Last night a bunch of us student pilots and one lecturer decided to go big at a really kewl bar called Hi-Flyerz which is an aviation themed bar. It is very kewl! It is right under the final approach for runway 03R of Oliver R Thambo International Airport. For plane lovers that is a very kewl thing!

You get to see planes like this:

Outside the bar is the actual real nose of an original Boeing 747-200 with registration ZS-SAL that you can sit around if you so desire. From inside the bar you can see inside the cockpit which is so neat! If you like anything aviation then do yourself a favour and get there for a drink.

Yesterday I did them all! I took off, we flew out north to Hartebeespoort Dam, did some fairly low level flying over the dam and tried to do a stall and incipient spin but the C172SP is just way to stable. It truly is an amazing aircraft. We also played around with the auto pilot that will come in handy when the Mile High Club opens! Most importantly I landed in one piece. I'm not going to lie and say I wasn't at all nervous after all it has been a while. I will even go one step further to say I was absolutely shitting myself! I did however manage to pull off an incredible landing and even though that's pretty standard and more so, expected, I was so chuffed that I still have it in me! So yes, it was a landing that we could walk away from!

It felt so good to be up in the clouds again. That of course is simply an expression since I am not instrument rated, so even if there were clouds in Johannesburg in winter, I would not be able to fly in them! But being airborne again was simply incredible.

I am going flying again this afternoon and this time I will be a little calmer and enjoy it even more! I need to do some work on my radio communications as I am a little rusty but that's all part of the learning.

My money is in the UK. Have you seen the exchange rate lately? Every day I lose more money! When I did my calculations to see if I could afford all this the rate was in the upper 15's. It has now dropped to upper 13's and still dropping!

Nicolas Sehnaoui, président de la commission économique du « Courant Patriotique Libre » a appelé à ne pas exploiter à des fins politiques l'incident de l'hélicoptère de l'armée, sur les collines de Soujoud.
Sehnaoui, dans un entretien télévisé à l'ANB a souligné que "cet incident doit être placé dans un contexte national et stratégique."
Puis il a ajouté: "Nous soutenons l'armée et cet incident ne nous a pas embarrassé, puisque l'armée a réagit d'une manière responsable et à son tour la résistance a pris une position positive en se mettant à la disposition de la justice et en remettant le coupable aux autorités compétentes ».

Sehnaoui a estimé que si « nous avions nommé le commandant en chef de l'armée depuis un mois, nous aurions pu éviter le deuil de Tannourine et nous aurions proclamé notre joie à Sarba ».
Nicolas Sehnaoui, a affirmé que le nouveau commandant en chef de l'armée a été nommé à cause de son mérite et de sa compétence militaire, et le CPL n'est pas intervenu dans cette nomination conformément au souhait et à l'appel du général Michel Aoun.

Sehanoui a exprimé le souhait de voir un jour l'institution militaire et l'institution judiciaire choisir eux-mêmes leur chef et non attendre leur nomination par les politiciens.

Sehnaoui a poursuivi: "Tant que nous sommes devant des menaces d'agressions israélienne, un voisin avec lequel nous n'avons pas encore normalisé les relations et des refugiés palestiniens sur notre terre, il convient de souligner que tous les partenaires de la nation ont un rôle clé dans les décisions essentielles qui concernent l'avenir du pays."

Quant aux récents événements de Tripoli, Sehnaoui a estimé que "les événements de Tripoli reflètent la paralysie inadmissible de l'Etat et de ses institutions,", puis il a ajouté : "l'armée n'a pas fonctionné comme elle aurait dû le faire puisqu'elle manque de couverture politique». De même, il a mis l'accent sur le fait que "l'armée et les FSI doivent maitriser la situation à tout prix dans l'intérêt des citoyens et des civils innocents. "

Sehnaoui a renouvelé l'appel à "neutraliser le Liban devant la politique des axes et des intérêts extérieurs."

De la tournée du chef du CPL au Liban-Sud, dimanche, on retiendra sans doute beaucoup de choses, mais c’est surtout l’émotion du général Aoun, qui avait le plus souvent les yeux brillants de larmes contenues, qui reste dans les mémoires, relève-t-on dans les milieux de l’opposition. L’émotion des habitants du Sud, chrétiens et musulmans, qui, depuis des années, n’ont droit – et encore ! – qu’à la visite de leurs députés, ou d’un leader chiite, était aussi remarquable et a marqué cette tournée aux étapes bien étudiées pour constituer, chacune, un message politique. Il y a eu ainsi le premier arrêt à Cana, qui reste le symbole de la tragédie vécue par la population civile du Sud depuis la première invasion israélienne en 1978, une tragédie jalonnée de massacres dont deux ont été perpétrés dans ce village, à dix ans d’intervalle, en 1996 et en 2006. Il y a eu ensuite la pause de Rmeich et le message adressé « à ceux qui cherchent à s’approprier l’armée, sa cause et ses sacrifices ». Ce message rappelle d’ailleurs que le général François el-Hajj avait été l’un des premiers officiers à refuser de coopérer avec les Israéliens... Ce fut ensuite la cérémonie de Bint-Jbeil, fief du Hezbollah, au cours de laquelle le général Aoun a pris la parole là où seul Hassan Nasrallah avait déjà eu l’occasion de prononcer « le discours de la libération » et enfin, la longue station à Jezzine, pour la dimension chrétienne de cette tournée tout en symboles, après l’escale de Nabatiyeh et l’hommage rendu aux résistants.

Cette visite du chef du CPL au Sud intervient d’ailleurs à un moment où les responsables israéliens multiplient les menaces contre le Liban et elle se veut, avant tout, un message d’espoir à une population qui n’en finit plus de vivre dans la précarité. Elle est donc empreinte d’une volonté de rassurer les habitants et de leur affirmer que si le danger existe toujours, il n’est pas, aujourd’hui, plus terrible qu’avant.

Pour les sources proches de l’opposition, elle s’inscrit aussi dans le prolongement du document d’entente signé entre le CPL et le Hezbollah. Elle vise donc essentiellement, selon elles, à montrer aux sceptiques que ce document n’est pas seulement un accord politique. Il constitue aussi, surtout, une entente entre des composantes essentielles de la société libanaise, qui ont assimilé le fait qu’elles ont un destin et un avenir communs. Côte à côte, chrétiens et musulmans ont accueilli le général Aoun et la délégation qui l’accompagne. Côte à côte, ils ont vibré en écoutant les mêmes discours, applaudi aux mêmes phrases, exprimant ainsi une harmonie profonde qui dépasse les différences confessionnelles et communautaires. Critiqué, attaqué depuis sa signature en février 2006, ce document est donc, malgré tout, devenu une réalité incontournable sur le terrain. Tel est, en tout cas, le message qu’a voulu délivrer Aoun, à partir des localités du Sud.

Les milieux proches de l’opposition précisent ensuite qu’en se rendant au Sud et en s’arrêtant dans plusieurs lieux qui ont marqué la mémoire des Libanais, Aoun a revêtu plusieurs casquettes : celle du militaire, qui a voulu évaluer l’importance de ce qui a été accompli en juillet et août 2006, celle du leader national qui prône l’unité autour d’une même cause et enfin, celle du chrétien, convaincu du rôle pionnier de sa communauté. Il y a aussi, ajoutent les mêmes milieux, celle du résistant qui ne peut que rendre hommage au courage de ceux qui sont tombés en défendant leur terre. Dans ce contexte, Aoun a d’ailleurs envoyé deux messages. Il a pressé les habitants de ne pas quitter leurs villages, évoquant, à Jezzine notamment, la vente de terrains, et il leur a demandé d’exprimer librement leurs opinions politiques. « Je ne vous demande pas de voter pour le CPL, a-t-il déclaré à Jezzine. Mais ne vous laissez pas influencer par l’argent... »

Les adversaires du général Aoun s’empresseront de qualifier cette tournée d’électorale, mais ce serait une démarche réductrice, affirment les sources proches de l’opposition. Les élections sont prévues en mai prochain, et d’ici là, beaucoup d’eau aura coulé sous les ponts et de nombreux événements pourraient se produire...Ce qui compte, c’est que les habitants du Sud, et en particulier les chrétiens, ont été, une fois n’est pas coutume, pris en considération. C’est une première depuis les années de guerre, lorsqu’ils étaient totalement marginalisés, une partie ayant coopéré avec Israël et l’autre n’osant pas réellement se manifester. C’est en quelque sorte « la normalisation » de la situation au Sud qui ressort de cette tournée.

Michel Aoun avait promis qu’il se rendrait au Sud à la première occasion et le Hezbollah ainsi que le mouvement Amal ont saisi cette occasion pour montrer qu’ils sont des alliés fiables.

Appui à la Résistance, droit d’expression pour toutes les composantes de la société libanaise, entente entre chrétiens et chiites, les thèmes n’étaient donc pas nouveaux. Mais c’est le contexte qui l’était, apportant au général Aoun la tribune dont il rêvait depuis des années, lorsqu’il servait encore en tant qu’officier le long de la frontière avec Israël. Ses détracteurs n’y auront vu sans doute qu’une maladresse de plus, une nouvelle preuve de « sa récupération par le Hezbollah » ou, du moins, une manœuvre électorale. Mais pour ceux qui ont accueilli le chef du CPL, c’était avant tout un rendez-vous avec le reste du pays...

C’est un véritable « retour aux sources » – comme il l’a dit lui-même de Jezzine, le village de ses ancêtres – que le chef du Courant patriotique libre (CPL), Michel Aoun, a effectué hier à travers sa tournée au Liban-Sud.
Le parcours du général Aoun était à la fois chargé d’émotion, puisqu’il s’agit de son premier déplacement au Sud depuis plus de trente ans, et de sens, dans la mesure où il a parfaitement traduit, à un an des législatives, le positionnement stratégique du CPL sur le plan politique dans toutes ses dimensions et ses thématiques, c’est-à-dire, dans le désordre : le soutien à la Résistance et au maintien de ses armes, l’alliance avec le Hezbollah, la fidélité aux martyrs, la loyauté à l’armée, et les droits des chrétiens. Un parcours ponctué, à chaque étape, d’un accueil populaire de la part de ses partisans et des habitants des villages de la région.

Les martyrs de Cana
Accompagné de son gendre, le ministre des Télécoms Gebran Bassil, du vice-président du Conseil, Issam Abou Jamra, du député Nabil Nicolas et d’un groupe de responsables du CPL, Michel Aoun a débuté sa tournée au Sud par la visite toute symbolique du village de Cana, qui porte les stigmates indélébiles du massacre perpétré par Israël en 1996, et renouvelé en 2006 durant la guerre de juillet.
Le chef du CPL a été accueilli au village par les députés Abdel Magid el-Saleh et Hassan Hobballah, et du responsable du Hezbollah au Liban-Sud, cheikh Nabil Kaouk. C’est d’ailleurs au côté de ce dernier que le général Aoun a déposé une couronne de fleurs sur la tombe des martyrs du massacre de 2006, peu après avoir visité le musée consacré aux martyrs du premier massacre de 1996.
Après avoir déposé la gerbe sur la tombe des jeunes victimes innocentes du dernier massacre, le député du Kesrouan a affirmé : « Ce sont d’ordinaire les enfants et les petits-enfants qui suivent le cortège funèbre de leurs parents et ancêtres. Cana a vécu deux fois le drame d’enterrer ses enfants et petits-enfants. » Il a exprimé à l’occasion son sentiment de « tristesse » et de « colère » : la tristesse « de pleurer la perte des martyrs », et la colère « de la révolte contre les bastions de la répression et de la tyrannie ».

À Rmeich, le souvenir de François el-Hajj
Michel Aoun s’est ensuite rendu dans le village chrétien de Rmeich, à la frontière, où il a assisté à l’office dominical en l’église de la Transfiguration. Mais Rmeich était surtout l’occasion pour l’ancien commandant en chef de l’armée d’exprimer sa fidélité à l’armée et au souvenir du chef des opérations militaires de la troupe, le général François el-Hajj, assassiné en décembre dernier dans un attentat à la voiture piégée. Aussi a-t-il déposé une couronne de fleurs sur la tombe du général Hajj.

Prenant la parole à cette occasion, le général Aoun a rendu un vibrant hommage au général-martyr : « C’était un frère, qui m’a accompagné dans mes moments les plus durs. Il a passé toute sa vie à défendre le Liban. Et voilà que nous entendons aujourd’hui des voix qui portent atteinte à François et ses compagnons. » « Le sang de nos martyrs s’est mêlé, entre la Résistance et l’armée, pour nous donner la souveraineté et l’indépendance », a-t-il ajouté.

Bint Jbeil et l’alliance avec le Hezbollah

C’est en allié indéfectible et en symbole national que le général Aoun a ensuite été reçu à Bint Jbeil, bastion de la résistance à Israël et fortin du Hezbollah, où ce dernier a réservé un véritable accueil populaire au chef du CPL, en présence du député d’Amal, Ali Bazzi, et du député du Hezbollah, Hassan Fadlallah. Bint Jbeil, une étape marquée essentiellement par la volonté du Hezb et du CPL de mettre en évidence la solidité de leur alliance.
Le député Bazzi a rendu hommage au général Aoun qui a « transcendé les communautés et brisé le mur de la peur », évoquant « les exploits et les sacrifices de l’ancien Premier ministre pour préserver ses principes et ses constantes ». Il a mis l’accent sur l’incontournable convivialité pour conspuer la discorde, la vindicte, le despotisme et le communautarisme.
De son côté, le député Hassan Fadlallah n’a pas tari d’éloges à l’égard du général Aoun dans son intervention, dans un style particulièrement imagé et lyrique. Mais il a surtout rendu hommage à l’homme de principes, rappelant que bien avant le document d’entente avec le Hezbollah, et durant son exil parisien, le général Aoun avait affirmé qu’en cas d’attaque contre le Hezb de la part d’Israël et des États-Unis, il se tiendrait de toute évidence au côté de son pays et du Hezb. Évoquant ensuite la victoire du Hezbollah contre Israël à l’issue de la guerre de juillet, Hassan Fadlallah s’est adressé à Michel Aoun : « Vous êtes partenaire dans cette victoire. À l’heure où les braves ici écrivaient les épopées les plus magnifiques, vous vous êtes illustrés par votre constance, vous étiez le partenaire de la Résistance malgré toutes les pressions qui ont été exercées sur vous. » Il a enfin rendu un vibrant hommage au document d’entente qui « consacre le principe du partenariat national » et qui permet « l’édification de l’État capable, fort et juste ».
Pour sa part, le général Aoun a appelé les Libanais, « à la veille des prochaines échéances, à choisir les détenteurs de la parole juste et à ne pas proroger le mandat d’un État qui a été à la base de l’effondrement de notre économie, de notre sécurité et de toutes les composantes de notre résistance sociale ». « L’entente avec le Hezbollah n’est que le début du chemin », a-t-il dit, s’élevant contre la réaction de la communauté sunnite qui, la semaine dernière, a rejeté l’entente entre le Hezbollah et le groupe salafiste, « un accord de reconnaissance de l’autre pour empêcher les combats fratricides, et qui a suscité la condamnation de certains ». « Cette condamnation, nous ne pouvons pas la comprendre », a-t-il souligné. Il a par ailleurs prôné la complémentarité entre le peuple, l’armée et la Résistance dans le cadre de la stratégie de défense du pays.

Maroun el-Rass et le soutien à la Résistance

Le général Aoun a ensuite choisi, en signe de soutien à la Résistance, de visiter le village de Maroun el-Rass, à la frontière, resté célèbre pour la fameuse bataille qui permit, durant la guerre de juillet, aux forces d’élites du Hezbollah de stopper l’avancée des chars israéliens. L’occasion pour le chef du CPL de rencontrer des officiers du Hezbollah, qui lui ont fait le récit de la bataille.
Le général Aoun a ensuite été invité à déjeuner par le Hezbollah à Tiri, au restaurant Family Park, en présence de cheikh Kaouk, qui lui a remis un écusson commémoratif de la Résistance et une boîte à caractère archéologique contenant des bombes à fragmentations israéliennes démontées par le Hezbollah.

Nabatiyeh et Imad Moghniyé
C’est sous les applaudissements que le convoi du général a ensuite été accueilli à Nabatiyeh, sous les portraits gigantesques érigés à la gloire de Imad Moghniyé. Le chef du CPL a été reçu par le député Hassan Fadlallah et le responsable de l’unité de liaison et de coordination au sein du Hezbollah, Wafic Safa. L’occasion de visiter une exposition organisée par le Hezb en hommage à Imad Moghniyé, qui met en valeur certains aspects de la personnalité du responsable sécuritaire du Hezbollah assassiné en février dernier, ainsi que des véhicules et des chars israéliens capturés par les combattants du Hezb en 2006.
Selon le reporter de l’ANI, le général Aoun « a paru ému » devant la pièce de l’exposition qui contient le bureau de Moghniyé, ses armes et ses effets personnels (les habits qu’il portait quand il a été assassiné, son tapis de prière, etc.).
Après avoir vu des missiles utilisés par le Hezb durant la guerre de juillet et qui sont exposés pour la première fois, le général s’est adressé aux journalistes pour dire : « Je vois des armes qui ont été utilisées lorsqu’il le fallait, pour combattre l’ennemi et libérer le territoire, contrairement à toutes les armes qui ont été utilisées pour les combats fratricides et qui ont tué beaucoup de Libanais. » Il a souligné que les armes devaient être dirigées contre l’ennemi, et non dans le cadre d’un conflit interne.
Michel Aoun a ensuite rédigé un petit mot pour le livre d’or du musée, affirmant avoir « vécu un jour extraordinaire avec les martyrs héroïques et leurs histoires, qui sont notre histoire et qui nous apprennent ce que doivent être les générations futures ».

Le retour à Jezzine

Mais le point culminant de la visite du général Aoun a été sans conteste son retour à Jezzine, où un accueil populaire et partisan lui a été réservé à la place centrale du village. Le chef du CPL a paru particulièrement ému de retourner au village d’origine de ses ancêtres, et il a pratiquement été obligé de se livrer à un bain de foule avant de pouvoir s’asseoir. Le ministre Gebran Bassil, le vice-président du Conseil Issam Abou Jamra et les députés Samir Azar, Pierre Serhal, Antoine Khoury, Sélim Aoun, Nabil Nicolas et Hassan Hobballah étaient parmi les présents.
Après une série d’allocutions d’introduction, notamment de l’ancien responsable kataëb Rachad Salamé, du chef de la fédération des municipalités de Jezzine, et du responsable CPL du village, Ziad Assouad, le général Aoun a enfin pris la parole devant une assistance conquise.
Dans son allocution, il a d’abord exprimé sa joie de revenir à Jezzine, évoquant tous les malheurs subis par ce village « conquis par quelque cinq armées différentes » durant les dernières années. Il a ensuite exhorté les habitants à revenir au village, à rester attachés à leur terre et à ne pas se livrer à la vente de leurs terrains « convoités dans le cadre des luttes régionales ». « Une nation sans territoire et sans peuple n’est plus une nation, a-t-il souligné. Or il y a beaucoup de marchands et la terre de Jezzine est très convoitée », a-t-il noté.
Il a ensuite évoqué le retour des Libanais réfugiés en Israël, faisant le plaidoyer de l’entente avec le Hezbollah et reprochant « aux responsables irresponsables » d’avoir empêché son application durant ces deux dernières années, ce qui a retardé le règlement de ce dossier, qui devrait toutefois être clos bientôt, a-t-il promis.
Évoquant enfin les prochaines échéances, le général Aoun s’est lancé dans une attaque en règle contre la majorité, sans la nommer. « Vous êtes libres de voter comme vous le voulez, mais prenez garde aux maladies dont souffre la société libanaise. Il ne faut plus s’allier ou soutenir certaines lignes politiques aujourd’hui. Aucun Libanais qui reconnaît son identité et ses frontières ne doit coopérer avec des lignes politiques qui ne reconnaissent ni l’identité libanaise ni les frontières de la nation libanaise, a-t-il indiqué. Si nous voulons préserver notre nation et notre identité, nous devons savoir que les élections ne sont pas une opération électorale seulement, mais une confiance octroyée pour quatre ans », a-t-il poursuivi. Et de souligner : « Il faut prendre garde, le Liban fait face à une vague qui ne vous reconnaît pas, et qui ne reconnaît qu’elle-même. Je ne sais pas si nous sommes réellement conscients de ses effets négatifs. Imaginez-vous que la semaine dernière, deux groupes libanais se sont mis d’accord sur le fait de ne pas s’entre-tuer. Puis, ils les ont obligés à rejeter cette entente, en les encourageant à s’entre-tuer et en leur affirmant que cette ligne politique leur est interdite... »
Le général Aoun a ensuite participé à un dîner organisé en son honneur à Jezzine avant de reprendre la route du Metn.

School has again been blistering. I kinda hit a brick wall on Thursdays after 4 hours of day class and 4 hours of night class every day. I shit you not but I actually become slightly dyslexic when trying to copy stuff down. And when I try and plot something from Durban, I end up tracking everything I need to but from Cape Town or some other place equally stupid. That is a real pain in the ass and extremely time consuming. Fortunately I do know what I'm doing but I just have to concentrate even harder not to make the stupid mistakes. That however makes me even more brain tired which causes me to make more mistakes. See the cycle? And by the time I get home I am so wired and on edge that I cant sleep until 4am and I'm up again at 7 for day class. The vicious circle tightens! Fortunately tonight is officially the last night class. There are just two informal roll over nights late next week. Ahhhhhhhh REST. Oh and time to study to prepare for exams! Fun Fun Fun

This weekend however is going to be spent  doing as much relaxing stuff as possible. That sounds odd. Force myself to relax. YOU WILL RELAX AND HAVE FUN OK!!!

I'm going back to my mate in the North (of JHB) tonight. He is having a braai (BBQ). Then tomorrow I will most likely catch up with a sweet dear friend of mine and on Sunday, hopefully if it's a good day, get a bunch of people together and have a kewl lunch out at Hartebeespoort Dam.

Comme à leur accoutumée, les députés du Bloc du Changement de la Réforme ont eu lundi leur réunion hebdomadaire. Et comme d'habitude, à l'issue de la réunion, le chef du BCR, le Général Michel Aoun a pointé du doigt les dysfonctionnements actuels montrant ainsi que le "politiquement correct" ou "langue de bois" et le "consensuel mou" n'auront plus cours avec la présence des députés du BCR. Evidemment, les propos tenus ne peuvent que déranger une certaine classe politique plus habituée par le suivisme que par le changement et la réforme, plus préoccupée par le clientélisme et leurs intérêts personnels que par la participation et l'intérêt public.

Le système actuel au liban est le système communautaire. Ce système doit être modifié en profondeur pour aboutir à un système laïc garantissant les droits égalitaires pour tous. Mais en attendant ce système, il est important de respecter les droits de chaque communauté au sein de ce système. Ce n'est que lorsqu'aucune communauté ne se sentira en danger ou exclue de l'Etat que le système pourra être réformé avec la participation de tous. Evidemment, les forces conservatrices corrompues existent au sein de chaque communauté et le changement et la réforme ne seront pas chose aisée.

Le système communautaire au Liban a réparti les différents postes politiques au Liban entre les différentes communautés. Ainsi, si le président de la République est maronite, le Premier ministre sunnite et le président du parlement chiite, le poste de vice-président du Conseil est attribué à un grec-orthodoxe. De plus, dans la composition du gouvernement d'union nationale, ce poste est revenu à l'opposition, en la personne du Général issam Abou Jamra.

"Le Sérail est devenu l'hôtel privé du Premier ministre"

Il n'en fallait pas plus pour que Siniora, qui considère le Sérail comme sa propriété privée (où fêtes, mariage et offices religieux ont lieu régulièrement), refuse la demande du vice-premier ministre, Issam Abou Jamra, d'avoir un bureau ou un secrétriat pour participer pleinement au fonctionnement du gouvernement..

« Ils ont dit qu’ils allaient lui trouver un bureau à l’extérieur du Sérail. Le Sérail est un grand hôtel où sont organisés des réceptions et des mariages. Un hôtel privé, comme on les appelle en France. Mais même les hôtels privés ont des ailes spéciales pour les invités. Cela est inacceptable », a ironisé le Génral Aoun. Il a rappelé qu’en 1972, lorsque Saëb Salam avait été se faire opérer en Suisse, c’est Albert Moukheiber, alors vice-président du Conseil, qui l’avait remplacé durant trois mois.

En réponse à la demande du général Michel Aoun, le député Farid Habib, membre des Forces Libanaises, estime que ce que le bloc du 8 mars n'a pu obtenir en temps de guerre, il ne pourra l'avoir en temps de paix. Habib rajoute : «  Le Sérail est comme une forteresse, et nous ne laisserons pas les forces du mal y pénétrer. Si Abou Jamra veut se maintenir au Sérail, qu’il se joigne au bloc du 14 mars ».

Toni Nasrallah, responsable du comité d'information du courant patriotique libre, répond à la critique faite par le député Farid Habib, membre des Forces Libanaises, concernant la demande du général Aoun : « Je suis désolé de constater que le député Habib se prépare pour la guerre alors que les gens en reviennent ».

Nasrallah (entretien accordé à Elnashra.com) assure : « Le Sérail est une propriété publique et n'est pas exclusif au bloc du 14 mars. »

« La demande du général Michel Aoun et de Issam Abou Jamra, le vice premier ministre, sont légales et nécessaires pour le bon fonctionnement des institutions gouvernementales ; et qu'au lieu que Habib se soit perdu dans ses critiques, il aurait mieux fait de prendre soin de la communauté orthodoxe », rajoute Nasrallah.

Dans une déclaration à "Elnashra.com", Abou-Jamra a regretté que le député orthodoxe et Forces Libanaises, Farid Habib, traite avec tellement de légèreté un problème de cette importance, dont la résolution pourrait conduire à l'établissement d'un vrai partenariat au pouvoir. Il a répondu aux commentaires qu'il a qualifiés de "prétentieux" concernant "les prérogatives du vice-Premier ministre et son siège au Grand Sérail", estimant que "le décret de formation du gouvernement 17/2008 basé sur l'article 53 de la Constitution stipule clairement que doit être réalisé ce qui est prévu par cet article, l'occupant du poste étant de la majorité ou de l'opposition."

Quant à Tamam Salam , le ministre de la culture, il répond au général Michel Aoun: " Toutes les séances ministérielles avant 1989 étaient présidées par le président de la république , le premier ministre et le vice premier ministre Albert Moukhayber n'assistaient pas aux séances. Avec un respect pour Moukhayber , mais il n'a pas assumé ses responsabilités durant trois mois".

Le vice-Premier ministre , Abou-Jamra, a conseillé au ministre de la Culture, Tammam Salam, de se référer au magazine "Al-Joumhour" (num. 945 de 1972) pour apprendre que feu l'ancien vice-Premier ministre Albert Moukhayber présidait en effet des réunions du conseil des ministres.

Le député Camille Khoury, membre du bloc du changement et de la réforme, a ajouté que la présidence de Moukhayber est un fait indéniable, estimant qu'il est inacceptable que l'Histoire soit fasifiée pour des intérêts personnels. Le député a ajouté que l'ancien ministre Elias Saba a lui aussi présidé un des gouvernements du feu Premier ministre Saëb Salam.

Quant au député Ghassan Moukhayber, il a invité Tamam Salam à revenir aux principes constitutionnels et à consulter les archives de l'époque.

Issam Fares, l'ancien vice-Premier ministre, a salué les récentes revendications soulevées par le général Michel Aoun, chef du bloc du changement et de la réforme concernant la clarification des prérogatives du vice-Premier ministre. Fares a estimé que si un tel poste existe au sein de l'Etat, la personne qui l'occupe doit en connaître les prérogatives, ajoutant que si c'est un poste "honorifique", il faudrait que cela se sache.

Sur un autre plan, Fares a appelé à ce que ces prérogatives soient déterminées par une loi ou un décret spécial issu du conseil des ministres, estimant que si ce poste est du droit de la communauté grecque-orthodoxe, il est important qu'il soit lié à une fonction donnée.

Fares a d'autre part appelé le Premier ministre Fouad Siniora à établir un bureau près du sien pour le vice-Premier ministre pour tenter, ce faisant, de dissiper le "mystère" entourant le poste en question.

Elnashra.com a rapporté en exclusivité que des pôles orthodoxes se préparent à tenir une réunion élargie se tiendra prochainement relative au rétablissement des prérogatives et des droits du vice-Premier ministre.

Two of the names (KAUSHIK & SHIVANI) were a fish trapper for Prince and Renny, they earned a lot by catching innocent students from India and elsewhere and made false promises even when the school was in the brink of extinction, they even said the student’s it was a summer vacation and they would receive a new laptop from the school when it reopens, and the third name (DEEPAK MAHALA) is a great and renowned person in ASA, an alcoholic and a drugs addict who was and is a hired mercenary for Prince and Renny to threaten the students from time to time. A few number of such cases are also registered against him in the Merced county. And about JIM I have no clue why is he still ******** Prince and Renny’s ***, probably he wants some multi hours so he even wants to triple his multi hours on the Dutchees as he was turned down from Cal Air for not meeting his multi requirements for an multi instructor post. They know it very well that with the current status they can complete their requirements but cannot go on with a check ride, so the next thing they will do is to get an I-20 of a school, get new TSA’s and complete their check ride. And probably they will seek a school which is far away from here, may be Arizona, Texas or elsewhere so that their records cannot be traced.

I have full support for the students of ASA who have suffered such heavy losses, and I am getting other people to help them but my sincere request will also be that all the students and the people who are in support should stand up and stop these kind of mean minded people to get away easily, they dont have any sympathy towards the suffered students, they only know their business, they can dance on their own ones graves for getting their work done. As per my information I have the news where these students are going to get their admissions for their check ride, and I will work seriously to see that I can update the concerned school regarding the matter so that they can not escape.

In Re: American School of Aviation

Dear Messrs Murray and Lehman:

In the FAA Aircraft Registry records, there appears to exist conflicting records that are likely to constitute a violation in compliance with the statutory requirement relating to civil aircraft registry in the US.

Synopsis:
American School of Aviation, Inc. is a California corporation with its president and other corporate officer(s) are not U.S. citizen.

Title 14 CFR Part 47 of the Federal Aviation Regulations (FAR) governs the requirement related to the civil aircraft registration in the US

Part 47.3 stipulates Registration required.
Part 47.5 defines Applicants.
Part 47.7 defines U.S. citizens and resident aliens with respect to civil aircraft registration.
Part 47.9 defines “Corporations not U.S. citizen”.
Part 47.9 (f) stipulates thrice annual report requirement by the registrant to the FAA.

Analysis:
All ASA aircraft except one (30 before 8/04/08 down to 11 as of 8/14/2008 ) are currently registered under FAR Part 47.7 and issued aircraft registration certificate bearing “Corporation” instead of its true and factual status of its corporate entity as “Foreign Corporation”. In the FAA AC Form 8050-1 Aircraft Registration Application, there is a specific box to be checked off for Non-citizen Corporation and provided along with “Certification” section for the applicant’s certification for a non-citizen corporation. If these sections were properly completed in the ASA aircraft registration application, all of its registration then should have been issued under Part 47.9 with the respective registration certificate bearing ”Foreign corporation”

Conclusion:
If ASA has made erroneous entry in its aircraft registration application and submitted to the FAA Aircraft Registry knowingly or not knowingly and obtained its registration certificate, then the ASA aircraft are not registered under Part 47.9 and not in compliance with Part 47.9(f) requirement. This ipso facto invalidates all of its registrations under FAR 47.41(a) ( 8 ) (ii) and requires ASA to surrender all of its invalidated registration certificate immediately in accordance with FAR 47.43 (b).

One of the school owners had publicly stated their school received 109 surveillance visits from your office in 2007, yet why this blatant aircraft registration violation eluded the filed inspectors scrutiny is beyond me.

There exists an ample evidence based on flight activities taking place recently at Hayward, Modesto and elsewhere to indicate the school is still operating under the guise of new satellite base after its 141 school certification has been long presumed to be suspended if not revoked already.

In view of the matter affecting the welfare and interests of all those victimized students as well as that of local aviation community, it would be most appropriate that your office offers a public announcement in connection with the ASA matter as soon as aircraft registration investigation is completed.

All eyes are on your prudent and swift enforcement action.

As suspected by one of the Ex-ASA students who posted earlier, all indications are now clearly pointing to the high probability that the remnants of ASA made up of few former ASA CFIs and a group of students hand picked by Prince and Reny have been flying out of Hayward and Modesto and elsewhere.

The two of the above aircraft (N757XY and N7774T) are among the 19 aircraft that changed hands recently.

Apparently sale/lease back or sale/payment by use type arrangement is allowing them to keep possession of some of the aircraft sold and continue to use them for those clandestine training flights.

I am following up on my open letter of 7/30/2008 addressed to you subsequent to SABA’s announcement to come to aid for the ASA students stranded in Atwater upon its sudden closure in June 2008.

Have you received a reply since from the DA’s office in response to your earlier request then made?

So, what sort of progress has been made and continue to be made at SABA to help those former ASA students in distress?

Why no SABA initiative so far for assisting the victimized students to file an individual or consolidated crime report with the sheriff’s department, the first step necessary for a criminal prosecution from the victim’s end?

Do you really believe in your trained legal professional mind that the ASA students qualify for a “U” visa with an employment authorization that I believe you’re referring to in your earlier statement? If not, please explain.

What makes you believe the “U” visa relief will work in this situation despite seemingly clear cut eligibility requirement that precludes the former ASA students?

Has anyone ever filed a crime report so far against Prince and Reny for a criminal fraud and received a crime reference number (CRN ) assigned by the sheriff’s department?………………….didn’t think so.

Over 100 students were wronged, yet no victims officially exist as far as the sheriff’s department is concerned because no crime report was filed.

Ignorance and assumptions are all too often dangerous.

No wonder this isn’t getting any traction. Much to my surprise, there seems to be no crime report against Prince and Reny has ever been filed with Merced County Sheriff’s Department by any former ASA student. Only one filed so far appears to be the fuel supplier who was reported to be owed $56,000 unpaid fuel.

Now onto your case, no matter how bad you want the duo to be put behind bars, just hoping and thinking doesn’t make it so. This is probably what’s transpiring: No criminal report filed→no criminal victim→no criminal charge brought forward That pretty much explains it. You all need to do what it takes by methodically following the established judicial procedures step by step. Here is what you need to do:

1. Go to Merced County Sheriff’s Department and get a Criminal Report Form http://www.mercedsheriff.com/
(If they don’t have the forms available get an instruction on how to prepare or better yet get a sample copy)

2. Contact SABA and ask one of their lawyers to help preparing a crime report
3. When it’s ready, take it to the Sheriff’s Department and file it.
4. Get a crime reference number (CRN ) assigned to your case (this is used for follow up and status check)
5. Tell everyone to do the same, more the better to place the case in a higher priority.
6. Follow up on the status using your CRN
7. Report on this blog from time to time to keep everyone posted until the justice is done.

American School of Aviation,  already besought with civil lawsuits, could become the subject of a criminal probe led by the Federal Bureau of Investigation.

Merced County District Attorney Larry Morse II has asked the FBI to take a role into the investigation of the American School of Aviation. Morse said the district attorney's office needs the FBI's assistance in performing forensic accounting to discover if crimes were committed by Manpreet "Prince" Singh and his wife Reny Kozman, who co-owned the flight school along with partners in India.

"There are a variety of issues involving potential criminal fraud arising from the situation," Morse wrote in the letter sent to the FBI.

As a matter of course, the FBI will not confirm if they are involved in a criminal investigation.

The students' tuition fees were supposed to be kept in a trust account and charged as the students progressed through their flight training. A lawsuit filed by 52 of the students in July alleges that Singh directed the tuition directly into his own accounts. It accuses him of fraud, breach of contract and misrepresentation. Among the allegations made against the school and Singh is that they continued to recruit students despite knowing they could not provide the instruction as promised.

The students are seeking $2.2 million in refunds and punitive damages. The lawsuit was filed with the Merced County Superior Court, but the papers have not been served upon Singh because he hasn't been located, according to attorney Palvir Shoker, who filed the lawsuit on behalf of the students.

A second set of 10 students has filed a similar lawsuit and is seeking $200,000. The lawsuit was filed by attorney Jeffrey Poindexter and claims that the students were directed to a fake ASA Web site where they could ostensibly keep track of how their tuition funds were being deducted. The complaints states: "This accounting system was set up to deceive and mislead the students. As soon as the students would make a tuition payment of $40,000, the defendants would spend all of the money. This allegation is premised upon the fact that the defendants have conceded they owe the refunds, but claim they have no money to pay the refunds...

"By immediately spending the entirety of a student's tuition, without providing the promised flight training and education, the defendants either purposefully, recklessly or negligently began operating as a sort of ponzi scheme. Each new student's tuition would go to pay the costs and expense of earlier enrolled students."

Reny Kozman has previously blamed the school's financial hardships on partners based in India, who she says stole the school's money in her email to SecondCity last month.

What occurred or reported to have occurred at ASA

1. It (ASA) failed to deliver flight training to its students as per the agreement
2. It failed to refund the unused tuition to the students when requested.
3. It operated in violation of numerous Federal, State and local regulations.
4. They (Prince & Reny; owners) lacked moral, professional and business fitness to run a fight school.
5. They defrauded students.
6. They defrauded local merchants.
7. They defrauded local governments
8. They defrauded federal government
9. They endangered the health and welfare of the students and their parents home.

Applicable California State Penal Code
□§154 Debtor fraudulently removing, conveying, or concealing property;

Every debtor who fraudulently removes his property or effects out of this state, or fraudulently sells, conveys, assigns or conceals his property with intent to defraud, hinder or delay his creditors of their rights,
claims or demands, is punishable by imprisonment in the county jail not exceeding one year, or by fine not more than one thousand dollars ($1,000), or by both; provided, however, that where the property so removed or sold or conveyed, or assigned or concealed, consists of a stock in trade or a part thereof, of a value exceeding one hundred dollars, the offense shall be a felony and punishable as such.

Any person who willfully, with intent to defraud, makes or draws or utters or delivers any check, draft or order upon any bank or depositary, or person, or firm, or corporation, for the payment of money, knowing at the time of such making, drawing, uttering, or delivering that the maker or drawer or the corporation has not sufficient funds in, or credit with said bank or depositary for the payment of such check upon such funds then outstanding, in

□§484b. Diversion of funds received to obtain or pay for services, labor, materials or equipment

Any person who receives money for the purpose of obtaining services and wrongfully diverts the funds to a use other than that for which the funds were received, shall be guilty of a public offense and shall be punishable by a fine not exceeding ten thousand dollars ($10,000) or by imprisonment in the state prison, or in the county jail not exceeding one year, or by both such fine and such imprisonment.

□§532 False pretenses; obtaining money, labor, or property; punishment

Every person who knowingly and designedly, by any false or fraudulent representation or pretense, defrauds any other person of money, labor, or property, whether real or personal, is punishable in the same manner and to the same extent as for larceny of the money or property so obtained.

□§537 Defrauding innkeepers, etc.

Any person who obtains any accommodations at apartment house, without paying therefore, with intent to defraud the proprietor or manager thereof, is guilty of a public offense punishable by imprisonment in the county jail for a term not more than one year, or in the state prison.

Now those are just few of the state penal codes that I came up with for the moment and by doing a little research on my own (I can’t afford a $250/hr lawyer for reading the same law books).

I haven ‘t touched in the areas of possible Federal statutes violation yet, here’re some of the applicable codes under the Title 18 of USC –Crimes and Criminal Procedures that could well apply to the ASA case on the Federal offense side for the feds to pursue.

Most of the above offenses if not all are felony offences each carrying one or more years of imprisonment if convicted. In the ASA case, if the DA is successful in achieving even one criminal conviction, that will land over 100 years in jail time for those convicted. (each one count x number of victims/students and you get the figure)

What needed to achieve a conviction requires only two things like everything else in everyone’s life, desire and strong enough intention (will) to carry it out, the rest will follow.

So far all seems to be lacking at both the DA’s office and the Sheriff’s department of Merced County. If they need to bring in an aggressive outside prosecutor, I know the one from the East Coast who’s not so long ago decided to take an unscheduled retirement for some personal reasons . Hint…… last name begins with “S” and his last job was a state governor.
As far as I know he’s still unemployed at present.

In Re: American School of Aviation

Dear Messrs Razin and Morse:

Since the first news appeared in the Merced Sun-Star about a month ago related to the sudden closure of American School of Aviation at Castle Airport, I have been following the matter with my mixed emotion of sympathy and indignation.

From what has been reported by various media, the case appears to have an overwhelming elements of offenses to constitute a criminal fraud, yet no criminal charges have been filed to this day against the unscrupulous school owner(s) much to the public dismay, why?

In the follow up story appearing in the Merced Sun-Star on August 05, 2008, it was reported that the FBI assistance was being sought because your office/department couldn’t handle the forensic accounting needed (emphasis added). Please kindly explain this highfalutin legalese to the public in a layman’s term, and the reason why so.

You have all the evidence and prosecuting authority necessary to file the case right where you’re in the Merced County. Why look elsewhere by somehow suggesting with a specious notion that this is an international case involving foreign nationals and therefore out side of your jurisdiction. Why not proceed on your own without any further indecision irrespective of whether the feds assistance and cooperation on the case is forthcoming or not.

The most recent record of the FAA aircraft registry shows eighteen aircraft formally owned and registered to the debtor defendant changed hands earlier this week. (13 on 8/04, 5 on 8/05) This alone ipso facto constitutes a felony offense under the Penal Code§155.

There seems to exist ample evidence with sufficiency to bring forth criminal charges under but not limited to the following penal codes:

§155 Defendant or judgement debtor fraudulently removing, concealing, or disposing of personal
property sought to be recovered.
§476 (a) Checks, bank drafts insufficient funds; Intent to defraud
§484.b Diversion of funds received to obtain or pay for services, labor, materials or equipment
§532 False pretenses; obtaining money, labor or property
§573 Defrauding innkeepers, etc.

Having stated the above, I have read the following mission statement from the respective offices and while came away quite impressed with the lofty statements, it’s more than apparent that none of the goals stated therein have yet to be fulfilled as far as the American School of Aviation case is concerned.

Here’s your statement, Sheriff Razin.
“Our mission is to provide responsive, professional, and caring law enforcement service to all the people of Merced County. We will respond to call for service promptly, protect lives and property to the best of our abilities, initiate and maintain crime prevention programs, and apprehend criminal offenders.” –Sheriff Mark Razin-

And here’s the one from the DA’s office.
“The mission of the Merced County District Attorney’s Office is to seek justice by ensuring that victim’s rights and the public’s safety are our first priority through the fair, equal, vigorous, and efficient enforcement of the criminal laws.” - Merced County District Attorney’s Office -

It is my sincere hope that the elected high officials of the Merced County such as yourselves live up to the own mission statement for the good of the public without resorting to another “forensic accounting” bit.
