Republican Presidential Candidate John McCain gets a lot of slack for being "out of touch." McCain admits that he is "technology illiterate" and "doesn't use e-mail." Here is my question: If you don't use e-mail, then what the hell do you use? Pony Express? Is McCain giving a manuscript to a neat ol' lad with a musket on a pony so he can toddle over to Capital Hill?

I brought this up in a conversation the other day, and someone responded by saying, "Nate, take it easy on McCain. There are a lot of people who don't have internet." Yes, you are right ... and they probably won't be voting!

I'm about to unleash my own Kraken - which is to say, I'm about to send an amazing amount of unsolicited e-mails to potential employers.

I'm doing a gigamegaload of online research, and when that's completed, I'll be directing the aforementioned lucky souls to this blog.

Here, they can read my innermost (and self-censored to remain professional) thoughts, see my work samples and resume, and best of all, brighten their day with a laugh. (Man, I'm humble.)

So I will soon see a large spike in blog visits, and I'll be seen by everybody who's anybody in the DFW marketing world.

By Zeus' beard, I welcome you all!

Se a questão for realmente grave, discuta-a pessoalmente.

I see today that another study suggests that excessive use of cellular phones might cause brain canc

I see today that another study suggests that excessive use of cellular phones might cause brain cancer. Of course there are other studies that say there is no risk. The more important question is - at least for me - who are all these people talking to, and why?

Yes, I own a cell phone. It's one of those that I add minutes to and if I need the phone, it costs me 15 cents a minute. If you wanted to know my cell phone number, I would have to look it up, because I never give the number out. My cell phone is always off unless I need to make a call. Things that merit my using a cell phone are car trouble, a storm taking out the house phone, or an emergency. That's about it. As a mom, I do appreciate the extra bit of security having a cell phone provides, but it seems to me that the saturation of cell phone use in this country has created a population that cannot stand quietness or being alone.

Of course there are jobs that are greatly enhanced by the advent of the cell phone, but it seems to me that the vast majority of cell phone conversations (voice or text) are unnecessary. I see people consumed with the person on their cell phone while ignoring the person sitting beside them in restaurants or in cars. I see teenagers texting their friend sitting beside them rather than actually speaking to them.

A few years ago I realized that the emergence of e-mail was destroying the art of taking pen and paper to write a letter and mail it. I think you will find that when most people go through their physical mail each day, that if they see a hand-addressed envelope from a friend they will open that immediately, while setting the rest of the mail aside until later. I see the obsession with cell phones creating an even greater barrier to meaningful human relationships.

Write a letter. Go see an old friend ... oh, and turn off your cell phone.

I have a disturbing personality quirk. I have had it for a very long while, actually-- I don't respond well to the words "mandatory" or "required", and I don't do too well with "urgent" or "now!" either..

When someone (say, my mother) would tell me to, "get over here now", I knew I was in trouble and I would move slower than grass grows.
When a Mandatory Staff Meeting was being held (back in the days before self-employment) I was famous for always having some trick worked out that allowed me to escape attendance.. because we all know that "Mandatory Staff Meeting" translates into English as "torture session - guaranteed to drive you insane."

So, armed with that knowledge about me, you will understand why I ignored this e-mail for several days...

IRS Notification - Tax Refund - Attention Required.

.. and if you read me regularly (or, happened to catch this article) you know that when I did take an action on this e-mail, I marked it as Junk, unopened.

What?! (you say) How could I disrespect the IRS?! (you say)
Well, for one, the IRS does not e-mail you important documents (neither does your bank, or Pay Pal, or..). And, the IRS -- like almost every other Government institution -- uses "dot gov" in its URL. In fact, the Internal Revenue Service's web address is www.irs.gov.

These particular phraudsters haven't tried spoofing the URL, instead they've set up a similar looking name, hoping that I wouldn't notice.
This classic phishing attempt is using "social engineering" to try to get me to reveal information that will allow cyber-criminals to adopt my identity. It is using my conditioning (to reacting) to Authority. It is appealing to my greed. It is telling me to "act now" (or miss out). In it is a hyperlink that would take me to a very realistic-looking fake IRS website.
This phraudster, or gang, probably had a network of zombie computers send out a million of these e-mails.. because he knows that for every phishing-savvy person, who deletes at a glance, there's 3 who've never heard of phishing.

Tip of the day: Pay attention to details, and know that IRS phishing e-mails are an everyday occurrence, and an estimated 6,000 fake IRS websites are in daily operation. Don't even open e-mails you suspect may be a scam.
Yes. I'm repeating myself. But, at least a part of someone's identity is being stolen every two seconds (global) at an estimated cost to business of $25 billion a year. That's 15,000,000 victims a year.

Today's free link(s): Folks, I don't usually do this (in fact, I never have before).. but I bet you don't know that you have a heuristic bogus Website detector built right into your machine, and all you have to do is turn it on. I wrote an article on how to do that, and the link to it is here.

Firefox users have this protection as well, and it is already enabled. When you see this..

you've stumbled across a cyber-criminal's site. I have been using the new version of Mozilla's Firefox browser, Firefox 3, for a while now, and am satisfied enough to recommend it. To get it, or just read more about it, click here.

Here are the results:

Of course, e-mail shouldn’t be a generic sales pitch if you want to maximize your return. You need a message targeted to the sender, based on analytics: where he’s located, how he got to your site, what information/service/freebee he asked for. It’s not necessary to write a personalized response to each lead, but buyers fall into categories, and the more accurately you can describe your potential client, the better you can rifle your message to him.

The letter is only partly about “selling;” it’s mostly about providing your product/service to someone who already wants it – remember, he came to you.

Not every prospect who comes to your Web site, landing page, or opt-in will proceed to the purchase. But the text of your message will help him see all of the reasons he should go to the next step. How do you know what his reasons are? Analytics will show most of them. Your targeted e-mail response to his request will help you close the deal at a lower cost than other on-line marketing methods.

My views on owning an iPhone are well known here by now, I just don’t see the sense in owning

My views on owning an iPhone are well known here by now, I just don't see the sense in owning one.

However I do see the sense in what they do which is why I brought an iPod Touch instead, it can do everything the iPhone can except make phone calls and do texts.

The other evening I downloaded the software update onto my iPod Touch so that I could have access to App Store, two hours later and a bit of swearing I was up and running and downloaded my Facebook app, the complete works of Shakespeare and the Wordpress app, which means in future I can post anywhere at any time without the use of a computer. That being said I am posting today on my trusty old desktop.

Some people think the iPod Touch is the senseless bit of kit when you have the iPhone out there, but I would argue it is the iPhone that is the senseless bit of kit when the Touch is on the market.

Lets look at a few points to argue my case. The Touch is a one off cost of between £199 and £329 depending on the Gigabytes required and from then on it's downhill all the way paying for your music as and when you want it and many apps are free with just a few paid for ones available.

Then there is the iPhone 3G. If you want one of these you may well get able to get the handset for free, but then you are looking at a minimum of £45 a month for a contract. If you want a cheaper monthly tariff you will be paying £99 for the handset followed by £30 a month...and this is just for the 8GB version of the phone.

I know we live in a day and age whereby our mobile phones have to do everything including the washing up, but surely in a time of economic uncertainty we should be looking at protecting our wallets a little rather than battering them every month with a luxury item. Yes the Touch is a luxury item, but it's a one off luxury item which then doesn't have the ongoing running costs associated with the iPhone if you don't want it to.

I don't hate the iPhone, I am just trying to see the sense in it when there is a gadget on the market in the form of the Touch which so obviously clashes with it. There is almost a feeling the Touch was seen as a necessary evil but isn't really liked by the people at the top and if it did fail it wouldn't be any great shakes to them.

I like my iPod Touch, I take it everywhere with me for music, e-mail, weather, the works. So faluire of the product isn't a option for me.

But can someone please tell me how these two products can work together when they are so alike?

Over the next few days, I will discuss recent, noteworthy legal developments that occurred prior to

Over the next few days, I will discuss recent, noteworthy legal developments that occurred prior to the launch of this blog. The first development pertains to the Ninth Circuit's decision in Quon et al. v. Arch Wireless Operating Co. Inc. et al., 529 F.3d 892 (9th Cir. 2008), filed on June 18, 2008. [Decision]

In Quon, the City of Ontario had a Computer Usage, Internet and E-Mail Policy, which Quon acknowledged, and agreed to comply with, as part of his employment. However, the City failed to enforce the policy. In fact, the City acted contrary to the policy by allowing its employees to avoid audits of their cell phone usage so long as they reimbursed the City for overage charges, which Quon did.

When the City subsequently enforced the Policy, the plaintiffs sued the City, wireless provider and other defendants for invasion of privacy. The Court noted that the Policy may have been enforceable if the City had complied with it. However, the Court found that the plaintiffs enjoyed a reasonable expectation of privacy in their cell phone text messages - notwithstanding Quon's prior agreement to the Computer Usage, Internet and E-Mail Policy - due to the City's inconsistent and contrary conduct (the "operational reality") with respect to that Policy.

This decision ultimately serves as a strong reminder that employers may inadvertently undermine their computer, Internet and e-mail policies by acting inconsistently with those policies. Employers should take special care not to do so, and emphasize such care to their supervisors and managers, especially given the importance of computer, Internet and e-mail data in discovering instances of employee misconduct.

Well a few email MX record hick ups and tweaks with logo and styling later we are live with the beginnings of our new site design. We had some strange reaction from IE initially and some of the strangest behavior we have ever seen from a browser. We had no problems in Safari, FireFox, Opera, WebKit but in IE 6 and 7 you would see the site and then poof error about connection to site and then cryptic error page from IE wanting to run connection wizard. This seemed to be an issue with a badge we originally had on the site. We have since removed them all, twitter, Upcoming, Google Reader and a Tag Cloud.

From the feed back we have received it may be a bit dense and especially with the badges overwhelmed a few people so we are loosing or moving the badges and are looking at making some tweaks on the home page.

What do you think?

E-mail: tandmlaw@sbcglobal.net

My name is Sarah Lorraine Matlock. I am a resident of San Francisco and the granddaughter of Hope's former mayor, Dr. Samuel W. Strong Jr. who died on June 8, 1999. My grandmother is Dr. Strong's one and only wife, Edra Meeks Strong, who died on August 27, 1999.

It has recently come to my attention that the above deceased individuals appear to have been the victims of their own children in that Edra's Last Will and Testament is fraudulent, and Dr. Samuel Strong's will, which his son evidently convinced him to amend in 1999, has seemingly served the primary interests of his two immediate children, Carolyn Strong Woodson of Yountville, California and Samuel M. Strong of Little Rock, Arkansas. Both children are named executors of both of their parent's wills.

This discovery has been a process. I first began looking into the will of my grandfather because my mother stated, immediately following his death, that my grandfather had "left" forty thousand dollars total to split four ways. She said there was ten thousand for her and her brother each, and ten thousand for myself and my brother each.

Carolyn did not tell me both had left a will. She added, however, that she did not wish to give the money to me. She stated that instead, she wished to place the $10,000.00 under her name for investment purposes.

I inquired about receiving back my invested money several times over the past nine years, which she always refused to return. This reported behavior raised the suspicion of my new fiancé, James A.Sablan Sr. Finally; it prompted us to search out the matter.

As it turns out, my mother misrepresented the matter in that she and her brother were executors of two wills representing two sizable estates. Both wills were done under an attorney by the name of A. Wyckliff Nisbet Jr. Mr. Nisbet works for a large firm in Little Rock, Arkansas known as Friday, Eldredge and Clark. Carolyn Woodson, Samuel M. Strong, and her attorney, Nisbet, have attempted to rationalize her failure to distribute to me under such excuses as "You are not a descendant", or "The entire estate was for the executors only" (even though the "surviving descendants" are to "share and share alike"), etc.

The first will was completed in 1996 on behalf of my grandmother Edra Meeks Strong. Because I know for a fact that Edra had full blown dementia in 1996, her will is fraudulent and could only have been completed coercively. In fact, Edra did not even recognize her children at this stage of her illness. Furthermore, in 2001, the executors transferred Edra's eighty acres of Timberland in Arkadelphia (where she and her husband were both born) listed in her "dementia will" into the Samuel Meeks Strong Family Trust which was only part of Samuel W. Strong's will. As you know, this renders the trust invalid, which we have already confirmed with a former judge and friend of my fiancé.

In addition, Edra's will gives her entire estate over to her two children only, Samuel Meeks Strong and Carolyn Strong Woodson. Contrary to what she is reported to have stated in her will, Edra clearly told me more than one time before the onset of her dementia that she intended to leave me "a nest egg", although she did not specify the amount.

Furthermore, both wills contain waivers for the requirement to appear in court in person before the judge, as well as waivers for the final accounting of all assets. There is apparently cash, stocks and bonds that are not even mentioned specifically in the will, which has evaded the scrutiny of the State of Arkansas and the I.R.S. as well by the use of these waivers.

For this reason, I have already contacted the I.R.S. They have requested that I come in personally to speak to them about this matter in further detail. I will do this before the week is out.

The entire family, including not only both executors but other heirs- my brother, Alfred Richard Woodson of Chicago, Illinois and my cousin Sharon Strong Cowell of Maryland, have been entirely non-communicative about this matter. I have also tried to speak to my brother's ex-wife, Jennifer Rose Sandstrom of Mesa, Arizona, and my father, Alfred Richard IV of Yountville, California. They are generally either hostile or non-communicative altogether. The few things that my mother has said by e-mail are also lies that can be clearly deduced through the e-mails.

We have also researched the cause of death of both grandparents and find it interesting that both died within two months of each other due to a "myocardial infarction". In fact the, entire circumstance surrounding their deaths has raised extreme suspicion. To begin with, Samuel Strong specified in his will that he wished for his wife to be live in accordance with "the standard to which she is accustomed", which was to be at her home in Hope, Arkansas with her own private care, not amongst strangers in a controlled environment.

Instead of following his will, the two executors immediately "skated off" Edra into a nursing home, Pleasant Valley Living Center in Little Rock, Arkansas, following their father's death. Edra then "up and died" two months later of a heart failure. Interestingly enough, even she had lived quite successfully and uneventfully for twenty to thirty years prior with her heart condition.

Also, whereas Samuel Strong's death indicates heart failure, I was never aware of him suffering from cardiovascular disease, or of any prior hospitalizations. My grandfather was an extremely healthy and strong individual all his life. It is interesting to me that his cause of death lists "cardiovascular disease"- as if someone is trying to convince us that this was a chronic condition that he had, but does not list "cardiovascular disease" on Edra, who indeed did suffer with the condition for a long period of time. These records were obtained from the Herndon Funeral Home in Hope, Arkansas.

In looking at the entire circumstance, it appears quite strange that in one year, Dr. Samuel M. Strong managed to have the will amended, both parents died, and Edra died shortly after the needed signatures from her were obtained. Furthermore, we are told that her signature is on EVERY page in her fraudulent will, although we have not yet ordered the will. Again, it seems as if someone wants to "convince" everyone that she was competent at this time, which she clearly was not.

Also, Dr. Samuel Strong died first, which gave the executors the freedom to disobey the wishes of their father in regards to Edra's care. You will also note in the wills that Samuel Strong was not Edra's Power of Attorney in 1996, but became her Power of Attorney in 1999. This enabled him to sign waivers on her behalf for the final accounting of all assets in Samuel W. Strong's will, and also would have convinced "dad" that he was doing everything straightforwardly and representing Edra's best interest.

We have confronted the entire family with our suspicions, as well as the attorney, concerning Edra's will, and no one has rebutted anything that we have said in regards to her dementia at the time of her will in 1996. We also voiced concerns of possible foul play, and neither have they rebutted this.

Thank you for hearing this matter. I am respectfully requesting that this case be re-opened and prosecuted, so that all perpetrators, including any and all accessories and accomplices, will brought to justice, and so that the estates can revert back to the State of Arkansas and be redistributed in the proper fashion.
