Judge Graham has a history of simply ignoring the edicts of the United States Supreme Court anytime he disagrees with them.  Judge Graham has freely admitted that he is bound by the decisions of the United States Supreme Court and the Eleventh Circuit, U.S. Court of Appeal. See Skylark v. Honeywell Int'l, Inc., <span>2002 U.S. Dist. LEXIS 10554</span> (S.D.  FLA 2002)("<span style="color:#008080;">In the case of the Southern District of Florida, the only courts it must be obedient  to are [the Eleventh Circuit] and the Supreme Court of the United States.</span>").<strong> </strong> However, Judge Graham's actions have demonstrated that he clearly believes he is not bound any rule or law. <h2>An Egregious Incident of Judicial Activism And Usurpation</h2>
<p>On July 6, 2000, the Government Defendants, Highlands County Board of County Commissioners, through their  				attorneys,  Maria Sorolis and Brian Koji, filed a "<a href="//mmason.freeshell.org/MariaSorolis/de231.pdf">DEFENDANTS'  				RENEWED MOTION FOR PRELIMINARY INJUNCTION, (D.E. #231)</a>",  				and requested the following relief:</p>
<blockquote class="style17"><p><span style="color:#ff0000;"> Defendants respectfully renew their Motion for a Preliminary  			Injunction 			prohibiting the Plaintiff from contacting the supervisory employees  			of the Defendants or the individual Defendants directly, and  			directing Plaintiff to make all public records requests through the  			undersigned counsel.</span></p></blockquote>
<p>This motion <strong>cited no legal authority</strong> for the requested relief. On July 25, 2000, Judge Graham's Magistrate, Frank Lynch Jr., granted the motion and commanded:</p>
<blockquote><p><span style="color:#ff0000;">ORDERED AND ADJUDGED that Defendants' Renewed Motion for Preliminary Injunction is GRANTED... Plaintiff shall correspond only with Defendants' counsel including any requests for public records.</span></p></blockquote>
<p><span><strong>See <a href="http://mmason.freeshell.org/goto.php?w=http://mmason.freeshell.org/DE201Orders/de246.pdf"> Docket Entry No. 246</a>.</strong></span> Without belaboring the point, a Magistrate may not issue an injunction of any type.  "<span style="color:#008080;">Notwithstanding any provision of law to the contrary—  a judge may designate a magistrate judge to hear and determine any pretrial matter pending before the court, except a motion for injunctive relief...,"</span><a href="http://www4.law.cornell.edu/uscode/html/uscode28/usc_sec_28_00000636----000-.html#b_1_A"> 28 U.S.C. § 636(b)(1)(A)</a>.</p>
<p>Judge Graham has expressly stated that the issuance of this order by Magistrate Judge Frank Lynch, Jr. was not <span style="color:red;">"clearly erroneous nor is it contrary to law.</span>" <a href="http://mmason.freeshell.org/DE-407/de407.pdf"> <span style="text-decoration:underline;">See</span> Docket Entry No. 407</a>. <h2>Judge Graham Refuses to Cite Legal Authority</h2>
<p>Judge Graham is under the apparent belief that he need not cite legal authority for actions he takes as he has been repeatedly challenged to cite legal authority for the order in question, but he has adamnatly refused to do so. On</span> January 25,  		2002, Judge Graham was asked the following:</p>
<blockquote><p><span style="color:#008080;">By what legal authority does the Magistrate act  			in issuing the orders in question, (DE #201, 246), directing that a  			nonlawyer must seek the permission of a private for profit lawfirm  			in order to communicate with his government directly and request  			public records ?</span></p></blockquote>

<p>Judge Graham's Answer and Controlling Legal Authority was:</p>
<blockquote class="style1"><p><span style="color:#ff0000;">The Court shall accept this Motion as a filing. However, this motion  			will not be denied. Plaintiff has, on numerous occasions, filed  			motions for clarification in this case, all of which have been  			denied. The Court finds the present motion, like the motions before it,  			is without merit.</span></p></blockquote>

<span style="color:black;"> Additionally, in his Report  				and Recommendation that recommends that the lawsuit be dismissed  				because of alleged violations of the orders of June 19, 2000,  				<a href="//mmason.freeshell.org/DE201Orders/de201.pdf">(D.E. #201)</a> and July 25, 2000,  				<a href="//mmason.freeshell.org/DE201Orders/de246.pdf">(D.E. #246)</a>, the Magistrate  				admits that the validity of these orders were being challenged,  				but he declines to assert legal authority for these orders by  				stating only:</span></p>
<blockquote><p><span style="color:#ff0000;"><span class="style17">The Plaintiff alludes to this Court's rulings,  			issued June 19 and July 25, 2000, directing that he should not  			contact any of the Defendants or individual Defendants, including  			their supervisory employees, regarding any matter related to this  			case except through their counsel of record. If the Plaintiff was  			represented, his attorney would know that this is proper procedure.  			The Plaintiff questions this Court's authority to enter an  			"injunction" as he calls it preventing him from contacting the  			parties directly. This Court has entered numerous orders on this  			issue in ruling on Plaintiff's many requests for clarification ito  			vacate, etc., of this issue and has attempted to clearly point out  			to the Plaintiff that it is a discovery issue and not one  			appropriate for injunctive relief. The Plaintiff has appealed those  			orders to the District Court and they have been affirmed by Judge  			Graham.</span></span></p></blockquote>

Judge Graham is alone in his view as all other jurisdictions have rejected Judge Graham's view of the law. <h2>The Florida Supreme Court On Florida's Public Records Law</h2>
<p>The Florida Supreme Court has held that the mere fact that a public agency is being sued does not relieve that public agency of its obligations under the Florida Public Records Act.  "Courts cannot judicially create any exceptions, or exclusions to Florida's Public Records Act." <span style="text-decoration:underline;">Board of County Commissioners of Palm Beach County v. D.B.,</span>784 So. 2d 585, 591 (Fla. 4th DCA 2001).  In <span style="text-decoration:underline;">Tober v. Sanchez</span>, 417 So 2d 1053, 1055 (App. Dist. 3 1982), the court held:</p>
<blockquote><p><span style="color:#008080;">We would be less than candid if we did not acknowledge that, as the present case demonstrates public agencies are placed at a disadvantage, compared to private person’s, when faced with potential litigation claims.  It is also pertinent to observe that the wisdom of such a policy resides exclusively within the province of the legislature.</span></p></blockquote>
<p>In several cases, the Supreme Court of Florida has held that the filing of a lawsuit under Federal Rules of Civil Procedure does not alter a public agency's responsibility for disclosure under the Florida Public Records Act.  In <a href="http://geocities.com/mcneilmason/Cases/hendersonVstate.html"><span style="text-decoration:underline;">Henderson vs. State Of Florida</span>, 745 So. 2d 319, 325-6; (Fla. 1999)</a></p>
<blockquote><p><strong>[W]e do not equate the acquisition of public documents under chapter 119 with the rights of discovery afforded a litigant by judicially-created rules of procedure.</strong></p></blockquote>
<p><span style="text-decoration:underline;">See</span> <span style="text-decoration:underline;">also</span> <em>Wait v. Florida Power and Light Company</em>, 372 So. 2d 420, 425 (Fla. 1979)(“We find no authority to support the argument that Florida Power &#38; Light, by engaging in litigation before a federal forum, has somehow given up its independent statutory rights to review public records under chapter 119. The fact that Florida Power &#38; Light simultaneously engaged in litigation before a federal agency does not in any way prevent its use of chapter 119 to gain access to public documents.”).</p>
<h2>The United States Supreme Court On State Court Law</h2>
<p>The United States Supreme Court has expressly stated that is was bound by a state's construction of its own law. "There is no doubt that we are bound by a state court's construction of a state statute."  <a href="http://supreme.justia.com/us/508/476/case.html">WISCONSIN v. MITCHELL, 508  U.S. 476, 483 (1993)</a>.   The Eleventh Circuit has held that “[a] federal court applying state law is bound to adhere to decisions of the state’s intermediate appellate courts absent some persuasive indication that the state’s highest court would decide the issue otherwise." <a href="http://bulk.resource.org/courts.gov/c/F3/476/476.F3d.1191.03-12739.03-12738.03-12737.html">Hunter v. Michigan Mutual Insurance Corporation,476 F.3d 1191 (11th Cir. 2007)</a>.  The Florida Supreme Court has stated that: ""[t]he decisions of the district courts of appeal represent the law of Florida unless and until they are overruled by this Court."[I]n the absence of interdistrict conflict, district court decisions bind all Florida trial courts." <a href="http://www.law.fsu.edu/library/flsupct/78318/op-78318.pdf"> Pardo v. State, 596 So. 2d 665, 666 (Fla. 1992)</a>.   Assuming for the moment the absurd notion that a non-lawyer litigant does not have the right to communicate directly with the government under U.S. Constitution, a state could grant such a right and the federal courts would be bound by that state created right.  The U.S. Supreme Court has expressly stated:</p>
<blockquote><p><span style="color:#008080;">Within our federal system the substantive rights provided by the Federal Constitution define only a minimum. State law may recognize liberty interests more extensive than those independently protected by the Federal Constitution. If so, the broader state protections would define the actual substantive rights possessed by a person living within that State.</span></p></blockquote>
<p><a href="http://supreme.justia.com/us/457/291/case.html">Mills v. Rogers, 457 U.S. 291, 300 (1982)</a>.  The Florida Supreme Court has defined the right of access to public records as a substantive right.  See <a href="http://www.law.fsu.edu/library/flsupct/sc00-82/op-sc00-82.pdf">MEMORIAL HOSPITAL-WEST VOLUSIA, INC. v. NEWS-JOURNAL CORPORATION,No. SC00-82, 784 So. 2d 438 (Fla. 2001)</a>("We have recently stated that the right of access to public records is a substantive right. See Henderson v. State, 745 So. 2d 319, 326 (Fla. 1999).")</p>
<h2>JUDICIAL MISCONDUCT DEFINED</h2>
<p>Judicial Misconduct has been defined by <strong>Jeffrey M. Shaman</strong>,  		DePaul University Law, <strong>Steven Lubet</strong>, Professor, Northwestern University Law, 		<strong>James J. Alfini, </strong>President and Dean, South Texas College of Law, <strong>U.S. Judge Alex  		Kozinski</strong>, United States Court of Appeals for the Ninth Circuit,  		in part as:</p>
<blockquote><p><span class="style3">Judicial action taken without any  			arguable legal basis —and without giving notice and an opportunity  			to be heard to the party adversely affected—is far worse than simple  			error or abuse of discretion; it’s an abuse of judicial power that  			is “prejudicial to the effective and expeditious administration of  			the business of the courts.” See 28 U.S.C. § 351(a); Shaman, Lubet &#38;  			Alfini, supra, § 2.02, at 37 (“Serious legal error is more likely to  			amount to misconduct than a minor mistake.</span><span style="color:#000000;"> </span></p></blockquote>

<h2>Chief Judge J.L Edmondson's Endorsement of Judge Graham's Conduct</h2>
<p>Chief Judge J.L Edmondson is of the misguided notion that legal error may not constitute "judicial misconduct".  Judge Edmondson appears to be alone in this view.  Even more remarkable is Judge Edmondson's apparent believe that a pattern and practice of ignoring prevailing legal  			standards is not judicial misconduct. This view is perfectly illustrated in Eleventh Circuit's <a href="http://mmason.freeshell.org/goto.php?w=http://mmason.freeshell.org/372c/05-0008/05-0008-Edmundson.pdf">Miscellaneous Docket No. 05-0008</a>, Complaint of Judicial Misconduct.  When told of this clear usurpation of authority and other abuses or misconduct, Judge Edmondson stated:</p>
<blockquote><p><span style="color:red;">In this complaint, the single (unsupported) allegation that has not already been determined in previous complaints filed by Mr. Mason against Judge Graham is that Judge Graham intentionally falsified his March 31, 2001, Civil Justice Reform Act Report in an attempt to conceal the fact that he had not ruled on one of Mr. Mason's motions for over 15 months. Not withstanding the fact that the motion in question was pending for more than six months, and the fact that the March 31, 2001 report is incorrect, Mr. Mason has not presented any information, evidence or documentation to support his claim to suggest that the omission of this motion on this CJRA report was an intentional attempt by Judge Graham to conceal his failure to rule on the motion.</span></p></blockquote>

<h2>Litigant's Right to Communicate With  		Government During Litigation.</h2>
<p align="left">Every jurisdiction in the United States has affirmed a  		citizen’s right to petition the government even in the midst of bitter  		litigation. <content:encoded><![CDATA[<p>Som tidligere nævnt i indlægget, hvor The Bach Blog havde rundet et skarpt hjørne, afslutter jeg nu afstemningen om, hvad I helst vil have jeg skal skrive om. Dette indlæg vil komme til at indeholde fun facts om netop denne afstemning.</p>
<p>Spørgsmålet lød i alt sin enkelthed "Hvad synes du, jeg skal blogge om?", og dertil var der meget delte meninger. Først kommer der lige lidt statistik:</p>

<p>Ikke underligt er det kategorien "Arbejde", der har fået færrest stemmer, hvilket jeg må sige, at jeg er meget glad for, da jeg ikke er i arbejde for tiden. "Livet på uni" har fået en del flere stemmer, men er stadig ikke helt oppe at ringe. "Fester" er I åbenbart heller ikke så interesserede i, hvilket måske egentlig også er meget godt, da hukommelsen ikke altid fungerer lige optimalt efter indtagelse af enorme mængder alkohol. Som en flot nummer to kommer jeres egne forslag, som jeg nok skal vende tilbage til lidt længere nede. Den suveræne topscore må siges at være kategorien "Sport", hvilket jeg også kommer en del omkring her på bloggen til dagligt. Det er ikke utænkeligt, at AaB's succes spiller en rolle for denne kategoris sejr, men jeg lover jer, at der nok skal blive blogget om mere sport i fremtiden - ikke mindst, når AaB bliver danske mestre.</p>

<p>Nu er vi kommet til det punkt, hvor vi skal se på, hvilke forslag I ivrige læsere selv er kommet med, samt nogle kommentarer dertil.</p>

<p>Jeg må sige, at jeg har svært ved at skrive om dette forslag, da jeg ikke er helt enig. Bevares, byen er stor og til dels flot, men den har hverken Gaden, et ordentligt universitet eller et ordentligt fodboldhold.</p>

<li><em>At ham Bach er lidt af en arrogancerytter</em></li>

<p>Endnu engang er jeg fundamentalt uenig. Bach er på ingen måde en arrogancerytter, Bach er en kritiker, som tør tage skeen i den rigtige hånd, og tør kalde en spade for en skovl... eller...??</p>

<p>Jeg er helt enig i, at min kæreste er rigtig sød, og måske kommer der mere på bloggen om hende i fremtiden.</p>

<p>Dette kommer bestemt ikke på tale. Jeg nægter at spilde min tid på en tv-kanal, der leverer så dårlig kvalitet. Jeg må dog krybe til korset og indrømme, at jeg en enkelt gang imellem har set den. "Mogens kom forbi" bliver på en måde fremstillet som det dårligste indslag på kanalen, men dette er bestemt ikke tilfældet. Der er sådan et madprogram, hvor en kok laver mad sammen med en gammel mand (som også laver havearbejde i et andet program - også uden held!!). Han er så elendig og egoistisk, at det er til at brække sig over. Flere gange har han nægtet at følge den opskrift, som den i øvrigt udmærkede kok har planlagt at følge - ganske enkelt fordi han ikke kan lide det de skal have, og den gamle mands appetit er naturligvis vigtigere end vi seere, som gerne vil se dem lave den rigtige ret. Andre gange er han bare flabet, og smager på maden inden det er blevet filmet, så seerne rent faktisk kan se, hvad de har lavet. Han svarer mest af alt til en middelmådig Carsten Werge, bare flere klasser under, og så tilsat et køkken og et ordentligt sidekick. Well... Nok om det - som sagt så ser jeg aldrig TV2nord!</p>

<content:encoded><![CDATA[<p>Victor was the 2nd male child, my father's older brother. (Pictured at far left) Harold was the oldest boy (pictured far right), then there was Donald (my father, pictured Center) and Lyle the youngest shown front lower right). Victor married Alice and they lived near Berthold, ND and had 4 children: Shirley, Christine,  Edwin &#38; Claire.</p>
<p>As a child, I remember going to North Dakota and we stayed at Uncle Victor &#38; Aunt Alice's home. They had a farm across the road from the original Haugen Homestead in Ward County, North Dakota. This is about 20 minutes west of Minot. Alice was a lovely and quiet person who was always so pleasant...a petite Christian woman. Victor was a serious church-goer who played music and detested alcohol. This was probably because his father Nels was quite a heavy drinker who hid bottles in the dirt under the barn of his Livery Stables.</p>
<p>Shirley was their oldest daughter. She married Bob Larsen and they still live in Glendive, Montana. (Cannot recall how many children they have).</p>
<p>Christine married Jim Shipton and they lived in Dawson Creek, British Columbia (Canada). Jim died early and I cannot recall how many children they have.</p>
<p>Edwin is one of my relatives I have known the best. Eddie loves to play guitar and he is the one who continues to farm the original Haugen Homestead to this day. He is quite a family historian and works in Minot as a financial planner, selling insurance through a Lutheran agency. Ed was married to Mary Anne and they had 2 sons. They divorced back in the 80's and Ed is now married to Pat (Dahl).</p>
<p>Clare married Jack Dendinger and they live in Fair Oaks, CA. They have no children and are very much alive and well.</p>

<content:encoded><![CDATA[<p>In <a href="http://www.amazon.com/gp/product/1401300979?ie=UTF8&#38;tag=thephtest-20&#38;linkCode=as2&#38;camp=1789&#38;creative=9325&#38;creativeASIN=1401300979" target="_blank"><strong>King's Gambit: A Son, A Father, and the World's Most Dangerous Game,</strong></a> I wrote about my losses (expected but painful nonetheless) in simultaneous chess exhibitions to Bent Larsen and Garry Kasparov.  On Friday, I had the opportunity to be on the other side of the table when I played 24 kids at once at the chess club in my son's elementary school.  I now appreciate the stamina that simuls require.  I was nearly dizzy when it was all over and dropped a bishop in a twenty-fifth game, against the sole adult who crashed the gathering.</p>
<p>Later that evening, the chess club held a bake sale at Poetry Night at the school.  A couple hundred people showed up to hear the kids read verse that they had composed.  My eight-year-old was one of the readers.  He wouldn't tell me in advance what he was going to read.  His classmates recited nice, sentimental ditties about the beauty of sunsets, deer, and swans.  Not my kid.  He's a little Jack Nicholson.   He brought down the house with a poem that began: "I'm a terror to teachers/ a stingray to substitutes/ I can make the clock hand go to 3:30/ when it's only been two seconds of math."</p>

<p>Once minutos. Eso fue lo que la tropa de <strong>Rijkaard</strong> tardó en abrir la lata del robótico <strong>Schalke 04</strong>, un equipo de tanto entusiasmo como escaso fútbol. Pero como el <strong>Barça</strong> sigue en época de depresión, en etapa de abandono, no remató la faena, y después llegaron los previsibles agobios. Los alemanes crecieron en intensidad, sacaron los cañones y gozaron de cuatro o cinco ocasiones para haber destrozado la maltrecha moral azulgrana. No fue así. El Barça, acomodado, lento, pasivo como en los últimos tiempos, volvió a airear su peor versión y su fútbol anodino permitió que los alemanes se lanzaran a la aventura. Allí, mientras su equipo se pertrechaba, Valdés sacaba varias manos a <strong>Kuranyi, Assamoah, Pander</strong> y compañía. Al final del choque, nada nuevo bajo el sol: el Barça, que sigue jugando mal y que es su peor enemigo por sus ataques de vulgaridad, salió vivo de <strong>Alemania</strong>. Lo hizo sacando petróleo de uno de los pocos estandartes a los que se aferra. Salió vivo agarrado a un gol salvador de <strong>Bojan Krkic</strong>, el <strong>Butragueño de Los Balcanes</strong>. Un chaval que llegaba como novedad y que a día de hoy es toda una necesidad. Su gol salvó la cabeza de <strong>Rijkaard,</strong> y concede medio billete de semifinales a un Barcelona que sigue enfermo, pero que esta noche salió ileso, a pesar de empeñarse en perder el partido. Valdés tuvo mucha parte de culpa en eso.<!--more--></p>
<p>Estaba en juego el futuro de <strong>Rijkaard,</strong> el crédito de los futbolistas y el ánimo del barcelonismo, y el <strong>Barça</strong> solventó el envite con más mate que brillo, aunque con un resultado francamente bueno. La primera mitad sirvió para que el Barça hurgara en las heridas defensivas del Schalke 04, un equipo de medio pelo, y para que <strong>Etoo y Henry</strong> descubrieran las miserias defensivas de la jurásica defensa alemana. A los once minutos, casi en frío, el Barça lanzó su primera bofetada al rostro germánico. <strong>Henry</strong> disparó, el portero rechazó y por allí emergió el pie, delicado pero preciso, pequeño pero muy grande, de<strong> Bojan Krkic</strong>. Un asesino con cara de niño, una especie de <strong>Butragueño de Los Balcanes</strong> que ha pasado de ser una novedad a ser una necesidad. A otro cualquiera le hubiera temblado la canilla, o le hubiera pesado la responsabilidad de ocupar el lugar de <strong>Ronaldinho</strong>. A este chaval, no. Bojan puso el pie, dejó esa sensación de goleador de área pequeña, con el cartel de <em>'pasaba por aquí'</em> y le dio un gol de oro al Barcelona. Un tanto que le convierte en el segundo futbolista más joven en marcar un gol en la historia de la Liga de Campeones. Un buen aval para pasar a la historia.</p>
<p>Con el <em><strong>Bojanazo</strong></em> silenciando <strong>Gelsenkirchen</strong>, el Barça cuidó más la pelota, la administró y le dio cierto criterio. Surgieron los actores de reparto de siempre, <strong>Iniesta y Xavi</strong>, y el Barça impuso su ritmo, su cadencia, su fútbol. Lo hizo al ralentí, con una velocidad aceptable para imponerse, pero con la misma tendencia de los últimos tiempos de abusar del toque sin excesiva profundidad. Sea como fuere, el <strong>Schalke</strong>, incapaz de entrar en la pelea del buen trato de la pelota, se fue a la caseta acusando el golpe. Sólo pudo cambiar su suerte a balón parado, y los alemanes dejaron la impronta de equipo peleón, pero sin excesiva calidad.</p>
<p>La segunda mitad fue un simulacro de la batalla de <strong>Las Ardenas</strong>. Los alemanes, pura furia, se lanzaron a tumba abierta en un plan de acoso y derribo sobre la portería de <strong>Valdés.</strong> El Barça para aquellos entonces empezó a recular, a acularse en torno a su portería y a pensar más en guardar el botín que en aumentar sus ganancias. Sin embargo, a pesar de que el Barça andaba con el depósito de gasolina justo, con el cuentakilómetros desajustado y con el centro del campo pidiendo árnica, los alemanes estuvieron peleados con la puntería. Amén del cambio de <strong>Kevin Kuranyi</strong> - mucho ruido y pocas nueces-, y contra todo pronóstico, el Schalke 04 fue creciendo en su intensidad atacante. <strong>Zambrotta, Milito, Puyol y Abidal</strong> se multiplicaron en tareas defensivas, y fue entonces cuando el once de Rijkaard aguantó el sufrimiento hasta el final. En los últimos veinte minutos, los alemanes incrementaron sus arreones - casi todos a balón parado-, y <strong>Larsen, Westermann y Bordon</strong> se estrellaron contra los guantes de un inspirado <strong>Valdés</strong>, con lo que la ofensiva teutona acabó por remar para morir en la orilla. There seem to be some connections between this discussion and the issues that Nella Larsen raised in 1928. 80 years later, it's interesting that this is presented as a "new dialogue" on the question of racial identity.</p>

<content:encoded><![CDATA[<p>Pe drum nu se intamplara lucruri prea iesite din comun. Asta daca nu punem la socoteala faptul ca la prima oprire, intr-un orasel aflat pe soseaua care ducea catre baile termale, Larsen nu mai reusi sa se suie inapoi in microbuz si se pierdu de restul grupului.</p>
<p>Oprisera un pic in oraselul respectiv ca sa-si mai indrepte spatele si sa-si rezolve si alte probleme fiziologice, microbuzul nefiind dotat cu o toaleta proprie (chestie care, oricum, nu era obligatorie, intrucat in interiorul lui nu se comercializau nici un fel de bauturi; de fapt, nu se comercializa nimic).</p>
<p>La toaleta Larsen observa un gandac rosu cu pete albastrui. Incepu sa ii observe cu atentie comportamentul: gandacul parcurgea o linie, de la un capat la celalalt, de-a lungul unuia dintre peretii camerei. Cand ajungea la capat, se intorcea inapoi.</p>
<p>"Se plimba ca un leu in cusca", isi spuse Larsen. Ramase pierduta, gandindu-se la aceasta expresie. Nu vazuse niciodata un leu aflat intr-o cusca (in Republica nu mai existau de mult timp custi in care sa fie tinute animalele, fusesera toate desfiintate inainte ca ea sa se nasca), dar stia ce inseamna.</p>
<p>Apoi se lansa in alte reflectii si apoi, sarind de la una la alta, isi aduse aminte de cateva intamplari din copilarie. Cand iesi afara, insa, observa ca microbuzul plecase. Nu era prima data cand i se intampla asa ceva, asa ca nu intra in panica. "Eh, o sa ma descurc eu cumva", isi spuse ea in semn de incurajare.</p>

Musuak ii era simpatic, era vecinul ei, dar stia foarte bine ca <em>nu erau locuri pentru toata lumea</em>. Cum adica, vine asa, cine vrea? Au fost doar 7 castigatori la tombola, iar Musuak nu era printre ei. </p>
<p>Asta e. Cum sa apara asa si sa intrebe daca mai sunt locuri, ce-i in mintea lui? Adica, in fine, s-ar fi bucurat sa poata veni si el, dar nu avea bilet, era clar ca nu avea, daca ar fi avut i-ar fi spus cand s-au vazut, dupa bal. Ce mai e si asta?</p>
<p>Larsen incerca sa isi pastreze cumpatul si sa spuna ceva echilibrat. Si tocmai atunci Musuak interveni: "Aaaa, am glumit cu locurile! Eu nu vin in excursie. Adica, in fine, vin si eu, dar nu in calitate de turist. Cei de la Ministerul Apararii aveau nevoie de un sofer. Ma plictiseam, asa ca m-am dus la ei si am incheiat un contract. Eu sunt soferul vostru pe perioada excursiei. Asta e tot. Nu toate locurile de la tombola au fost extrase. Asta e. Acum hai sa plecam, pana nu se face tarziu!"</p>
<p>Incordarea pe care o simtea Larsen se dizolva ca prin minune. Nu mai spuse nimic. Zambi prosteste catre Jollie si Musuak si se duse pe locul ei. Microbuzul demara in tromba. "Spre baile termale!" isi spuse Larsen. "Wow, chiar am pornit!"</p>

<p>Mai vazu cativa oameni. Nu-i cunostea pe toti, dar pe unii parca isi amintea ca ii vazuse tot in seara balului. De fapt, alte ocazii sa vada multi oameni nu mai avusese de mult timp, oricum.</p>
<p>Fata cu pisica albastra incepuse sa ii spuna anumite lucruri. Larsen dadu din cap absenta. Spera ca nu incuviintase vreo grozavie. Ii observa expresia fetei lui Jollie. Vedea ca reactia ei era pozitiva, dar nu reusea sa se concentreze la cuvintele ei. Gandurile ii zburau in alta parte.</p>
<p>Altercatia dintre pisica albastra si liliacul mov o readuse la realitate. Nu ii era limpede ce s-a intamplat, dar simtea ca s-a intamplat ceva. "Dar ce anume?" - isi spuse. "Si de ce nu vine soferul microbuzului? A trecut deja destul de mult timp!"</p>

<content:encoded><![CDATA[<p>Larsen se trezi intr-o dispozitie excelenta. Era ziua pe care o asteptase toata saptamana. Si cu toate astea, saptamana nu trecuse greu. Isi vazuse de lucrurile pe care le facea de obicei - citise, ascultase povesti la radio, facuse tot felul de obiecte aiuristice din nuiele, sfoara, panza si frunze uscate, se dusese in vreo doua zile pe la piata si vanduse din ele si asa mai departe.</p>
<p>Cu Musuak nu se mai vazuse decat din intamplare. Si nici cu alti oameni pe care ii intalnise la bal. Pe Opzecica o mai vazuse in treacat prin sat, dar nu discutasera nimic.</p>
<p>Iar acum se pregatea de plecare. Isi puse intr-un rucsacel de panza pe care si-l facuse singura cu mai mult timp in urma cateva lucruri: pantaloni de trening, ca sa ii foloseasca in loc de pijama, o bluza, niste ciorapi de rezerva, o caciulita, un briceag si o sticla de apa. Pentru drum isi mai lua intr-o punguta cateva sandvich-uri (cu gem si cu branza).</p>
<p>Ajunse imediat in oras si apoi in fata Ministerului Apararii. Microbuzul era acolo, avea si o hartiuta lipita pe geam: "Excursia la baile termale". Dar nu era nimeni in jur. Venise prea devreme. Se aseza pe o bancuta de pe marginea drumului si incepu sa astepte.</p>

<title><![CDATA[A reflection of circumstances]]></title>

<content:encoded><![CDATA[<p class="MsoNormal">The origins of Africans in America are rooted in violence. As a people, African-Americans would not even be present in this country if not for the slave trade during America's formation. Slavery is by definition an exercise in suffering, as the victims are treated as subhuman. I see this as being reflected in the literature of African-Americans. Violence pervades their experiences. Their history is in fact built upon it. Even through the early part of the 20<sup>th</sup> century, racially based murders were common in the South. The authors we are reading lived through these turbulent times, and their experiences were molded by them.</p>
<p class="MsoNormal">Baldwin’s “Going to Meet the Man” is a particularly poignant example. In the story, we get an extremely graphic depiction of a lynching. I am not sure if Baldwin ever witnessed this act in person, but even if he never did, his description is likely very accurate. The violence we see here is obviously shocking to the reader, but for the characters involved, it is thrilling, exhilarating, and entirely justified. Despite the inhumane and torturous act, the people carrying it out feel as if they are carrying out God’s will, or something equally deranged and misguided.</p>
<p class="MsoNormal"><i>Quicksand</i> to me does not depict suffering in the same way. Helga Crane’s turmoil is internal, and indirectly a result of her situation. Her problems stem from an unhealthy childhood, although it could be said that her half-black, half-white genes exacerbated the problem. Still, I see Helga’s suffering as not so much a continuation of the plight of blacks in America but more a result of a traumatic upbringing.</p>
<p class="MsoNormal"><i>Gabriel’s Story</i>, although I am only about a third of the way through, feels like it is going to explode into a rousing, violent epic. As of my posting this, I haven’t begun the second part of the novel, so I am still unsure of what will befall Gabriel and James during their journey. I think, however, that there will be a violent confrontation at some point, resulting in the death of one of the boys, most likely James.</p>

I'm sorry that it has been  posted so late. Most of you don't respond until after this time anyway, so I'm hoping it won't be a huge inconvenience.</p>

<p>For this post, please find a point of connection between the novel and the poem you are analyzing in your essay.  What are some similarities or differences?</p>
<p>Think about rhetorical style as well as plot.  How do the two authors use language? Characterization? The role of history? Do both approach concepts of essentialism and social construction in similar or different ways?  As always, use cited quotations to demonstrate your ideas.</p>
<p>A perhaps self-evident note: Please go further than "they both address black identity" or "they both address black female identity."  Take that surface similarity and deepen it to explore the significance of different approaches to literary expression of identity.</p>
