Articolo 71
Assenze per malattia e per permesso retribuito dei dipendenti delle pubbliche amministrazioni
1. Per i periodi di assenza per malattia, di qualunque durata, ai dipendenti delle pubbliche amministrazioni di cui all’articolo 1, comma 2, del decreto legislativo 30 marzo 2001, n. 165, nei primi dieci giorni di assenza e’ corrisposto il trattamento economico fondamentale con esclusione di ogni indennita’ o emolumento, comunque denominati, aventi carattere fisso e continuativo, nonche’ di ogni altro trattamento accessorio. Resta fermo il trattamento piu’ favorevole eventualmente previsto dai contratti collettivi o dalle specifiche normative di settore per le assenze per malattia dovute ad infortunio sul lavoro o a causa di servizio, oppure a ricovero ospedaliero o a day hospital, nonche’ per le assenze relative a patologie gravi che richiedano terapie salvavita. I risparmi derivanti dall’applicazione del presente comma costituiscono economie di bilancio per le amministrazioni dello Stato e concorrono per gli enti diversi dalle amministrazioni statali al miglioramento dei saldi di bilancio. Tali somme non possono essere utilizzate per incrementare i fondi per la contrattazione integrativa.
2. Nell’ipotesi di assenza per malattia protratta per un periodo superiore a dieci giorni, e, in ogni caso, dopo il secondo evento di malattia nell’anno solare l’assenza viene giustificata esclusivamente mediante presentazione di certificazione medica rilasciata da struttura sanitaria pubblica.
3. L’Amministrazione dispone il controllo in ordine alla sussistenza della malattia del dipendente anche nel caso di assenza di un solo giorno, tenuto conto delle esigenze funzionali e organizzative. Le fasce orarie di reperibilita’ del lavoratore, entro le quali devono essere effettuate le visite mediche di controllo, e’ dalle ore 8.00 alle ore 13.00 e dalle ore 14 alle ore 20.00 di tutti i giorni, compresi i non lavorativi e i festivi.
4. La contrattazione collettiva ovvero le specifiche normative di settore, fermi restando i limiti massimi delle assenze per permesso retribuito previsti dalla normativa vigente, definiscono i termini e le modalita’ di fruizione delle stesse, con l’obbligo di stabilire una quantificazione esclusivamente ad ore delle tipologie di permesso retribuito, per le quali la legge, i regolamenti, i contratti collettivi o gli accordi sindacali prevedano una fruizione alternativa in ore o in giorni. Nel caso di fruizione dell’intera giornata lavorativa, l’incidenza dell’assenza sul monte ore a disposizione del dipendente, per ciascuna tipologia, viene computata con riferimento all’orario di lavoro che il medesimo avrebbe dovuto osservare nella giornata di assenza.
5. Le assenze dal servizio dei dipendenti di cui al comma 1 non sono equiparate alla presenza in servizio ai fini della distribuzione delle somme dei fondi per la contrattazione integrativa. Fanno eccezione le assenze per congedo di maternita’, compresa l’interdizione anticipata dal lavoro, e per congedo di paternita’, le assenze dovute alla fruizione di permessi per lutto, per citazione a testimoniare e per l’espletamento delle funzioni di giudice popolare, nonche’ le assenze previste dall’articolo 4, comma 1, della legge 8 marzo 2000, n. 53, e per i soli dipendenti portatori di handicap grave, i permessi di cui all’articolo 33, comma 3, della legge 5 febbraio 1992, n. 104.
6. Le disposizioni del presente articolo costituiscono norme non derogabili dai contratti o accordi collettivi.

La crisis se está acercando, el bolsillo del ciudadano medio ya tiene un nuevo agujero, porque el Banco Central Europeo ha decidido seguir adelante con la subida de los tipos de interés que tenía prevista.

Con esta subida de un cuarto de punto, que deja los tipos en Europa a un 4,25%, se encarecerán todos los préstamos bancarios, lo que incluye créditos, hipotecas... Esto, añadido al progresivo encarecimiento del petróleo y los alimentos, el récord del Euríbor y la caída de las bolsas hace que se justifiquen datos como el de la caída de la confianza de los consumidores en España.

En Estados Unidos se ha optado por el camino contrario: en los últimos ocho meses, la Reserva Federal ha bajado los tipos de interés de forma progresiva con la intención de reactivar el mercado, del 4,75% de hace unos meses hasta el 2% actual.

Hey Everybody! I just wanted to keep u updated on what's happening with "Bags For ZaZa!" Well, first of all, for all you guys who don't know what "Bags For ZaZa" is, it all started with my family deciding to adopt a little girl from Colombia. We didn't know her name yet, and not wanting to call her "The Little Girl" or anything, my Auntie Jennie came up with the name "ZaZa" to call her. And it just stuck.

So, the adoption process continued and wanting to help "Bring ZaZa home!" my Auntie Jennie started sewing bags made out of scraps, left over material, and donated material. The bags started off selling for $25 each but due to high demand, we have started auctioning them off instead. Highest Bidder wins! :D

So, now every Monday morning the 5 new bags go up, and it goes "5 bags for 5 days!"

No more John Hancock for purchases under $25

Consumers can now use Visa debit cards for smaller purchases without entering a personal identification number, the same way they can skip signing receipts.

Visa said Tuesday it is no longer requiring merchants to treat its debit cards differently when customers use them as PIN-debit cards, as opposed to signature cards.

The move prompted the Justice Department to drop an antitrust investigation of the practice.

Visa has allowed banks to permit merchants to waive the signature requirement when customers use Visa debit cards, usually on small purchases below $25, the department said. But Visa has prohibited banks from allowing merchants to waive the entry of a PIN if a customer chooses that route.

Visa said it is ending the prohibition on waiving PINs effective Tuesday.

AJ pins Creed after a Styles Clash.

JB comes out and tells AJ that Kurt Angle is waiting in the parking lot for Karen. AJ runs to the parking lot.

Backstage, security is seperating Kurt Angle from AJ and Karen. AJ says he'll protect Karen Angle.

Brother Ray vs. Christian Cage

Johnny Devine runs in and tries to hit Christian with a kendo stick. Cage catches him and tosses Devine out of the ring. Brother Ray uses the kendo stick on Cage, leading to a disqualification. Ray and Devine beat on Cage. Brother Devon and Tomko bring out a glass topped table. Ray power bombs Cage off the top rope and through the glass table! The heels pose, then leave when the EMTs come out to check on Christian. Eric Young and Kaz come out to check on Christian (a little late, guys). The EMTs place a towel on Christian's back to "soak up the blood". Nice touch.

JB interviews Kevin Nash. Samoa Joe interjects.

The Awesome Kong $25,000 Challenge:

"Danielle" signs up to face Kong. During the match Shantelle Taylor shows up again. Taylor yells at Kong, Kong shoves her. Kong beats the hell out of Danielle until the merciful pin following the Awesome Bomb. Taylor jumps into the ring and brawls with Kong until security seperates them. Jim Cornette tells Taylor that that's not how we do things in TNA. Taylor asks to fight Kong, or Saed, she just wants one more chance. Cornette brings her back to the office so they can talk about it.

TNA Knocked Out profile on Angelina Love.

Frank Trigg comes out and calls out AJ Styles. AJ is backstage with Karen, who is trying to calm him down (and for some reason JB is there). AJ leaves to go after Trigg. AJ gets to the ring, Trigg leaves, and AJ sees what has been happening in the locker room. Backstage, Kurt Angle confronts Karen. He says he won't lay a hand on Karen, but someone else will. The Beautiful People attack Karen and put the paper bag on her.

World X Cup Tournament first round match.

Team International and Team TNA come out to watch the match.

Team Japan - Naruki Doi and Masato Yoshino vs. Team Mexico - Ultimo Guerrero and Rey Bucannero

Rey and Ultimo pin Naruki after Rey jumps off the top rope and hits a top rope corkscrew senton onto Naruki who is placed accross Ultimo's knees.

Sonjay Dutt wants Val to be "set free". Val comes down to the ring to yell at Sonjay. Jay Lethal runs down the ring to brawl with Sonjay until Dutt runs away.

Tomko and Kurt Angle (and JB) talk backstage. Tomko tells Kurt he's gone too far and needs to get over Karen. Team 3D show up and set Kurt up on some blind dates for next week.

Moose hits a double arm DDT onto a chair for the pin.

Kevin Nash vs. Booker T

Booker T pushes over Samoa Joe to take his chair. Booker then hits Joe with that chair. Joe gets up and goes after Booker. Joe is in the ring and attempts to kick Booker, Booker moves and Joe hits Nash instead. Booker tosses Joe out of the ring and pins Nash. Kevin Nash and Samoa Joe have dissension in the ranks.

It can be disappointing when people who are close to us don’t do what we would like for them to do. But if we really love them, we should encourage them to follow the Holy Spirit rather than try to keep us happy all the time.

Help others grow spiritually by encouraging them to listen for God’s voice. Remind them that God will help them through mistakes and lead them to a good life. Soon they will be making Spirit-led, rather than people-led, decisions. It is tremendously gratifying to see loved ones mature spiritually in Christ.

Ayuda a otros a crecer espiritualmente animándolos a escuchar la Voz de Dios. Recuérdales que Dios los ayudará a través de los errores y los conducirá a una buena vida. Pronto serán personas guiadas por El Espíritu, en lugar de ser guiadas por sus propias decisiones. Es enormemente gratificante ver a los seres queridos madurar espiritualmente en Cristo.

Milano 2008: Bruce Springsteen 2.0

25 giugno 2008, San Siro, Milano. E chi l'ha detto che i valori del Web 2.0 si applicano soltanto al Web? The Boss, all'anagrafe Bruce Springsteen, uno dei miti che accompagnano da sempre la nostra esistenza di quarantenni, ieri sera, in forma smagliante, carico ed energico come non mai, ha introdotto nel concerto un paio di chicche da grande artista quale è.

1) Scaletta 2.0: si parla tanto di User Generated Contents, di Prosumer, di coinvolgere attivamente il proprio pubblico. Bene come applicare tutto ciò in un concerto? Semplice, facendo compilare parte della scaletta dei brani al pubblico! Ed in diretta ovviamente! E' cosi che The Boss ieri sera dopo un paio di brani di introduzione per scaldare l'ambiente ... è sceso tra il pubblico delle prime file chiedendo nel suo italiano imbastito "richiesta ... richiesta ... richiesta ....", ed ha raccolto 5 o 6 foglietti con i titoli delle canzoni più gettonate. Se ne è quindi tornato sul palco ... e le ha eseguite! Mitico!

2) Sound 2.0: tutti gli artisti in concerto fanno cantare le decine di migliaia di fan ... ma Bruce li ha fatti anche suonare! alla faccia del Prosumer :-) Come? semplice, più di una volta al termine del brano è sceso tra la folla, ha avvicinato la chitarra ai fan, ed ha lasciato che decine di mani strimpellassero le corde della sua chitarra elettrica ... bravo Bruce!

Il concerto è durato più di tre ore e Bruce ha saputo scaricato tutta la energia che ha sul pubblico, facendoci cantare e ballare tutto il tempo. Domanda: qualcuno sa la ricetta di come arrivare a quasi 60anni carico ed energico come The Boss? Graditi suggerimenti ...

Tutto perfetto quindi, tranne:

a) i primi brani erano quasi inascoltabili al secondo anello, la musica era completamente impastata, e al mixer ci hanno messo un po' per trovare le giuste regolazioni ... peccato.

b) E' vero che il concerto è andato un po' lungo (per noi meglio cosi) ma quando siamo usciti la Metropolitana era già chiusa ... forse con un po' più di organizzazione cittadina avremmo evitato un rientro avventuroso a più di 60.000 persone .... Peccato ...

AJ Styles, Rhino, ODB and a few others make the save.

*Samoa Joe and Kevin Nash teasing dissension, defeated James Storm and Robert Roode. Sting's music played and the lights flickered.

*Doug Williams defeated Masato Yoshino.

*Shantelle Taylor defeated TNA Knockout champ Awesome Kong in the $25,000 challenge to win the Knockouts title.

*In a World X Cup match, Kaz defeated Ultimo Guerrero.

*Booker T comes to the ring and calls out Samoa Joe. Booker says Kevin Nash is right and he can't beat him. Booker runs down a list of names he has beaten in the past. Joe says he will beat Booker in Houston in front of his friends, family and wife. Sting's music plays and he comes out and says he will be at Victory Road to see who wins.

*AJ Styles & Gail Kim & ODB defeated The Beautiful People & Kurt Angle. MMA star Frank Trigg attacked Styles. Kim got paperbagged.

Upgrading to ESX 3.5 and VirtualCenter 2.5 Best Practices

The following are best practice procedures when upgrading to VirtualCenter 2.5 and ESX Server 3.5:

To be done on VirtualCenter:

Backup your VirtualCenter database. VMware recommends detaching the database and copying it to somewhere safe.
Grant the System DSN user of the VirtualCenter Database db_owner privileges on the MSDB database as well as the VirtualCenter database.
Ensure that your ODBC System DSN is using the proper driver. You must have a SQL Server driver if your database is SQL 2000, and SQL Native Client driver if using SQL 2005.
Log in to your VirtualCenter server with a local Administrator account on your Windows system to run the installation, do not use a domain administrator or a domain account.
Perform the upgrade to VirtualCenter to 2.5 and ensure all your data is visible in VirtualCenter 2.5 after the upgrade.
Ensure no processes are running that conflict with the ports that VirtualCenter uses, such as IIS.

To be done on ESX Server host:

If there is a SAN connected to your ESX Server host detach the SAN before continuing with the upgrade.
Confirm that all the virtual machines are now migrated from the ESX Server host or powered down, and that ESX Server host is no longer part of an VMware High Availability or DRS cluster.
Download the newest version of the ESX operating system ISO image and burn it to CD.
Place the CD in the CD-ROM drive of the host and boot from the CD.
Install ESX Server 3.5 with a fresh install or upgrade.

Note: A fresh install wipes out all previous network configuration.

Day 3; Bravissimo Simone ! 7-6 7-6 3-6 7-6

Mister Simone Bolelli, made my day perfect by winning his 2nd round match by defeating Fernando Gonzalez in 4 sets, 7-6 7-6 3-6 7-6. Just like I predicted in a few posts below.

With this second round win, he's experiencing his best Wimbledon-run so far in his career.

He won the first two sets in tiebreakers, 10-8 in the 1st and 9-7 in the 2nd. He fought really hard to obtain a 2-0 lead in sets. While giving away the 3rd set, partially caused by himself and by the better form of Fernando Gonzalez. Simone Bolelli lost a bit of momentum, causing him to fall behind 1-3 in the 3rd set.

As a huge fan, I believed in turning the score around and lead again on the scoreboard... He then held serve, broke back and held again, to lead by 4-3, I guess he heard my prayers :-)

Fernando Gonzalez then held serve to level to 4-all. Luckily Simone Bolelli didn't give into the pressure of the 14th ranked player in the world, and having never won to him. He hold his serve twice, same for Fernando Gonzalez, to get another tiebreaker. His first match point was the right one, winning the last set by 7-6 (4).

In his next match, Simone Bolelli will face Lleyton Hewitt. I'm really anxious for this match, because I do believe Simone Bolelli can beat him in 5 sets. Most people would say I am crazy, but I do believe Lleyton Hewitt is beatable by anyone, simply because he isn't a very good player anymore, and his mental aspect of the game is extremely vulnerable, even more than before.

Forza Simone ! Credere è la chiave a successo !

Day 3; Serena struggles through 6-4 6-4

The sixth seed, Miss Serena Williams, didn't have it easy today against Urszula Radwanska. She was constant leading, but yet, she always managed to lose her margin during the first set.

Eventually she pulled through 6-4, and went on to win the second set by 6-4. I was kinda nervous, because of the fact that she was playing her 2nd Round on the Court #2.

Luckily Serena Williamswas prepared and ready to win this 2nd round match to advance into the 3rd round.

Next she will play Amelie Mauresmo, which i suspect to be a straight set win. Ok, Amelie Mauresmomight have some suprises, but that was in the past, right now, she isn't even playing with a Top-10-level. Which she clearly needs to challenge Serena Williams on grass, especially at Wimbledon.

This match will be played Friday, probably the 1st/2nd match on Centre Court.

I predict Serena Williams to win by 6-4 6-2.
